I'm sure they did investigate all the accounts and they still have good evidence that she lied. She just got her "version" of the story out in the news media before the state did. Actually, her attorney should catch some trouble from the judge for doing this. Yes, defense attorneys do scummy, dishonest things to defend their clients, but the court does have rules they're supposed to follow.

I have a feeling if Fred Wagner ever gets out from house arrest, she's going to be making the rounds of all the tabloid talk shows, telling her tale of woe about her murdering family. Wait until all these talk show hosts find out her son has tattoos from violent white supremacy groups and all were obsessed with a violent, vigilante-style B movie with heavily racist overtones.

It will be interesting to see how the public reacts to that.
She will likely charge a nice penny for them as well.

Boy it sure has been busy on here the last 12-24 hours. Have I missed something?

In just 48 hours (Wednesday 1:30pm) AW will be having her Pretrial. It will be streamed live like all the others.

Will anyone be up town that day? I’m thinking about maybe doing a live podcast if people want to listen or show up. If not I’ll just keep track of everything new that gets brought up

It's busy because of Fred's video interview and all the controversy it's causing. And the suspicious timing of the Oxygen show so close to her interview. Plus, we now have photos and more information on the BPV's.

Yes do a podcast and link for us, thankx.

Wouldn’t this be considered tainting a case and/or jury pool? This is a first for me to see a defendant and their lawyer present a portion of their evidence to the media before a trial. Perhaps I’m overthinking it.

I will most likely just record it unless I can get a piece of equipment to do it live by then.

I think things are going to start heating up come Wednesday. We will see what the W’s overall goals are.

In honor of St. Patrick's Day I'm sharing one of my favorite expressions. Obviously Fred must like it as well............
Never-let-the-truth-get-in-the-way-of-a-good-story.jpg

I'm still trying to wrap my head around this mornings The Plain Dealer article. I guess at this point, nothing should surprise me.

Does anyone think the timing of last Friday’s “Motion to Dismiss Indictment” was a coincidental prelude to today’s feature article on FW?

No verifiable facts in that story, just spin, and theatrics. Could easily be fiction. Possibly unrelated facts woven together by FW and her attorney into a story.

All we know for fact is there are two BPV's in evidence and documentation from Amazon (it's content and relevance unknown) and that FW perjured herself in her GJ testimony. We have no idea how those facts might actually be related in the Indictment.

I have a hard time believing that AC and her team have made such a glaring mistake on receipts. AC is too sharp. But in the meantime, FW has gotten her publicity machine going and there is no one that can challenge her version of the story because they are under a gag order. On the surface, the Prosecution was made to look foolish and I guess that was the intent of the article.

Rather than dismissing the current count of Obstructing Justice, I think I’d add another count for discussing her Grand Jury testimony again in this interview.

MOO

ETA - I will go back and watch FW's court appearance again, and make corrections if needed.

I totally missed this! Your right, Fred is definitely discussing her Grand Jury Testimony in her video interview. AC accused her of doing this before but she wasn't held in contempt and...My 2 Cents...on why she wasn't held in contempt is because I think this information came from the "confidential reliable source."

But NOW Fred herself is blasting her Grand Jury Testimony all over creation, the only "source" here is herself, and she's not keeping it confidential!

Will AC address this interview, that includes GJ Testimony, at the next hearing? If the defense is under a gag order will the Judge find them in contempt of court? Would just the lawyers be in contempt or Fred too?

If there is no gag order the prosecution will likely insist on one now---with the GJ testimony revealed in the interview---there are grounds now to get the gag order.

.........2 Cents.........o_O

I was born in Appalachia,, Ky
Just because Jake Wagner was able to fool Dana & Chris into "accepting" him for a while that justifies him killing all of them when Hanna broke up with him? If you don't think that's true, what's the point of bringing up the fact that Jake Wagner lied and weaseled his way temporarily into the Rhoden family?

Well for one, I have NEVER said what that family did was justifiable, so maybe you should read back through the threads and see that I am 100% hoping they ALL get the needle if they are in fact responsible. You don't know me, you don't know how I know a lot of things so I would appreciate it if you would have your opinions and let me and others have ours. You jump on other posters for their opinions, not everyone has to agree with you.

You have judged people without even knowing them, their lives and the backdrops. You post as if what you say is gospel and others are wrong. So unless you know "facts" to back things up your opinion is just as good as mine or others here. MOO

Thanks. Hadn’t seen this before. This wasn’t in the investigative grand jury though was it? This seems to be done after the arrests were made. I could be wrong MOO

These interviews were just recently done by Fred with her attorney posted March 17, 2019. I will link you to a couple articles.......I forgot, this first one has her videos in it, definitely look at this one, this is the original article......

......FREDERICKA WAGNER'S ATTORNEYS GIVE ARGUMENTS FOR DISMISSAL.....
**********************************************************************************

In Friday’s filing to dismiss, Wagner’s attorneys state “the sole basis for both the obstruction of justice charge (Count 1) and the perjury charge (Count 2) was Frederica’s July 24, 2018, testimony to a Pike County investigative grand jury.”

According to the dismissal motion, Wagner testified she personally purchased two bulletproof vests taken as evidence from her house by agents of the OhioFace of Criminal Investigation (BCI.) However, the defense states Wagner testified she purchased the two bulletproof vests after the Rhoden homicides. The filing also talks about Wagner being confused as to where she purchased the bulletproof vests.

“Dismissal is sought because… prosecutors made several false assumptions about the bulletproof vests, and then presented erroneous information to the indicting grand jury,” the dismissal paperwork reads in part. “The irrefutable facts known by both the state and the defense do not support a violation of the obstructing justice and perjury statutes.”

Friday’s filing goes on to argue prosecutors falsely believe the bulletproof vests were purchased prior to the Rhoden homicides.

“Both sides now know that is not true. They were in fact purchased on May 7, 2016, 15 days after the date of the Rhoden homicides.”

Lastly, the defense claims prosecutors falsely believed Wagner did not purchase the vests online.

“Once again the irrefutable evidence now proves that she did, although she bought them from eBay not Amazon.” During her grand jury testimony, prosecutors say a confused Wagner did state she purchased the vests on Amazon.

It is not clear from filings what importance has been placed on from where Wagner purchased the bulletproof vests. The defense team claims the motive for the purchase of the vests actually came from Pike County Sheriff Charles Reader following the Rhoden homicides.

“Mass hysteria ensued in the days following the discovery of the killings, culminating with the church press conference by (Reader) on Sunday, April 24 where he warned the citizens of Pike County to ‘arm yourself’… On May 7, 2016, Frederica, then age 74, took the Sheriff’s advice and bought two bulletproof vests online from eBay.”

The defense filing goes on to say Wagner believed she had reason to fear for her family’s safety because of their close relationship with several Rhoden family members.

"................Little evidence directly related to the murders likely is to be presented during the (current) pretrials, but there are numerous issues which should or could be settled in the next month or so, in addition to Frederica Wagner’s filing to dismiss all charges. One other significant issue could be decided Wednesday, namely a request by the defense for Angela Wagner for change of venue moving her trial out of Pike County.

AW had filed a motion last month asking for change of venue due to "pretrial publicity". It will be interesting to see if the judge grants her request and where it will be. Since the Plain Dealer ran the profile of Fred Wagner yesterday, my guess is they will move it to Cuyahoga or an adjacent county (Lake, Lorain, Medina, Summit, Geauga, etc.) JMO, AW's attorneys will prefer that for reasons related to jury selection.
I will most likely just record it unless I can get a piece of equipment to do it live by then.

Somewhat O/T but I learned that BWs lawyer (MC) is on another very high profile case.

"According to the filing, Owen said the special prosecuting attorney believed the two bulletproof vests were used in the Rhoden homicides. But Owen argues that the date of manufacture on the bulletproof vests proves Wagner truthfully testified to purchasing the vests after the murders."

1. I wonder if there is something on the vests for the belief in the first sentence.
2. Are they saying they can prove the vests were manufactured after 4/22 and made it to eBay 15 days later?

"She bought both from eBay. The PayPal receipts show Wagner made the purchases May 7, 2016, which was 15 days after the slayings."

The defense filing goes on to say Wagner believed she had reason to fear for her family’s safety because of their close relationship with several Rhoden family members.

In addition to any other relationships which might exist, murder suspect Edward Wagner is said to have fathered a child with murder victim Hanna Gilley, allegedly a minor at the time the child was conceived. Prior to the imposition of a gag order issued by Deering, prosecutors alleged a custody battle over the child was possibly at the heart of the motive behind the Rhoden murders.

In a bit of a holding pattern since late January, as has been previously reported, the story of the Rhoden family massacre is about to move into its next phase when the second round of pretrial hearings for all six suspects in the case begins Wednesday.

Family matriarch Angela Wagner is slated to be back in front of Deering for a pretrial hearing 1:30 p.m. that day. Pretrials for the rest of the suspects continue throughout the month of March and extend into April, when Edward Wagner will be back in court April 4.

Little evidence directly related to the murders likely is to be presented during the pretrials, but there are numerous issues which should or could be settled in the next month or so, in addition to Frederica Wagner’s filing to dismiss all charges. One other significant issue could be decided Wednesday, namely a request by the defense for Angela Wagner for change of venue moving her trial out of Pike County.

I noticed something interesting about the photos of those bullet proof vests.

Here's a larger version of the BCI photo

Wagner family matriarch asks judge to dismissed perjury, obstruction charges

It looks like the wall behind the vests has some kind of hidden storage area that was opened. The area behind the orange trim has studs and insulation, like an attic. The BPV's are covered in dust. It looks like these BPV's may have been hidden in some kind of attic storage area. LE must have done an extensive search to find that little hidden compartment.

If an elderly woman and her daughter are so concerned for their safety, fearing terrorists killing their neighbors, why would they purchase BPV's, then stash them away in a hidden compartment that is difficult to reach?

If you're concerned about your safety and fear a big shoot out, why wouldn't you have your BPV's where you could easily grab them? If you were routinely using them while you were outside working or riding on your farm, why wouldn't you just store those BPVs in the coat closet or in the mud room, where you keep your coat and boots?

Why would you hide your BPV's in a hidden attic crawlspace if you had nothing to hide?

This could be the big hidden clue:
"Lastly, the defense claims prosecutors falsely believed Wagner did not purchase the vests online."
Maybe they have proof they were purchased elsewhere.

Yes! I noticed right away when I saw these earlier that they have "white dust" on them, they look like they were stored away. Is something not adding up? Good call. (Drywall from being hidden behind a "secret" wall?)

Thanks, but I'm just confused about why people are defending Jake and spending so much time discussing his sex life with Hanna, the mother of his child and the woman he brutally murdered, along with her entire family. None of this is really related to the murders - they were about custody, not extramarital sex.

It's important to stay on topic in the discussion here. JMO. Jake has been charged with having sex with an underaged Hanna. It seems pretty clear cut, it was his fault, according to the law. Not much more can be said about that.

Sorry quoted wrong!
I know that makes me so mad! I emailed the guy and told him to get his facts correct, that it was a basic fact that he will need to know for all the trials .
