OR OR - David 'Dave' Lewis, 46, Ashland, 4 September 2008

  • #221
Ohhh me tooooo!!! Id love to go through those case notes.

MOO-This is my supposition-MOO Someone traveled to 12801 DIMR specifically to confront Dave and take what they believed they were entitled to that night. IMO It was planned and well executed leaving almost no evidence.

I don't know if he had a will, if he did, it could have been in the cabin. I guess he could have had something filed with a lawyer or it's possible he could've not done that yet as he was only 46. I'm sure his next of kin knows.

Either way anyone that knew him would know EVERYTHING would go to his sons. That was the whole thing about not sharing his inheritance when he was asked, he had HIS OWN CHILDREN to be concerned about.

In the end EVERYTHING (unless it was in a bank) was destroyed, so there's no legacy of his art or his tools or of anything besides the vehicles. IMO I find that to have been extremely personal and vengeful on someone's part; to leave nothing of him behind. MOO-It feels like jealousy to me-MOO

AFAIK and from what @Sleuth2010 posted above, any known money he possessed at his time of death (that IMO MOO wasn't stolen or destroyed by fire) went to his kids (one son was still a minor, so his mother, Dave's exwife JF would have been legally responsible)

...but that doesn't answer my questions about the inheritances...

Did someone benefit financially from Dave's death?
Did they inherit more than they would have had Dave lived?
Unless those checks were taken they burned in the fire. Were they ever reconciled?

That's the 20 million dollar question, isn't it?

I don't think Dave had any actual influence over anything that could affect what BMc was doing.
They were definitely building illegally, and Dave had been employed directly to build these (we now know) illegal structures.

IMO His ace in the hole was that he knew the sheriff MW because he lived on the mountain too and it's a small community.

David did say to me that he would/could tell MW the nitty gritty details of BMc misdeeds at the resort (specifically illegal buildings encroaching on federal property) I don't know that he actually did, but I think he thought that might have an impact if it came down to it but IMO I really doubt MW cared, he knew about the encroachment after the fact for sure and never acted personally AFAIK.

Any action taken against the resort or preventing further development happened by concerned citizens and neighbors going through the legitimate Jackson county commissioner land use process after Dave's death.

I haven't heard of other citizens being harassed or harmed as a result of holding this company accountable, so why would they want to harm Dave who was a regular patron of the resort and was just MAD that they had fired him for petty reasons?

Petty reason: He told me that they accused him of stealing returnable cans from a shed/outbuilding- he was shocked and hurt by the accusations, besides not needing the few dollars from cans, it was insulting after all the work he'd put in on the property.

He had no reason to actually report them but IMO he had a right to be angry and to voice his opinion about what was happening at Hyatt Lake Resort and even to THREATEN to report them.

However, there was no benefit to Dave for reporting them, no upside. There was also no financial benefit to the Resort if Dave was no longer present. They had the county's approval. IMO Dave wasn't a threat.

Like I said, it was not a secret that they were placing and selling manufactured "cabins" in the resort, they got the county's initial approval for the development; it was approved as an RV campground and Dave had nothing to do with that process, he was a builder.

I just don't see it myself. I understand others have their points of views and that's valid too. None of us know what happened except Dave and his killer and Dave's gone. He can't fight his battles anymore.

I would love to know!!

Excellent questions! Thank you @Lilibet ✌️

Factually, there was quite a commotion over the empty-can-riches. BMc & P****e :/ threatened David to get out of the lake... Dave told them they didn't own the lake. A, " verbal altercation," happened & BMc runnoft. Coward that he is. <modsnip>

Blue square is 40 acre parcel Dave lived on for at least 23 years, the larger lake is Howard Prairie and the smaller lake is Hyatt Lake (there's also a Little Hyatt Lake), they're part of the lake system that was built to feed the Talent Irrigation District that runs through the south end of the Rogue Valley in Southern Oregon. Due to exteme draught, the TID has not been able to supply water for irrigation for a few years. This year there has been significant snowfall, refilling the reservoirs. Fingers crossed for this year.

I’m so glad to hear you’ve been able to communicate with a JCSO investigator! I’d like to know if they’ve ever had a POI (person of interest). Also, who has been ruled out and on what basis? I’m sure I can come up with more after my coffee kicks in! :)
I asked these questions awhile back but, as we all expected, they're not able to share anything about the case.

One of Dave's friends is interviewed in this YouTube video.

DISCLAIMER: this video also depicts theoretical scenarios which may or may not be what happened.

NOTE: I obtained mod approval to post this one video

Of course, it’s quite possible that there is something in the autopsy results that only the murderer would know, so it wouldn’t be released until an arrest or trial. It seems to me that JCSO could at least reveal what is currently happening with the investigation and perhaps even why they won’t release any information, after almost 15 years. And it’s certainly worth asking JCSO if OSP is involved and if not, contacting OSP directly.

In my experience on the Stephanie Warner case, it was helpful to contact local TV reporters from the three stations, who had done stories previously and ask for a follow-up. I set up a new email that didn’t include my name for this purpose. The family wasn’t doing anything, so I did this as a private citizen, not a WS member (which we can’t do—against the rules). One eager-beaver reporter just starting her career at KOBI was extremely helpful and we developed a personal working relationship. She got interviews with the detective in charge, and with a formerly reluctant family member, scooping the other stations, so that kept the case in front of the public. And it was a good career move for her, as she ended up at a much bigger station in another state! If you can figure out reporters who are already into investigative reporting it’s even better. Even print reporters at the Oregonian can be inspired to do some digging. Or try Curtis Hayden at the Sneak Preview. He loves that sort of stuff! It helps if you’re willing to be interviewed, but they can keep your identity anonymous. Even if you’re on camera, they can film from behind and disguise your voice.
Thought you might find this article hopeful and positive, about Stephanie Warner. Hopefully they found her remains. The Jackson County Oregon Sheriff Dept., is on it with new cold-case determination. Terribly painful. She was young and wonderful.

Thanks so much for thinking of Stephanie @Sleuth2010. Yes, this news is definitely reason for hope. It’s been almost 10 years…a long wait for her loved ones. You certainly know what that’s like! I hope you get answers soon.

Case rapidly being solved, as always. Dave was never a " patron" of the resorts. Quite the opposite. Fishing buddies knew that. Limited use ( 10 day stay max ) Seasonal only ( summer )
restricted. Roll all the " RVs" off said the law man.

" Bob McNeely, who has owned the Hyatt Lake Resort since 2004, said the lake has been empty for the past three years.

"Thank God for the cross country skiers and the nordic ski club and thank god for the snowmobilers because in the wintertime we get very busy," he said pointing out that the business does well and is busy year-round but acknowledging that he has not been able to rent fishing and boating gear in quite some time."

Declared bankruptcy, meanwhile with the other hand...

FWIW McN must be thrilled with water levels now. We just drove past Emigrant Lake and it’s full. Haven’t seen it like that in ages. Same with Shasta Lake, with water to the tree line! So I imagine it’s the same at Hyatt.

This morning I'm wondering what Dave's parents would have made of his tragic death and the mystery that's surrounded it for almost 15 years. Dave spoke highly of them both, and I know he spoke to his mom regularly before she passed.

I'm hoping to get up to Hyatt and check out Conde Creek & Soda Creek rd in June! Maybe I'll see how much the "rv's" or vacation cabins around there go for.

The campground at Hyatt is closed this year for utility upgrades but the lakes should be nice and full for the first time in years.

We're going up to one of the mountain lakes for Memorial Day weekend. It's supposed to be in the 70's up there which sounds pretty great to me.

ETA: Soda Creek ✌️

What does any parent feel about their child's murder? They wanted the death penalty.

Interesting perspective. I don't think every parent of a murdered child is pro death penalty, but I'm sure some are.

Losing a child is absolutely the most devastating experience a parent can have, I'm grateful his folks didn't have to experience his passing and the enduring mystery surrounding it.

Just for the record, whoever killed David would not be eligible for the death penalty in Oregon.

Capital crimes

Aggravated murder is the only crime punishable by death in Oregon.[17][18][19][1] On 1 August 2019, Governor Kate Brown signed a bill that restricts the death penalty to four cases:
(1) acts of terrorism in which two or more people are killed by an organized terrorist group
(2) premeditated murders of children aged 13 or younger
(3) prison murders committed by those already incarcerated for aggravated murder
(4) premeditated murders of police or correctional officers

That's a great question. I was wondering about that back in February when I realized they were all going to a personal email & phoneline.
