Despite the murder of his pregnant girlfriend, the prosecutor says he can't charge Ferraro with the death penalty. "The fetus has to be viable in order to permit a death specification," said Franklin County Prosecutor Ron O'Brien.
Family and friends stood together on Thursday to remember a young, pregnant woman whose life was taken one year ago.
“Our lives have forever changed,” said Samantha’s mother, Winnie Chutes.

The man accused of killing his girlfriend and her unborn child has pleaded guilty to murder.
Jacob Ferrero, 24, admitted to the charges of aggravated murder, murder, aggravated arson, and gross abuse of a corpse, for the death of his girlfriend, 22-year-old Samantha Greenlee, who prosecutors said confessed to beating her with a baseball bat before he strangled after an argument. The Franklin County coroner confirmed Greenlee died from blunt force trauma to the head.
Jacob Ferrero has been sentenced to prison for 45 years to life for murdering his pregnant girlfriend, Samantha Greenlee, and her unborn child.
McCarthy reported 10 sheriff's deputies were in the courtroom for Ferrero's sentencing. His family and Greenlee's family members attended as well, and they had hoped Ferrero would be sent to prison for life without parole.
"After 45 years, he could still get out and live free for another 20 years or so," dad Douglas Greenlee said. "I don't think the justice system looks at it the right way."
