Trial date scheduled for family suing Phoenix police

Day’s sister, Nelda Adkins of Coalinga, California, filed a $2.2 million civil lawsuit in Jackson County Circuit Court against the city of Phoenix claiming that the police department was negligent in its investigation, and limited the evidence that the Jackson County District Attorney’s Office had to work with in the homicide case.

The latest development, court records show, is that a five-day trial is scheduled to begin March 21, 2022.

Trial date scheduled for family suing Phoenix police

Homicide suspect Daniel James Burda, 38, who lived with Day and his husband as a handyman, faces charges of manslaughter, criminally negligent homicide, abuse of a corpse, criminal mistreatment and aggravated identity theft. The charges accuse Burda of causing Day’s death, hiding the body and using day’s bank cards.

Burda is in prison on unrelated charges while the DA’s office awaits an Oregon Court of Appeals ruling surrounding the evidence they’ll be able to present to a jury in the homicide trial.

Day (76) (former original Disney Mouseketeer, Phoenix, missing July 15, 2018, found April 4,2019, ID’ed Jun 6, 2019) – for *Daniel James Burda (36/now 38) arrested & charged (7/5/19) & arraigned (7/17/19) with 2nd degree manslaughter, 2nd degree criminal negligent homicide, 2nd degree abuse of a corpse, 1st degree criminal mistreatment, 7 counts of aggravated identity theft, fraudulent use of credit card & 2nd degree theft. Plead not guilty. $150K Bond. Released on 7/15/20. But wound up back behind bars after he was convicted of 3rd degree robbery in Jackson County & imprisoned at the Columbia River Correctional Institution on Feb. 9, 2021.
Was handyman for Day. Day’s car found 200 miles away on Oregon coast on 7/26/19. Day’s partner Caswell died in Sept., 2019.
Trial was set to begin on 8/10/20 continued with no further dates.

3/24/21 Update: The surviving relatives of Dennis Day, one of the original cast members of "The Mickey Mouse Club" in the 1950s, filed a $2.2 million lawsuit in Jackson County Circuit Court on March 24 after their federal suit went nowhere (Jan. 2021).
