McGirt ruling could affect case of mother charged with killing children

A Nuyaka woman jailed for more than 18 months in the shooting deaths of her two children could face federal prosecution instead of going before an Okmulgee County jury this year due to the children’s Native American ancestry.

But in a motion filed Wednesday, Hall’s attorney, Travis Smith, said the Okmulgee County District Attorney’s Office does not have jurisdiction to continue prosecuting Hall because the incident occurred within the boundaries of the Muscogee (Creek) Nation and all three children involved in the case are members of the Creek Nation.

Smith attached copies of information showing the children were enrolled with the tribe for more than a decade before the case against Hall was filed. He argued in the document Okmulgee County should dismiss the case in light of the U.S. Supreme Court decision in McGirt v. Oklahoma, which involved 71-year-old Seminole citizen Jimcy McGirt’s child sex crime case.

In another case affected by a landmark Supreme Court ruling this summer, a federal grand jury has indicted an Okmulgee County woman on charges in connection with the 2018 shooting deaths of two of her children and the wounding of another.

Hall has been jailed in Okmulgee County since Nov. 1, 2018, after Kayson Toliver, 18, and Kloee Hall, 16, were found shot that day in their home, located near the community of Nuyaka, southwest of Beggs, the Okmulgee County Sheriff’s Office said at the time. She was charged that month in Okmulgee County District Court with two counts of first-degree murder and one count of shooting with intent to kill.



So - maybe that is why nothing is going on with this case - she now has Federal charges?

BEGGS, Okla. — A mother accused of shooting and killing two of her children in 2018 was indicted in federal court this week after a recent U.S. Supreme Court ruling changed how crimes involving Native Americans are handled.

A federal grand jury indicted Amy Hall on two counts of murder in Indian Country and one count of assault with intent to commit murder in Indian Country on Oct. 28, according to court records.

Hall was charged in state court for the shootings but after a U.S. Supreme Court ruling on how some tribal cases are prosecuted, the state dismissed the charges because they lacked jurisdiction.

Hall remains in the Okmulgee County jail.

Hall is scheduled to have an arraignment hearing in federal court on Nov. 12.

Nuyaka mother accused in killings of two children indicted in federal court

Amy Leann Hall, 40, faces two counts of first-degree murder and one count of assault with intent to commit murder in Indian Country, according to the indictment, filed in Muskogee federal court.

Hall has been jailed in Okmulgee County since Nov. 1, 2018, after Kayson Toliver, 18, and Kloee Hall, 16, were found shot that day in their home, located near the community of Nuyaka, southwest of Beggs, the Okmulgee County Sheriff’s Office said at the time. She was charged that month in Okmulgee County District Court with two counts of first-degree murder and one count of shooting with intent to kill.


Toliver was found dead in the house, while Kloee Hall, who previously has been referred to as Kloee Toliver, was declared brain dead about a week later. Authorities have also spelled Toliver differently at times.


While the federal charge of assault with intent to commit murder in Indian Country is vague, state prosecutors had charged her with shooting her 14-year-old daughter. County investigators said at the time that the 14-year-old daughter disarmed her mother after being shot.

An 18-year-old who was staying the night, an acquaintance of Kayson Toliver’s, was not injured.

Hall was indicted in federal court after the public defender representing her in her state case challenged the charges on jurisdictional grounds. A hearing is scheduled for Wednesday in Okmulgee County District Court to consider a motion to dismiss the state charges based on the Supreme Court ruling, according to an online docket.

The challenge cited a July 9 Supreme Court ruling that Jimcy McGirt, a member of the Seminole Nation, couldn’t be tried in state court for crimes that occurred within the 1800-era boundaries of the Muscogee (Creek) Nation because Congress never disestablished the reservation.

Amy Hall is charged with murdering two of her teenage children and trying to kill her third child nearly 18 months ago, in their home, outside of Beggs.

"I heard a gunshot. I hurried up and ran to the bathroom right there in our room," said Nikole Toliver.

She was 14-years-old when she survived the shooting. For the first time, Nikole wants to talk about that night and her belief that her mother should not be taking all the blame alone.

"When she was doing it, nothing went through my head until after and then I looked at my head and blood all over me," said Nikole. "I turned around and she had the gun in her left hand and she was pointing it straight. It was like all in slow motion, like I just grabbed it and she ran and that was it."

Nikole's older brother, 18-year-old Kayson and her older sister, 16-year-old Kloee, were killed; but, Nikole is not ready to talk publicly about them yet.

Nikole admits her mother had a history of mental illness and even heard voices and would go into fits of anger that could last days, but Nikole says it never got to anything close to this level. Nikole believes someone put the idea into her mother's head or helped her plan it or in some way encouraged her mother's actions.
