“Happily Never After: Dan and Nancy,” a new podcast from Wondery and The Oregonian/OregonLive, pores over the pages of Crampton Brophy’s life and novels to draw a revealing portrait of the self-published author-turned-killer.

Sure. :)

The appeal claimed there were a dozen errors in Brophy's trail, from the introduction of evidence found her laptop, to life insurance records that hadn’t been properly authenticated.

It also says that she shouldn't have been allowed to answer Prosecutor Overstreet's final Q during cross-examination which was “My last question to you, Ms. Brophy, is: If there’s one thing that you know about murder, is it that anyone is capable of doing it?”

Apparently he took that phrasing from her essay according to the article. The issue was... his doing that skirted the Judge's order not to directly mention her essay.

Yay me! I FINALLY found her essay, so THANK YOU @Niner for asking me to tell you what was in the appeal! I wanted it bad so went down a rabbit hole in old emails on the subject and BINGO! Found it. *grin*

But, I'm not finding that phrasing in her essay. The word capable isn't in the article, nor is anyone so I'm not seeing how he skirted the issue by "directly mentioning her essay".

She started the article with:

As a romantic suspense writer, I spend a lot of time thinking about murder and, consequently, about police procedure. After all, if the murder is supposed to set me free, I certainly don’t want to spend any time in jail. And let me say clearly for the record, I don’t like jumpsuits and orange isn’t my color.

Discusses motives and options, and ends with:

What if killing didn’t produce the right results? Would they do it again? Could they do it again? What if they liked it?
Whoa, there’s an idea for a new story.
