He opted out - said he drove cattle trailers with Jake and George. Says both were trustworthy and reliable. Never heard so much as a curse word from either of them. Said he arrived after BCI was going through Wagners' trailers - some belongings left out in rain.

IMO, who is this guy kidding? Surely, he isn't talking about the W bros?
Well maybe he only heard mother frickers and didn't consider that a curse word. LOL

I feel so bad for the families, the emotional turmoil going on after week and not to mention the financial cost of missing work, travel etc. has to be a heavy burden.

I don't know... I see Zero defense of the actual charges. What are they going for anyway?

They better hire Raisin as a consultant... and fast.
I just was catching up and when he's questioning Mr. Staley the prosecution objects because it was a yes/no question and the witness went on and on. Then Nash says something like unfortunately when I ask these questions you are going to just have to answer yes or no.

I'd have to agree so far there has been nothing in 9 witnesses to show any type of alibi or refuting that he was there that night.

If GW was not at the murders - tell us where he was
If GW was at the murders - case closed
If GW did not plan on the murders - tell us why he did the things he did and the things he said
If GW did plan on the murders - case closed

Gosh... I realize the defense has little to work with but this defense is useless so far.

I copied and pasted it from YouTube subject line:

Oh I wasn't blaming you - I figured you got it somewhere from MSM - I think I will keep mine the way it is - Day 42 today - as I have not counted the other days when the jury wasn't there. :)

I have suspected that maybe the defense thinks he was involved. Let's say the believe he was involved, they can't ask questions that they know will produce a lie right? They can't present an alibi witness because if they know he was with them, then anyone they present to say George was with us, will be a lie. So instead they are presenting the suggestion that he was home. They have put on witness after witness about George being a nice guy, George was a good worker, etc.

I'd say they will put the BCI agent on the stand that said you are a witness or a participant or something like that to show BCI wsa trying to manipulate him into saying he was involved. They have picked apart each state witness to show they might be lying. Then they have an expert say it's possible one person can do this alone, but that person can't say for sure it was only 1 person. They aren't suggesting only one person did it either, they were trying to show Jake admitted to all 8 and this expert says it could have been done by 1.

I am starting to think they are defending him in a way that is legal to do even if they believe he did it.

IANAL so I could be wrong, but just what we've seen so far maybe it isn't so much trying to present him an alibi because that would be a lie and they know it?

IMO, this seems to be all mitigation steps.

Remember how many times he hassled the prosecution when their witnesses did the same?

09/30/2022SUBPOENAS ISSUED TO SAMANTHA STALEY; SKID MONTGOMERY; JEFF TACKETT; SHAWN FISHER; ANDREW CARSON; NATHAN WALLS; BERNARD BROWN; CAPT SETH HAGEMAN; SHAWN WALLS; OFFICER CANCER; ALEX STALEY; DANIEL VANCE WALLS ISSUED BY ATTORNEY NASH

0/07/2022SUBPOENA ISSUED TO BARBARA MOORE Attorney: NASH, JR, RICHARD M

So these are the witnesses the defense sent subpoenas too. I am guessing then that not all witnesses have to be subpoenaed since the pastors both testified and there are no subpoenas listed for them.

So we have seen the following:

Shawn Fisher - tattoo artist
Barbara Moore - George's divorce lawyer
Alex Staley - (took the stand today friend of George through is wife Samantha who took the stand earlier)
Andrew Carson - (friend who called Jake the morning of the murders)
Kelly C. Older pastor, knew the W's from Ohio and then in Alaska
Caleb C. - son of Kelly, friend of Jake and George as teenagers, now pastor of church the W's attended in Alaska
Bernard Brown - owner of land where the W's goods were stored while they went to Alaska to secure jobs/find home
The expert that testified Thursday.

Is this everyone that has testified so far? I feel like I am missing one. I thought 4 opted out the first day, then both pastors opted in. Then we had the expert on Thursday and then 2 today, one opted in and one opted out. Who am I missing?

This is probably the same way Parker defended Anthony Sowell, the Cleveland serial killer. He started out by saying there was no DNA, fingerprint or other evidence showing that Sowell killed the 11 women.

Parker used the same MO of delaying the trial as long as possible, in this case from Oct. 29, 2009 to June 6, 2011.

Sowell pleaded not guilty. The jury found him guilty and he received the DP

When Sowell appealed his verdict and sentence, his new appeals attorneys said Sowell had received poor representation from his first attorney (Parker) because Parker should have told him to plead guilty, then try to reduce his sentence to LWOP.

Interesting how different DP attorneys approach these kind of cases.

Also, a question if someone has testified for the state do they come back for the defense or does the defense just make their points when they are already on the stand. I see Samantha Staley and Jeff Tackett I believe both already testified for the state.

@pattinewberry

Here's the midday score on exhibits in @PikeCountyMassacre trial of #GeorgeWagnerIV after lawyers walked through evidence in the first three of four crime scenes. 1/8

The prosecution wanted about 340 photos entered from Crime Scene 1, where Chris Rhoden Sr. and cousin Gary Rhoden were found April 21, 2016. The defense objected to three photos with the judge allowing two. Physical evidence from the scene: 37, with no defense objections. 2/8

At Crime Scene 2, where Frankie Rhoden and his financee Hannah Hazel Gilley were killed, the prosecution wanted the jury to see about 230 photos. Wagner IV attorney John Parker objected to about 105, saying they were either too gruesome or not germane. 3/8

The judge allowed for about 45 of the photos Parker objected to. Physical evidence: 17 items, with Parker objecting to three. The judge took an unspent bullet out of evidence, but allowed the bloody diaper of a toddler rescued from the scene. 4/8

At Crime Scene 3, the prosecution wanted to enter about 210 photos. This was where victims Dana Manley-Rhoden, Hanna May Rhoden and Chris Rhoden Jr. lived. Parker objected to 50 photos, again because of their graphic nature or relevance. The judge allowed for all but 17. 5/8

Physical evidence at Scene 3 numbered 21, bloody comforters, pillows and sheets among them. Those were among the ones Parker objected to and the judge allowed. 6/8

The defense also brought on two witnesses for Wagner IV. Bernie Brown said Wagner was a good worker with a quiet personality. Brown owns land where the Wagner family stored their possessions during a year they spent in Alaska. 7/8

Second witness Alex Staley, who is separated from earlier prosecution witness Samantha Staley, called Wagner a friend. He said Wagner IV was emotional when the couple asked about the Rhodens two weeks after their deaths. "He started tearing up and got really sad about it." 8/8

My head is spinning and I've got splinters in my bum, this fence is very badly made!

Oh GW4, did you, didn't you. You did, you didn't. I spent time having a listen to this and that, like most of us have done no doubt. Just needed to refresh make new notes etc. But the bloody foot prints keep getting in the way. Why?

those prints were set up. They weren't George's foot prints because how could he have made a bloody footprint at DRs place? Don't tell me it was blood on his shoe from CRs home, no way. George had to walk out of that trailer then where to, Frankies or did he hop there, before going to DRs.

Whilst I know GW4 is guilty there's just too much missing to convince me and then I'm back to that bloody print over at Dana's. Where was the blood on the flooor that George stood in to leave a print? There wasn't any.

I now step back and chill my mind, if I can and hope to get off this rough fence.

edit: I do believe that the Jury will find GW4 guilty.
Just to add to the confusion; o_O At least mine, anyway.

There was a size 11, and based on a toe impression, a 10.5, shoe size left at CR1's. They found one size 11 print at DR's.

She was on her phone, well, on FB, according to JW Was she using her phone for FB? (Did he finish her post for her? 1668541572559.png)

--------------------------------------------------------
  • The brothers and their fathers then went to Dana Manley-Rhoden’s house. The door was unlocked, and they all went inside.

  • He said George and Billy were both inside that house, and that George had his .40-caliber Glock pistol out and even had it in Jake’s face as he came out of a bedroom. Jake Testifies at bro's trial
I thought G4 was said to have used an SKS. His own iirc. What did Big Daddy Billy have?
-------------------------------------
From link below: Jake indicated that he wore the size 10 and a half that night and that george wore the size 11 that night
um and you will see that that size 11 that i told you that was in scene 3 at dana's place is almost exactly where he
says that george was stationed to make sure that little chris didn't come out of his room. Jake's Proffer in Opening Statements

There is a high probability to link donor DNA to the shoe sole for up to 300-400 steps, regardless of the underground, blood location, and amount of blood. (that's .14 to .19 miles for an average 6' male) A lot of driving was done so there should have been some blood traces picked up by luminol, at DR's, if they were the same bloody shoeprints at CR1's, or so it seems, although I'm not a professional in that area by any means. Persistence of blood (DNA/RNA) on shoe soles under varying casework related conditions
JW says his father was standing right beside GW4, while JW was murdering all three people at DR's. They were concerned about the 16 y/o coming out and killing them? Nooo, I have never bought that.I'd have been more concerned about DR pulling something out of her bedside drawer, and firing when she saw JW (through her closed, oops, opened, uhm, closed, bedroom door ).

Out of curiosity, has anyone found a link, as to what size of shoe that G3 wears? I may be looking over his shoe info. TIA!

man....Angela just showed the pic she had in her hand of one of them deceased, by accident id imagine. not sure which one it was. Parker flashed one or two of the more gruesome pics, as he calls them, that he gave to the judge

Just like the prosecution, they've been called to testify. The defense has questions that may not have been covered, or they want to reiterate, from previous testimony. They're not really testifying for or against either side.

Defense continues to object to specific autopsy photos etc. and is overruled pretty continuously.

On to another set of autopsy photos for Gary Rhoden - prosecution says they used 47 out of more than 140.

Autopsy photos for Hanna Rhoden - 47 out of 97 photos used. The defense is objecting to 12 or more. Prosecutors saying they would only have two left.

I didn't take it that way. I know you like to keep your records orderly as I do too. :)

Time management is not a skill that Deering seems to have acquired.
Time management is not really a thing in courts. The behind the scenes, cannot be time managed. The federal holidays cannot be managed. Illness, vacations, births, deaths, cannot be managed. There is no time clock.
