OH - Samuel Dubose, 43, killed by Cincinnati LE during traffic stop, 19 July 2015

WOW. I just realized that all 3 Univ. LE were prowling out of their usual territory....Did RT call them for back-up? Why? JMO

Hard to say, but they listen to each others radio traffic, and can and do start heading in that direction, hoping to get in on the action.

Looks like they were there, laden with body cams, at the end of the street or we would not be able to see their view of the car and RT on the ground, a considerable distance, before the car came to rest at the corner. Also, the front wheels are pointed at a sharp left angle, and if it impacted the pole it must have bounced back away from it???? JMO No wonder they are being investigated.

Did the other two officers testify under oath to the Grand Jury? If so, methinks they are in BIG trouble. JMO

  • #84
They probably did testify. But the grand jury had all body cam footage.

From the Kidd body cam I heard "you can make a killing around here between 4 and 6...lots of violations". I believe he was talking to a Cinci Officer, in a friendly chat. Nice choice of words.....JMO

Why does everyone run these days? Absolutely not a reason to be killed, but I don't understand why people run.

Perhaps it's because they sense ill will........they don't want to be banged up on some trumped up charge or even......get shot.

Coach on Tensing: 'This guy is not a monster'
The Cincinnati Enquirer
By Jason Williams
July 30, 2015

http://www.cincinnati.com/story/news/2015/07/28/know-officer-tensing/30810035/

To get the context, it is important to read the whole article, but this point is particularly interesting to me:

"Deters’ comments, however, raise questions about what’s not known about a guy who’s been in headlines across the globe in recent days. Among the unknowns: What led Tensing to quit the Ohio State Highway Patrol after just one day on the job in September 2013?

Jobs with the state highway patrol are considered highly competitive and prestigious. An applicant is required to pass a months-long, rigorous background and interviewing process. Tensing started the state patrol’s 26-week academy in Columbus on Sept. 18, 2013, but quit the following day, patrol spokesman Sgt. Vincent Shirey told The Enquirer.

Tensing cited his reason for leaving as he “couldn’t adapt to the training environment,” Shirey said. Additional information on Tensing’s time with the highway patrol was not available Thursday, and the state is processing an Enquirer public records request seeking his full personnel file."

I'd think that if I killed someone, even if I believed I was justified in the killing, the last place I'd want to be is in similar circumstances.

Overall, a very good article. Includes a brief and what appears to be a slowed down, easy to see, version of the actual shooting. Also, lots of links to other relevant items.

The Sam Dubose Police Report Is Full of Falsehoods From Ray Tensing’s Fellow Officers
Slate
By Jeremy Stahl
July 29, 2015

“University of Cincinnati police officer Ray Tensing was charged with murdering Sam Dubose, an unarmed black man who had been pulled over on a traffic stop, it was clear that the police body cam video of the shooting played an enormous role in the indictment.

Hamilton County Prosecutor Joe Deters said a prosecution became urgent “especially after we saw the tape.”

“I think it’s a good idea for police to wear them,” Deters said when he was asked if there would have been a prosecution without the video. “Because nine times out of 10 it clears them of wrongdoing. And in this case, it obviously led to an indictment for murder.”

Cincinnati Mayor John Cranley added that “this case is going to help the cause of body cameras across the country.”

Mark O’Mara, a lawyer representing Dubose’s family, was even more forceful.

“If we didn’t have a video, I do not believe we would have had an indictment,” he said.”

No Charges Against 2 Officers in Traffic Stop Shooting Probe

http://abcnews.go.com/US/wireStory/campus-officer-charged-murder-ohio-job-back-32808468

The Hamilton County prosecutor says the two officers arrived as Tensing reached into the car. He says their official statements about what happened matched what was shown on Tensing's body camera, and neither of the two officers said in official interviews that they saw Tensing dragged.

2 backup officers at Samuel DuBose shooting scene won't be charged
http://www.latimes.com/nation/la-na-cincinnati-shooting-20150731-story.html
After the shooting, Tensing claimed that he shot DuBose because he was being dragged by DuBose's car. But Tensing's body camera footage appeared to contradict that claim.

Hamilton County Prosecutor Joseph T. Deters -- who has vigorously criticized Tensing's handling of the stop -- said there was "confusion" in an initial incident report that implied the other two officers saw Tensing being dragged.

"That was not a sworn statement by the officers and merely a short summary of information," Deters said of the initial report. "When the officers were specifically asked about what they saw and heard, their statements matched Tensing’s body camera video. These officers have been truthful and honest about what happened and no charges are warranted.”

In the interviews they gave to Cincinnati police and the testimony they gave the grand jury, the officers' accounts conformed with what was shown on Tensing's body-camera video, Deters said.

News 5 Investigates: Ray Tensing's body cam video, frame by frame

Tensing told officers at the scene he shot DuBose because, "He was being dragged from the vehicle and had to fire his weapon."

When viewed sequentially, the frames of Tensing's body cam video seem to suggest Dubose's car did not move until the fatal shot was fired.

This is what I thought happened since first looking at the video. I think the car only moves forward significantly after he is shot. And if the officer was dragged it was after that point.

So here is a question I have. If it turns out that he was not being dragged by the car or at least not until after he shot Mr. DuBose. Why shoot him? He knows he has a body camera on. Did he just get angry because DuBose started the car in an attempt to leave? I say this with the understanding that Tensing has not been to trial yet, has not presented any evidence and is innocent until proven guilty. Just curious about what others think.

I think he was angry but I have no idea what was actually going on his head when he shot, but I'm going to guess he didn't care about the body camera because he thought he'd get away with it.

Do we know how long his department has been wearing body cams? I'm guessing not very long, so he might not have even thought about the body camera when things started to escalate. Since his car doesn't have a dash cam, it makes me wonder if there were zero cameras on this officer before they started wearing body cams, which is very scary to think about.

Clearly his personality type is the exact opposite of what a police officer's should be.

I think he had his gun out as soon as SD put his hand on the ignition key. He put his hand on the shoulder strap in an effort to stop him.
My take he wanted him stopped even if it took a shot to to do it.
I don't think he shot out of fear of being injured. I think he thought this guy was guilty of something and he was determined that he wouldn't get away.
IMO
