Judging from her appearance in the courtroom, Killer Arias is not worried in the least about a possible DP sentence. She is animated, giddy, flirty, and relaxed.

JW just argued to the jury a few minutes ago: 'If you are merciful and give her Life in prison, she will not get out"!

There was NO jury question - JSS omitted a jury instruction and needed to clarify it. PHEW!

If she gets LWOP, she can buy a TV for about $300 - comes with basic cable.
:banghead:[/QUOTE]

And she can do interviews whenever the media wants her to. :banghead::banghead::banghead:

There's some kinda hoopla going on at the court. They don't know if it's just a jury question or a verdict about to happen.

  • #665
Doesn't have to be unanimous. If they don't all vote for DP then judge decides LWP or LWOP

That is not correct. All 12 must agree. If they all vote death, judge has no discretion. If they all vote life, just will decide LWOP or LWP. If all 12 don't agree, a new jury gets the case for punishment only.

Ok I don't get it....they did the part previously (an hour ago?) where JSS read them the jury instruction she left out...they did that w/o camera, etc., so why does this have to be in front of the camera?

I saw that on camera. There was no one in the courtroom but the attorneys, CKJA, and the staff.

In her allocution Jodi said one of the reasons she changed her mind about wanting the DP was because she didn't know before that she could work in prison and be self sufficient. Pretty words but here's what else Jodi doesn't know:

1. Her per diem costs (2011 budget), excluding medical, will be $83.12 a day.

2. The job she will get pays $2.00 per hour to the State for an 8 hour work day: so that's $16.00 a day.

3. That's a deficit of $67.12 a day for five days a week and $83.12 for the other two.

I won't bore you with the math, but here's something else Jodi probably doesn't know: From a 2011 article found at

http://www.huffingtonpost.com/al-norman/i-aint-gonna-work-on-mart_b_886596.html

One of those businesses that turned to prison labor was Wal-Mart's vendor, Martori Farms. According to a disturbing story published June 24th by Truth-Out.org, Martori Farms "pays its imprisoned laborers two dollars per hour, not including the travel time to and from the farm." Women from the Arizona state prison complex at Perryville Unit are assigned to work at Martori Farms." Arizona law requires that all able bodied inmates work.

One of the women prisoners at Martori Farms told Truth-Out: "We work eight hours regardless of conditions .... We work in the fields hoeing weeds and thinning plants ... Currently we are forced to work in the blazing sun for eight hours. We run out of water several times a day. We ran out of sunscreen several times a week. They don't check medical backgrounds or ages before they pull women for these jobs. Many of us cannot do it! If we stop working and sit on the bus or even just take an unauthorized break we get a MAJOR ticket which takes away our 'good time'!!! We are told we get 'two' 15 minute breaks and a half hour lunch like a normal job but it's more like 10 minutes and 20 minutes. They constantly yell at us we are too slow and to speed up because we are costing $150 an acre in labor and that's not acceptable... In addition, the prison has sent women to work on the farms regardless of their medical conditions."

I believe AZLawyer said up thread that if there is a hung jury, they get a new jury.

Did I read that right?

Correct. If this jury can't reach a unanimous decision, then a whole new jury is picked.

I know...and NO I am not trying to dis the officer talking to her, but he really needs to be made aware of her vulture ways around men. Wait...hasn't he listened to the whole trial or was he spacing out?
