Lehigh County Judge Maria L. Dantos told Caleb Barnes that he'll be "locked in a cage for the rest of your natural life" as she imposed the mandatory sentence of life in prison without parole. She added to that 22 to 44 years for other counts.
One year after Jamie Silvonek pleaded guilty in her mother Cheryl's 2015 murder, the Upper Macungie teen's defense attorney is fighting to get her a lesser sentence.
"The only issue we could argue at this point was to get her to juvenile court. That was our only appellate issue," said attorney John Waldron.
Waldron argued Silvonek, who is now 16, never belonged in adult court, and said a Lehigh County judge who made that decision relied on questionable testimony.
"Our experts were more believable than the commonwealth's. Since she had just turned 14, her brain wasn't fully developed and therefore she was impressionable. She was impulsive, she made poor decisions," Waldron said.
The three-judge panel will decide in a few months if Silvonek should have been tried as a minor.
Jamie Silvoneks quest to get out of prison on her 21st birthday hit a roadblock this week when an appellate court refused to overturn a Lehigh County judges decision to try the Upper Macungie teen as an adult for her mothers murder.
In a 13-page decision filed late Wednesday, a three-judge panel of the state Superior Court called Silvoneks an extraordinary case, but found no errors in Dantos ruling.
"Our comprehensive review of the certified record in this matter confirms that the trial court did not abuse its discretion in denying Silvoneks motion to transfer to juvenile court, the opinion states.
Waldron said Thursday that he will now take the case to the state Supreme Court.
Saying it found no fault with how he was investigated, questioned or prosecuted, a state appeals court has upheld the life prison sentence for a soldier who killed his 14-year-old girlfriend's mother.
Stabile rejected Barnes' claim that his confession to police should have been suppressed because it was made while he was under duress. The detectives never tried to intimidate Barnes, nor did he ask for a lawyer or demand that the interrogation end, the judge noted.
