Since this trial will be about the death of Kathleen, I wonder if the jury will ever hear about the fact that Stacy is missing. I believe the SA will only be allowed to bring forth evidence regarding Kathleen's death. Since Mr Peterson has not been charged for Stacy's death, I think nothing pertaining to Stacy will be allowed. Maybe someone with more legal knowledge can correct me if I have it wrong.

You probably have more legal knowledge than I do, Paintr, but I think you are correct. I don't think it can be used as a pattern of abuse. Would the fact Stacy's disappearance happened afterward also play a role in admissibility?

Wouldn't Stacy come into this trial if the hearsay law is used? ie. what Stacy told her pastor about Drew admitting to killing Kathleen.

It is unlikely that anything about Stacy will be admitted into this trial. Even if he had been charged with Stacy's murder that is different than a conviction, and prior records are generally only admissable during the penalty phase.

They could possibly call Stacy's pastor under the hearsay law, indicating only that he was the pastor of Drew's next wife, but in this trial or in Stacy's I think they will avoid using this type of testimony if at all possible. This is a new law, unused and untested by any cases that have used it being appealed and upheld. They are not going to want this high of a profile case being overturned so I would expect that they will not use it unless they absolutely need it.

Friday is D-Day for Drew's Road Show

The request cites the saturation of coverage in newspapers, on television and online which, according to his attorney, makes it difficult for the former Bolingbrook police sergeant to get a fair trial.

Brodsky needs to convince his client to confess and take a plea. Save the state money and the families further pain.
Every time the media shows the clip of him in his orange j/suit talking to the inmates as he enters the jail house, I want to slap him sane.
If moving the case will lessen the event of a mistrial or some other nonsense, I guess it will be ok.

The defense team filed a motion last month for a change of venue due to the massive media coverage the case is attracting. Earlier this week, Drew Peterson's attorneys filed a 29-page motion to have the new Illinois hearsay law - nicknamed "Drew's Law" - declared unconstitutional. Defense attorneys say the state statute cannot be used against Drew Peterson because it was passed four years after the events he is accused of.
"The criminal law cannot relate back. It cannot change the rules of evidence in the middle of the game, so to speak," said Joel Brodsky, Drew Peterson's attorney.

Peterson hearing halted for potential jurors

An expected hearing on a motion for a change of venue in the Drew Peterson case was delayed this morning when the judge told the courtroom he planned to bring some 240 potential jurors into the courtroom.

Jurors also will be given a questionnaire that among other things lists some 493 potential witnesses in the case. Potential jurors will be asked to indicate if they have any connection with them.

All reporters were then ordered out of the courtroom.
