My only thoughts to this is there is no way to prove HOW Caylee died. We know it was at the hands of her mother, but what we don't know is if it was an accident due to neglect or if it was intentional. The evidence (at least from what I have seen so far) does not say if Caylee was alive or dead before the tape was placed on. IF there were bite marks on the tape or Caylee's finger prints on the outside of the tape then I could definitely see a DP case. Right now, I think she could change her story to "accidental death that spun out of control". Even with all of her lies a confession of this would satisfy a jury. Along with some remorse, which KC seems incapable of showing. If she is convicted of Manslaughter and gets 15-25 years, she would only do half of that with good behavior. If the trial takes place in 2011...that means she would have already served 3 years and would only have 4 more to serve at minimum before she is out.

In my opinion...it is imperative that prosecution keeps DP on table. That would insure her of at least getting 25 years (the max for manslaughter) or LWOP. I don't think she will get the DP unless SA does a unbelievable job of explaining how Caylee died.
Two things: 1) she's not charged with manslaughter, which is what would be the result of an accidental death, and the defense also isn't claiming accident. You don't duct tape a person who died accidentally.
2) It's not necessary to prove manner of death to obtain a 1st degree murder conviction. Nobody knows exactly how Laci Peterson died, only that Scott did it and her body turned up in the Bay where he was "fishing".

No, no and no. Unfortunately folks have sunk to new lows trying to get attention from provocative sound bites and headlines. That is what that is. Nonsense.
This article should not be taken seriously, obviously the author is not a lawyer, nor a judge and only God knows what limited qualifications he had to have to write a opinion article.
Rest assured Lawson Lamar, Mr. Ashton, Mrs. Drane Burdick all know what they are doing. Compare their record to Cheney Mason's any day of the week. Mr. Mason is not the success story the author of that post has him pegged as. Indeed, Mr. Horsnby researched his record and you'll be surprised to learn he found that most of his clients were convicted and sitting behind bars, his latest one is on death row! He is very experienced, he is not some miracle worker. In the short time he has been on this case he has already made some glaring mistakes.

There is no plea offer on the table for Miss Anthony, nor will there EVER be ANY OFFER OF THREE YEARS. The State believes she committed felony murder, purposely and with malice against a helpless child. One doesn't get a three year pass for that. To suggest it is preposterous and ignorant,OR TO BE TAKEN AS A JOKE, imo.

I think he is having a little fun seeing who he could get to from zero to one hundred in ten seconds flat and write him scathing messages. If he is serious, he has a very , very poor understanding of how this matter can and cannot be handled.
I would just take the article as a goof, tell him to get in that long *** line and have a coke and a smile while he waits for his prediction to make it to fruition. If that prediction comes true...., I am the Pope! I am not even Catholic.
In Anthonyland, apparently you can be whoever you want to be. Mr. Lexus Nexis can play attorney. Dominic with his construction background can don a badge, copy a few documents from Muzikman on W/S, go on My Space and call himself an investigator. George who cannot even safeguard Caylee's little piggy bank from his thieiving daughter can work in security! Casey can be an event coordinator, after all she does line up the cups for beer pong. Cindy and George after sending away four thousand volunteers with TES can now be the authority on searching for missing children, and apparently Joy can solve the case, better and faster than all of them combined, even without the magic visions of Ms. Lucas.

You just can't make this stuff up!!!!!

If this trial was taking place in California I might agree. In Florida--no way--jmho.
True. I have to admit that I am originally from California so I am use to very sketchy sentences.
Strongly disagree, and I'm a California native, and lived here all my life, up and down the state. We're not talking OJ's dream team, or even Michael Jackson's or Robert Blake's jury.:snooty::snooty::snooty:

the only way i wouldnt convict is if she can produce a real person that took caylee from her, not some imaginary nanny or the guy who found caylee's remains, cause thats all nonsense
That's the only scenario in which I see them removing the Death Penalty from consideration.

4) Henkel duct tape – same brand and type found in home

Behavior evidence:
1) Lieing
2) Happy behavior- Dancing/ drinking/ partying /shopping
3) Hiding from family
4) Uncooperative in helping find daughter

If an accident:

What loving mother would tape up their baby’s face with duct tape to cover an accident? What loving mother would throw away their baby like trash? What loving mother would not care that a tropical storm is coming through and their baby’s remains are being ravaged by the elements? What loving mother would not worry or care about their baby’s remains being torn apart by animals? What loving mother would not care that their baby’s bones are being chewed on by animals? What loving mother would know all this is happening to their baby and then turn around and enter a Hot Body Contest? What loving mother would not feel guilt that under their care a child had expired and instead rent a movie about an abducted person with duct tape across their mouth … just a few hours after it had happened?

There is plenty against the accused and she ain’t walkin’...

No amount of sneezing on Casey's part will blow away all that is against her...

Who would get a tattoo like that when your child missing?!

Oh wait a minute - note to the defense: you can't use that because Casey wasn't supposed to know Caylee was dead at that point in time. :banghead:

There is only one way Casey could have the potential of walking away and getting away with this murder. I'm not going to write what I think Mason needs to do because I don't want to help the defense in any way. But it's pretty simple what they need to do, but it would be nearly damn near impossible to accomplish it.

So basically, I have every faith that Casey will get her just punishment. Even if Mason intends to discredit LE until the cows come home. He can squawk all he wants but no juror is going to overlook the big pink elephant in the room.

OK, JSR! Now I am going to wonder what you (and possibly Mr Mason) have seen that I haven't. LOL!

Does anyone remember those old western movies, when they have circled the wagons against attack and John Wayne is hunkered down with a rifle, staring out into the darkness? Then Wayne turns to his trusty sidekick ans says,"I have a bad feeling about this." That's where I am right now...in the dark with John Wayne and a 'bad' feeling. LOL!

I think that Mr Mason, while watching this case unfold (and no doubt reading the doc dumps)noticed something that he thought gave him an edge. Something to make him believe that he could pull this case out of the fire. He would never have stepped forward if he did not think he could accomplish what he set out to do.

I am worried about whatever loophole, misstep, discrepency, or whatever he noticed. Maybe he is of the opinion that Florida just can't afford to fight this case in a long drawn out battle. Maybe he believes he can discredit LE, the witnesses, or the evidence. I have no idea, but, like John Wayne, I still have a 'bad' feeling about this. I am afraid a lot of us are going to be disappointed by the outcome of this case. :( I sure hope I am wrong.

I do feel that there is something out there just beyond the horizon that might, just might, turn this case on it's ear. When I read posts like the one from "The World According' up thread just a bit, I start to breathe a little easier.

No matter what people think of him, CM is a lawyer with years and years of experience and I can't help wondering, like you, what he saw or what he thought of that made him take on this case - especially after the coments he made when he was just a 'talking head'.

Thank you kindly, Mac, for chiming in. I was begining to doubt my sanity, thinking that I was the only one who saw a huge black shadow looming. As you said, I think Mr Mason has more up his sleeve than his hairy arm. I watched him watching the judge, Baez, the prosecution and everyone else in the last hearing. He looked way too complacent and way too knowing for my peace of mind.

I think it's laughable. Controversy sells papers, that's why they write these articles. Circulation must be slow. His article belongs in the same section as the story about Sharon Osbourne removing her breast implants to give as paper weights to Ozzie. Good for a smirk or two, but not of any consequence.

CM has started the case with a severe credibility deficit- he has been very vocal in press interviews in Orlando, of his opinion of KC's guilt.. Now someone thinks he is going to appear like the Lone Ranger ( with Tonto) and rescue her from the dastardly SA. Nah

Cheney saw what every other local lawyer there saw, a train wreck, a mockery to their profession. We have heard from Mr. Nejame, Ms. Tennis, Mr. Sheaffer, Mr. Hornsby, and many others that opine to that effect. It wouldn't take much to convince him he could end his career working on the case of the century, imo. Go big or go home..that is the classic good ole boy motto, right?

Just taking a break to remind all you good folks that we always get a bit restless and paranoid when one or both things happen.

1) We get a shocking surprise which at first sight makes us think the case against Casey may have lost some ground. (read: Strickland steps down to ....insert unknown)

2) We don't have a really decent juicy doc dump to chew over. The last two have been the questionable River Cruz Blip, which we may never know how it will help, if at all. And the second one was the Casey letters, which set off a firestorm of was she or was she not molested - pitting poster against poster. Now we have the Maya info - again - good - but is it rock solid helpful.

I say bring on the evidence - give us Dom Casey's sworn testimony - bring us something big to lift our spirits.

Okay back to making Revenue Canada ....well if not content...to step back to their assigned desks.

BBM...thats one of many things that bothers me...it is not rare, and can be found here in my garage!

dont mean to be a pain...just dialog/discussion. I have lurked for a long time, wanting to get in on some of this, now I am probably not welcome I would imagine. but for the sake of dialog, again, I dont see it...I can doubt everything I have heard thus far.

With respect, it is exceedingly rare.We have entire threads on it. You may very well have duct tape, you may even have Henkle duct tape, but do you have this ( no longer manufactured ) specific, special strength duct tape made by their company? I could be mistaken, but iirc was never sold in Florida, or for a short period of time only. Go on to the search button and type in duct tape, you can read the threads and the actual reports, they are voluminous.

What I really wanted to tell you is of course you are welcome here. All day long. It is valuable to have folks bring up their concerns , it gives the prosecutors an idea of what potential jurors may question. Of course you are welcome here. The only thing I have ever seen that was unwelcome here was vile, unsubstantiated slamming, disparaging of someone with no proof whatsoever, and someone threatening one of our members. Just to have a different opinion, even if it is colorful.....that is what we want, we are here to discuss, not to preach to the choir. BBM: Probably OT but I will risk it - do we (as in WS we, not just the we who are reading this thread - does that make sense?) know whether Dom did have that investigative interview with LE? Guess I had better go find the Dom thread and ask there too.

So, no we haven't seen it and to the best of my knowledge, and believe me I hunt and watch for it, we don't know when it will be forthcoming.

But for someone who played a fairly substantial role, how could they not have taken it yet.

Given the sheer volume of work that KC continues to generate for the Defense to respond to and mitigate .... it could take the next 3 years to get to trial!

The Defense just gets their arms around the scope of the problem and a new front is opened for them to address.
