Opening Statements

Kurtz just indicated that Bella got up after Nancy left on her jog. Wonder why he wanted the statement in that Bella saw Nancy that morning when even he admits the little one got up after Nancy left ?

No castings made of tire tracks at the dump site to compare to Cooper vehicles?

Very effective opening for the defense. Going to be hard to ignore 16 different witnesses that say they saw her jogging that morning. Explaining the different shoes (one pair by the garage door, 1 by the front door). Home phone wasn't voip, which is key. He didn't trash Nancy (which is good). Made Jessica Adams look like a liar about the painting. Dealt with the garage issue by saying that it was still too cluttered to fit a vehicle in. Tire track at site couldn't have been made by the Cooper vehicles. Dealt with the scratches or lack of scratches...the reason Brad didn't call the Rentz family (or his own). And really showed a rush to judgement by CPD. The prosecution has their work cut out for them since this is a circumstantial case to begin with.

Just indicated their are photos of Nancy without the necklace. That it wasn't true she never took it off.

He has really made Detective Young look bad. Indicating he deliberately lied on search warrants about information that he knew was wrong. Example is saying that Brad never called Nancy while she was on vacation even though he had records that they talked daily. Also, it's a huge deal that Young wiped out all the data on the phones. How idiotic is that.

It sounds like the phone is going to be very important ... since he's spending an awful lot of time on it.

It also sounds like affidavits were sworn even though the content wasn't entirely true.

It will be interesting to see if the prosecution is able to whittle away at the shadow of doubt the defense has now laid out about the competency of the CPD

If they are correct in what they are saying, not entirely true is being kind. Taking out a search warrant on a phone that you know the data is already gone, because you were the one that deleted it is darn near criminal. That's cya material there.

Again, I still don't have an opinion on guilt or innocence, but the defense has done an excellent job of explaining things away and introducing reasonable doubt during their opening arguments. And 16 eye witnesses saying they saw her is going to be hard to get beyond. That and the tire tracks at the scene. That's actual physical evidence that points to someone other than Brad, unless it isn't as the defense portrayed it.

This is not evidence, it is merely a lawyer attempting to defend a client, as he should. But as the judge told the jury, it is not evidence and it is not to be considered, it is but a forecast of how the lawyer intends to prove his point.

I'll wait for real witnesses before I buy either the ADA or the Defense statements. Show me the proof. Now I understand why this case is estimated to be 8 weeks.

I too have no opinion about guilt or innocence. I deliberately avoided most of the earlier discussion, articles and affidavits for the very reason that we are hearing about in court this morning - not all of it is true.

The defense case is being set up suggesting that the police were following the lead of Nancy's friends, and that Nancy was calculating and manipulative of information given to her friends about her husband and marriage. Still, opening statements are not sworn statements and we have yet to hear the testimony.

Of course it isn't evidence...neither was the prosecutor's opening statement. But if both sides present evidence to back up what was discussed in opening statements, the prosecution might be in some trouble.

Not if the DA backs up what they claim. I'll wait before deciding who might be in trouble - this is what is, nothing at this point.

I know that there are some grand misconceptions that we Canadians live in igloos and ride on dog sleds but we also, surprisingly, get warm weather. The city that Brad is actually from, Medicine Hat, AB, runs temperatures in the summer of 35 to 40 degrees Celsius (95 to 104 degrees Fahrenheit) and is actually considered a desert area. Given that he had been in NC for some time, I would assume he was acclimated to the area. So wearing a long sleeve shirt in July in NC would be odd for him, it would not be common just because he's Canadian. Sorry, hate when Canadians are stereotyped.

I'm sure you were kidding when you said it originally.

(Ok, but don't look at our temps now, they're horrible but it is winter).

Yeah. Was totally kidding. In fact, it should have been the opposite right? Like a folk from Canada would be running around nearly naked irregardless, 'cause it was warmer to them.

Mainly just trying to lighten the mood, because of my firm belief that this is going to be a fairly damning trial on both sides and may not turn out the way folks believe it should.

In fact, from the get-go, I've sort of thought him guilty, just not of first degree murder. I've been rolling around "crime of passion" and that better fits where they are heading here. Anger murder, messy cover-up, etc. etc.

Temperature always feels relative to me. If it's been -20 for a while, then 65 feels warm. If it's been 90 for a while, then 70 feels cold.

Does anyone know what time the trial resumes?

Except he didn't. He decided to put his car in the garage and load her body in there.

On the mark, SG -- Just what I had been thinking all along -- that would be the ONLY reason he would have cleaned up anything -- making the garage have enough room for a car for just a short time. I just don't see him doing any work around the house -- and it is a bit understandable since he is the one going to work each day. "Her" jobs and "his" jobs.... and ne'er the twain shall meet .... except when it comes to post-homicide time, then it's clean, clean, hide, clean, vacuum, wipe, etc., etc. Quite the housekeeper, IMO. :maddening:

Just realized they were back. Who is on the stand, anyone know?

  • #180
The guy who found her body while walking his dog.
