The murder trial of a US Marine accused of killing a transgender woman in the Philippines began on Monday after plea bargain negotiations fell apart...
Laude's relatives said they had been offered 21 million pesos ($468,000) in exchange for their approval to lower the charge from murder to homicide.
The opening day of the trial attracted dozens of reporters and photographers who packed into the foyer of the courthouse to catch a glimpse of the accused. However, the judge ruled that media were not allowed in the courtroom. Prosecutor Emilie Fe de los Santos briefed the media after the day’s proceedings.
The hotel receptionist testified that Pemberton and Laude checked into the Celzone Lodge, Santos said. “He was the one who received them and then he assigned them room 1” — the room where Laude’s body was discovered...
Santos said the judge is hearing both the civil and criminal sides of the case, and that defense lawyers are negotiating with Laude’s family during the trial... Pemberton’s lawyer, Benjamin Talosa Jr., told reporters that the family had demanded 21 million pesos, about $430,000, in compensation during negotiations that could see Pemberton plead guilty to homicide instead of murder.

Judge Roline Ginez-Jabalde of the Olongapo City Regional Trial Court's Branch 74 handed down a guilty verdict and sentenced Pemberton to 6 years as minimum to 12 years as maximum imprisonment. The court also ordered Pemberton to pay Laude's heirs P4.32 million for loss of earning capacity, P155,250 as reimbursement for wake and burial expenses, and P50,000 for moral damages.
Pemberton was charged with murder but the court downgraded the case to homicide due to the absence of several qualifying circumstances.
6-12 years? That's a pretty light sentence.
http://www.voanews.com/content/us-m...th-of-transgender-filipino-woman/3133182.htmlA U.S. Marine is appealing his conviction in the death of a transgender Filipino woman, his lawyer said Wednesday. Lance Corporal Joseph Scott Pemberton was found guilty of homicide in December for killing Jennifer Laude after he found out she was a transgender woman.
Judge Roline Ginez Jabalde had sentenced Pemberton to six to 12 years in prison, with credit for his confinement, and ordered him to pay nearly $100,000 in damages to the Laude family. On Wednesday, Pemberton asked a regional trial court judge in Olongapo, northwest of Manila, to reverse his conviction, and sought bail and a reduction of his six- to 12-year jail term, said Rowena Garcia-Flores, the Marine's lawyer.
