Alleged Jerry Sandusky sexual abuse victims warn Sandusky, Penn State against destroying evidence

In the wake of the Jerry Sandusky child sex abuse scandal that has rocked Penn State in recent weeks, several civil lawsuits have been announced against Sandusky, Penn State and the charity Sandusky founded, The Second Mile.

Today, attorneys representing alleged victims of Sandusky sent a letter cautioning all parties against destroying evidence. Here's what the letter said:

"Lawyers representing victims of former Penn State coach Jerry Sandusky’s alleged sex abuse sent letters today warning Sandusky and Pennsylvania State University against destroying evidence that they may need in the lawsuits they expect to file soon on behalf of one or more victims. The letters, written by Washington, D.C. attorney David J. Marshall, notified the recipients that they may be named as defendants and directed them to preserve a wide range of potential evidence, including records that may show when Sandusky entered and exited the Penn State facilities where he is accused of molesting minor children, and credit-card records of trips and gifts that he is believed to have provided to underage boys.

"Similar letters went to former Penn State officials Timothy Curley and Senior Vice President Gary Schultz, the Second Mile charity and its president Dr. Jack Raykovitz, and two government agencies – the Centre County Office of Children and Youth Services and the Pennsylvania Department of Public Welfare. The letters directed the agencies to preserve all evidence of complaints they received about the sex abuse and investigations and any actions they took to address those complaints. “We expect to name these and perhaps other parties as defendants in one or more lawsuits,” Marshall said. “It may have been only Sandusky who laid his hands on these children, but it is clear that a number of other individuals and agencies placed the children in harm’s way by knowingly taking actions that allowed the abuse to continue even after they became fully aware of it.”

Marshall sent the letters today on behalf of a legal team that includes State College lawyers Andy Shubin and Justine Andronici. The team represents the victim who is designated as “John Doe” in the criminal proceedings against Sandusky, and says it is working with additional victims. Shubin said that the team’s investigation is “focusing on the failure of a number of local child welfare agencies, whose mission involved protecting children, to take steps that could have prevented this abuse from continuing.” He added, “We are following these leads and will hold responsible every official who knew about the abuse, had responsibility to the children, and failed to step in and protect them.”......................................

You know it is funny Paterno admitted the first thing he said to McQueary when he called after the rape was what are you calling for I don't have any jobs for you just being funny. Then shazam, he had a big nice job for him after he kept his mouth shut for awhile.

Unbelievable,” the prosecutor, Bruce Beemer, said in his arguments to the judge.

He called claims by Curley and Schultz that they didn’t think what McQueary told them was a crime a “perjurious statement.”

“The intent here by both Mr. Curley and Mr. Schultz was to mislead the grand jury into thinking their actions were appropriate when I would submit that clearly they were not,” Beemer said.

As Jerry Sandusky's preliminary hearing nears, the ex-PSU coach has supporters in Happy Valley
http://www.pennlive.com/midstate/index.ssf/2011/12/as_sanduskys_preliminary_heari.html

These supporters are just as sick as Sandusky. Some of the comments are idiotic.

Forgiveness has to be earned first of all. The sad fact is Sandusky is probably a very religious person. No offense to anyone who is religious.

I am sorry...but this man is a sick pedo and has yet to repent for a single act! I believe in redemption, but have yet to see or hear of a pedo who has been healed or successfully treated. He will have to ask God for forgiveness, I am not going there. Pfft. BTW - I can tell you that this man would be asked to leave our church. We have children to protect and they come first.

When the object is COVERUP, intelligence and common sense goes out the window. And each person, IMO, who tried to keep the story underwraps or take the sting out of the truth was focused on their own job or career and how this episode was going to hurt the University and the football program and ultimately their own positions. These men need to be whipped and tarred and feathered. I want revenge and punishment for these officials. They are as bad as Jerry IMO.

Coming from a survivor who had multiple people cover up the abuse....and the abuse continued for 9 more years....I can tell you that in my book, it is as bad or worse. I am so stinking angry at these people for covering up these horrific crimes of Jerry Sandusky's. They deserve equal punishment. If you know someone is in the act of killing another and you do not stop it, IMO you are party to the murder. If you know a man is raping little boys and you do not stop it, IMO you are just as liable for the rape....and the next rape, and the next.

"Paterno testified that he told McQueary he would contact the appropriate people at Penn State.

“I have a tremendous amount of confidence in Mr. Curley, I thought he would handle it appropriately,” according to testimony. “... I did tell Mike, ‘You did what was right; you told me.’”

He continued to explain that he couldn’t be precise about when he called Curley because it was a Saturday, and he probably didn’t want to disrupt his weekend."

Yep, I always wait until Mondays to report child rape so as not to disrupt anyone's bbq's or kids' soccer games.

Absolutely!! He can be forgiven...after he has repented...I haven't heard a confession...let alone repentance...

And after Paterno finally notified Curley, it took Curley TEN DAYS to meet with McQueary. The only explanation I've seen for Curley's inaction is that the school was on spring break. Unbelievable. Not that these delays much mattered, since no one ever called the police anyway. :banghead:

Handling the complaint stupidly does not equate for handling the complaint illegally.

Handling the complaint stupidly does not equate for handling the complaint illegally.

The adverb I would use to describe how they handled the complaint is shamefully.

But how can you apply a verb to an non-action

Why doesn't it? Doesn't the law there say suspected child abuse has to be reported to the police and the State within 24 hours?

The story that is alleged they heard was no different then seeing a naked old man laying on a little boy naked in a bed.

Just because you don't see the actual penetration a logical person would assume something sexual in nature was going on.

In addition to saying Thanks to SuziQ and Doc Fessel for posting the tweets, I've got to say I like this newest form of court reporting.

In real time, we're able to keep track with the proceedings and testimony. It also gives us a tangible written record, instead of our own memory, well before actual transcripts are available.

Courtroom tweets are the best. I first discovered the advantages of courtroom tweets during all four of the Christian/Newsom murder trials. Sadly all four defendants will be retried so the process starts all over. :maddening:

Whoa! This gives me a chance to trot out the most frequently misused word of them all - "hopefully." These days it's almost always applied, incorrectly, to a non-action.

I'm not certain about the state, but Shultz was the head of the University Police. There was no requirement beyond that, technically.

Stupidity does not equate criminality.

Suppose that Sandusky had other kids on the string- not just from Second Mile. (And Second Mile records have disappeared anyway) Has anyone ever looked at Pennsylvania's missing children list to see if any disappeared about that time? I have a faint memory of reading that about 4000 minors go missing in PA each year- this seems like an impossibly large number. All month I've been twitching- "Find those two missing kids!"

In autumn 2000 Victim 8, 11 to 13 yrs was seen by the janitors and Sandusky knew he was seen in the hall but was probably not very worried because of he may not have known one saw the act. In spring 2002 he knew for sure Victim 2 was seen by McQuearry. At any time later he might have picked up a kid and--- I really want those kids found!

The indifference just drips off the page, doesn't it? :furious:

This reminds me of the Exxon executive in charge of the Gulf Oil Spill saying he "wanted his life back" after causing a huge natural disaster and ruining the fishing industry.

Unbelievable.

I think I'm adding "Evil thrives when good men do nothing" to my signature. Although I'm not sure I would call these guys "good men" either.

How did any of these people sleep at night when they never even knew this little boys name?

As far as they knew Jerry could have done the kid in after McQueary ran out.

McQueary, his dad, the Dr. Dravo, Paterno, Curley, Schultz, and Spanier should all pay dearly for this unknown little boy. Start with Paterno and melt down that statue of his and make one to this little boy with no face and no name.

YES! Because these little boys (now men, most of them) are the real heros of PennState. NOT these men who allowed a man to continue assaulting little boys. God have mercy on them, because I cannot.
