Oh. I had to think for a minute here. You mean what if the device only starts recording when Jake starts talking so it can't be proven that the inmate either did or didn't start the conversation, that no one can tell what was or wasn't said before Jake starts talking.

If that's what you mean then I believe Jake's attorney would get the wire evidence thrown out, for this very reason that you can't tell who initially started the conversation.
I believe the judge would throw out that taped evidence. The judge would need to hear how the conversation initially got started in the first place, and if he can't tell, out goes that evidence.

That is a very good theory! My take on your theory is that the Wagner's did purchase BPV's and wore them during the murders but then disposed of them.

Then as you said, they were afraid evidence would come out showing those vests were purchased by them so they bought 2 "fake" vests to create a "fake" paper trail. Throw those vests in and it's like a red herring.

In that case, they deliberately planted those 2 vests in Billy's bathroom and inserted different plates inside that showed dates after April 22nd.

Seriously, they knew they were being questioned which means they must have known they were in jeopardy of being searched, so why deliberately leave 2 vests where they will be discovered? Answer, because they wanted them to be discovered. If they did not want LE to find the vests, LE would not have found them.

Canepa said there is more to the indictment than Owen is revealing. She said you have to look at the 4 corners of the indictment. In other words, it's not as simple as he makes it out to be, it's not simply that Fred forgot she bought them on eBay rather than Amazon.

Owen seems pretty desperate to get potential jurors to believe the State is wasting it's time prosecuting an innocent matriarch. And it is working somewhat. I've read all over SM people's opinions that the State is railroading an innocent grandmother because they really don't have enough evidence to try her family..:confused:

If W(s) purchased an additional two vests as a red herring, wouldn’t there be a traceable transaction unless they were purchased with cash or untraceable gift card? IMO

What if the BPV were purchased after the murders, because BW et al feared LE would come after the W in a big way (which they did, crashing the gate, etc., even brought an ambulance to at least one raid). LE obviously had a concern - waiting to arrest at a time when they knew the suspects were separated from each other, and away from potential munitions.
Rightfully so - it was a huge concern, if the confidential resource is true that revenge was discussed.

It might be but the vests were found in 2017. It's hard for me to understand why the 2nd vest would be at the farm tho.

Well, whatever that was, I missed it. Was in the process of putting it up on the big screen, hoping to get better audio. The Judge was going through the usual opening formalities, and ... "we are adjourned."

Waiting for the youtube to get posted so I can see that whole 30 seconds again.

Ok, thanks, so next Wednesday then. Wonder what's up? Seemed to be a lot of shuffling and consternation in the minutes leading up to the beginning of the hearing.

The defense seems a little worried?

Not sure myself. I caught the brief exchange just after the defense table sat down, F's head was spinning to find her best ear, but I missed the pertinent seconds of the hearing.

She didn't seem to have trouble hearing R when they were sitting in the back.

Fredericka Wagner was scheduled to be in court Tuesday afternoon, but during what is sure to be the most-brief appearance by a member of the Wagner family during the Pike County massacre hearings to date, her attorneys asked for the case to be continued to June 12th.



Federicka Wagner and her daughter have arrived for her pretrial hearing. Her attorney has filed a motion requesting all discovery which was due April 30. He also wants all search warrant affidavits for her property. She is charged with perjury & obstruction of justice @Local12

My 2 Cents ... Her attorney Owen is sharp ...:cool:... If he finds even one (i) not dotted, or one (t) not crossed --- pertaining to the search warrants of her property --- then he will try to get the search warrants tossed out along with the case against her. Illegal search warrants = no bullet proof vests = no case against her...:eek:
