The court is still waiting a psychiatric evaluation of Meyer, 59, to determine his competency to stand trial, District Attorney Andrew Bender said last week. He did not know when that evaluation would be complete.

There have been multiple continuances in the case since Aug. 11, when Judge Kathy Morrow ordered the evaluation.

Bender previously said in court that the prosecution believes Meyer to be competent and that he should stand trial.

Meyer is charged with criminal homicide, two counts of aggravated assault, prohibited possession of firearms, involuntary manslaughter, simple assault, terroristic threats, reckless endangerment, and endangering the welfare of children.

"Donald Meyer is accused of aiming a loaded semi-automatic rifle at state Constable Clark Steele who was there to evict the family from their apartment, according to police.
Apartment staff also were on hand to witness the eviction and documented the events in video that was played for the judge at Meyer's hearing.
Police said Meyer opened the door, then shut it, and opened it a second time while holding the rifle.
When Meyer allegedly aimed the rifle at Steele, the constable fired his pistol, hitting Meyer in the arm, according to police." bbm

After nearly two years, the case of a Penn Twp. man charged with homicide in the shooting death of his daughter could soon go to trial.

Jury selection is scheduled to begin Jan. 16 in Perry County Common Pleas Court for the trial of Donald B. Meyer Jr., according to court records. Meyer, 59, is charged with homicide and other crimes for his role in the January 2016 incident where an eviction notice turned deadly.

Jury selection was pushed back to February 13th.

But. They knew that he wasn't home alone. Plus they should have seen her standing behind him.

The second the father pointed a rifle at the constable, lethal force was justified.
Now if they had nowhere to go. Than of course tensions would be very high. But professionals should know how to hold off until the coast is clear.
Not even the best professionals have the ability predict in advance how another person is going to react.

In short, unless the had concrete indications that the father would resist any eviction attempt with a weapon, they were not obligated to call the SWAT team, negotiators etc. etc. simply based on what he might do.

The father needs to be charged with murder as well.

Meyer's trial has been rescheduled several times in the two years since he was charged for his daughter's death. Earlier this month, Mumma ordered Meyer to undergo another psychiatric evaluation at the county's expense, court records show.

Second day of Meyer trial ends with closing arguments

The defense called just one witness: Donald Meyer. Jerry Philpott, Meyer's attorney, noted that Meyer decided to testify over the objections of his counsel.

In his testimony, Meyer said he heard light tapping at his door but couldn't see anyone outside. So he got his rifle assuming it was someone who wanted to harm him in a home invasion. When he opened the door and eventually saw Steele, Meyer said he did not recognize him as the same constable he talked to two previous times.

He also testified that he never had a conversation with Steele on the day of the event, and that he didn't point the gun at Steele. He claimed at one point that opening the door forced the gun up in Steele's direction. Although it appears in the video that Meyer reached back for the gun on his shoulder and pointed it up.

Later, in closing arguments, Philpott ran down the list of crimes, saying in each case that the prosecution didn't prove Meyer's intent.

He also noted that although police testified burglaries and home invasions were not a problem at the apartments, Meyer's perception was important.

"In his mind, it was a big problem," Philpott said. "On this day, he feared a home invasion."

Bender disputed those claims in his closing, outlining a series of events that he said illustrate Meyer knew what he was doing that day and was responsible for escalating the events from an eviction to a shooting.

"Donald Meyer started the boulder rolling down the hill," he said.

He pointed out that constable Steele is not on trial, and Meyer sticking the gun in his face set off the chain of events that led to Ciara's death. He called Meyer's actions an "irrational reaction" and said he had decided to go to war over the eviction without regard for others.

"Bottom line, if he doesn't pull a gun, Ciara Meyer doesn't die," Bender said.

'Justice for my daughter' mother of slain girl says after Meyer guilty verdict

The mother of a slain 12-year-old Ciara Meyer said the murder conviction against husband Donald B. Meyer Jr. has closed a painful chapter in her life.

"It's justice for my daughter," said Sherry Meyer, who was in the home the day her daughter was shot in an eviction gone wrong. She said the verdict brought some relief. "Now I know I can put it and him behind me."

A Lycoming County jury on July 27 returned a guilty verdict against Donald Meyer of Duncannon, convicting him of third degree murder and other charges, in the 2016 shooting death of his daughter.

In the courtroom, Ciara Meyer's family as well as Steele and his family held hands and were relieved when the jury foreman read the verdict saying, "Guilty on all accounts." After court was dismissed, the families broke into hugs and tears.

"I just praise God," Clark Steele said, being embraced by his family and Ciara Meyer's family, who never blamed him for the shooting. "I don't know what else to say. That's where my strength comes from."​

A jury is to be selected Sept. 27 in Lycoming County for the trial of Donald B. Meyer Jr., 60, on a charge of illegally possessing a firearm.

Meyer is awaiting sentencing after jurors found he caused the death of his daughter, Ciara, 12, who was shot Jan. 11, 2016, at the doorway of the family apartment in Penn Twp.

He also is charged in Dauphin County where he is scheduled for plea court on Oct. 15 on charges of making false statements to obtain firearms.
