I can't imagine him not being aware of what he was doing when he sodomized that girl...Such a sick . He sneaked into the family, spent Thanksgiving with them and took off with the girl. Sounds pretty smart to me.

He's fully aware of his actions, he has no remorse.

I've dealt with him directly (was a friend of a friend) in the past, and have discussed at length with his parents. Basically, he's never been 'right'. Professional help was utilized but it never made an impression. There have been multiple encounters with law enforcement, but it was basically property offenses. Personal relationships were dysfunctional, natch, but were age appropriate (except for the stalking behavior toward an ex). Long term alcohol and drug abuse have contributed to an inevitable downward spiral.

In short, he's a one-man chapter for the DSM...

PORTLAND – The man accused of kidnapping an Oregon City girl in early December was sent to the Oregon State Hospital for a mental evaluation on Feb. 20.

The evaluation comes after the defense for 40-year-old Kelsey McCune said it will use an insanity defense and argue McCune had a mental health defect when he allegedly kidnapped a 13-year-old Oregon City girl.

On Feb. 3, McCune’s attorneys said they would use an insanity defense after a doctor concluded McCune didn’t know his actions were criminal. Now, the Clackamas County District Attorney’s Office is having an independent mental evaluation done on McCune.

Back in early December, authorities thought the teen ran away, but later identified McCune as a suspect in her kidnapping. SWAT teams scoured areas of Clackamas County looking for the pair as a bitter cold snap set in with temperatures falling as low as 10 degrees.

McCune and and the girl were later discovered in a wooded area north of a mobile home park in Oregon City.

McCune is set to stand trial on April 15 where he will face kidnapping, rape and sodomy charges.

Kelsey Patrick McCune's twisted journey through the legal system ended Tuesday when he was sentenced to more than eight years in prison for having sex with a 13-year-old Oregon City girl he kidnapped last year.

But it was clear that the relationship between McCune and the girl was deep and complicated. Defense attorney Stephen R. Kelly said the two still had strong feelings for one another, and prosecutor Rusty Amos said the girl was "conflicted" over the criminal proceedings.

Both McCune and the girl were crying when Clackamas County Circuit Judge Kathie F. Steele sentenced McCune to eight years, four months in prison, followed by nearly four years of post-prison supervision. He also must register as a sex offender.

"I may well believe that you really cared for this young lady," Steele said. "But she is a young girl. That's not how you treat young girls. Do you understand that Mr. McCune?"

Before sentencing, McCune pleaded guilty to second-degree kidnapping, second-degree rape and second-degree sodomy. Additional charges were dropped in a plea agreement negotiated by Amos and Kelly. The plea agreement became possible when McCune dropped a plan to use an insanity defense, though he has a history of mental issues.

McCune was arrested in December 2013 after an exhaustive five-day manhunt around the edges of Oregon City. The girl's parents reported her missing after the two disappeared, along with camping equipment. Sheriff's deputies found them in a nearby wooded area at the north end of the Country Village Mobile Home Park, where the girl lives with her family.

The girl's parents, who declined to comment Tuesday, told deputies that McCune was a family friend who was staying with them through Thanksgiving weekend. They said he was a bright fellow who did information-technology jobs on a freelance basis.

In court, Amos said a mental-health exam at the Oregon State Hospital showed that McCune suffered from personality disorder, obsessive compulsions, pedophilia and "eccentric and somewhat delusional behavior."

"All that said, he could understand the nature of his actions," Amos said.

Amos said the girl had problems with her family, especially with her father, and that McCune had become a trusted "confidant." He said they conspired together to run away.

Kelly said the relationship between McCune and the girl was "not as manipulative as the state would have you believe.

"She was living in a horrible situation and wanted to leave," Kelly said. "They had a really great friendship and cared for one another. I know that sounds odd, given their differences in ages."

For his part, McCune apologized to the court. Speaking softly into his long gray beard, he said he took responsibility for his actions and said he wished he could undo the events.

"I've felt a lot of remorse since this happened," he said.
