He pleaded nolo contendere to the second-degree assault - as my criminal law professor (who is a public defender) said, "it makes my job easier when the only witness is dead."
If it was planned he is an idiot.
Any life insurance policy in the world would dispute this payment.
The family will dispute the will or file a wrongful death so a financial benefit is not likely.
Oklahoma allows prosecution for foreseeable outcome of an act even if the intent was not death or bodily injury. If the prosecutor calls this an accident instead of a reckless act with a foreseeable outcome he should be removed from his job.
Was the gun legally owned? If it wasn't and owning it was illegal that is another avenue with death resulting as a result of a criminal act.
If he goes to trial, that should be interesting. Listening to testimonies of how they did this in the past. WOW and OMG is all I can say. Judge and attorneys will surely need a drink after that.
OKLAHOMA CITY -- The Canadian County District Attorney has charged a man with manslaughter after he admitted to shooting his wife in the head while the two were in bed.
Oklahoma County District Attorney Michael Fields said Sedille "created an unreasonable risk and probability of death or great bodily harm" when he put the gun to Rebecca Sedille's forehead.
If convicted, Sedille could be sentenced to at least four years in prison.
There are a few factors here which I find disturbing, including the age difference and the vast difference in their interests as stated on FB.
He entered prison in September 2011 & his first parole hearing is set for December 2015. Regardless, his sentence is up in December 2016. Then he has 9 years of parole. So he got a bit stiffer sentence than the four years.
