Post Conviction Brief

Here is the problem I have with the RAV4 damage..... IF it was previous damage and friends/family knew about it, why wasn't it on the missing persons poster? The family was working with a missing persons organization the first night, the 3rd, to make up posters. Now, I've never had to do one of these myself (thank goodness), but these organizations are experienced and they know what they are doing, why wouldn't they ask the family if there was any "identifying" marks on the RAV4 that would make it stand out? If it was known that it had damage, why did they use a Lemieux sticker on the back of the RAV4 to help identify it with the family? Why didn't Wiegert ask Pam if the front drivers side light was broken when she called in the RAV4? They guy from her first appointment that day noted that there was no damage to her RAV4 and it looked "new". I have very little doubt that the damage happened after or around the time she went missing. So then I question why Ryan would tell Fassbender that it was damaged.

Totally agree RE the damage to the RAV.
Pretty big deal when reporting a missing person IMO...to give details of the damage & all🙄

And I think Ryan told Fassbender it was damaged because HE damaged it & needed to cover his @$$!!
IMO...he most likely drove into that pole/metal ROD that was sticking out of the ground as he was trying to frame SA.🙄

I don't want to disrupt the fascinating thread that is ongoing here, but I am re-watching Making a Murderer, now that I've read the Post Conviction briefs I am struck even more profoundly by the absolute integrity of Steven Avery and his family. Steven Avery appears rough. I think if I didn't know him and saw him from a distance, he might make me nervous. But appearances mean nothing. The Averys have more integrity in the very fibers of their beings, than all the lawyers and investigators combined on this case.

I had forgotten that Steven was denied parole, because he refused to admit to a crime he did not commit.
Steven's mother, copying and stapling all those legal papers, fighting huge odds, and her humanity still intact.

And Brendan Dassey's soft spoken words, as he is conned by so many, who should have been looking out for his best interests. This case is heartbreaking.

And the forgotten victim in all of this, Theresa Halbach, was also such a kind and lovely woman.

It is simply overwhelming at times, how unfair the world really is.

Very well said. It's hard to believe the world we live in is so twisted. All we need is truth and it shouldn't be this hard to get it!!

A murder occurred in Manitowoc County and the victim was known to a local citizen who was on the verge of collecting a large settlement for a wrongful conviction and imprisonment years before. How convenient for all that authorities were presented with this murder at precisely the right time to solve some major financial woes.

I do not think the murder was planned for that reason but I firmly believe commission of the act was planned for that location, and then authorities took full advantage of the situation and worked overtime to frame Avery. They knew also that they could hound Dassey to the breaking point and they knew exactly how that would play out.

This case is heartbreaking on so many levels. The Avery family has been beaten down by the system with two of their own behind bars for life without evidence of guilt. The Halbach family lost a loved one and will always feel the pain of that loss. And the guilty party is walking free.

I have been for some time way beyond just clearing Avery and Dassey. I want the guilty fully prosecuted, and I am not talking about just the killer. Those who covered up and framed innocent citizens must be held accountable for their actions.

The truth must come out; it is long overdue.

Please keep an open mind to the idea that there was no murder. Far fetched, i know. But keep an open mind to that. Truth is sometimes stranger than fiction.

And this is the exact type of case that just keeps getting weirder and weirder the more you dig into.

Been meaning to post this for a while. I'd like to know how LE got such a CLEAR picture of where the license plates were found, but doesn't have a clear picture from the fly-over in November.

I agree, and according to KZ's Fire expert TH was definitely not burned in SA's fire pit. So what did actually happen to her?
I do now think TH died somehow otherwise what was her blood if confirmed to be hers doing in the Rav4, and what are those very suspicious scratches doing on RH's hand? The only thing i am doubtful about though are the bones. Were they definitely TH's? I don't think it was proven conclusively that they were.
And what about the shallow grave the dog's alerted to? Had TH's body been placed there and then moved elsewhere? So many questions in this case.

Thank you! Their Character ( Avery's) speaks VOLUMES...sure they aren't perfect, was ANYONE who had ANYTHING to do with this case?

Yes good point. I don't know if or how that scene was processed and if at all? I wonder if there was any DNA evidence of TH's there also? The dogs alerted there and being cadaver dogs it would of been a deceased human that was alerted to because that is what cadaver dogs are specifically trained to do.

I have just recently discovered this archived news article and saw where someone had pointed out a very intriguing statement that MH had made pertaining to that haunting video of TH that most people were attributing to being a "school project" she had done. It appears to me that that assumption was, indeed, a false one now. In the article, it reads,

"Halbach's younger brother, Mike, a video assistant for the Green Bay Packers, said he created the DVD from a "video diary" that Teresa recorded from 2002-2005. He said he did not know of its existence until after Teresa's death."

So now I am wondering, if there is a "video diary" out there from TH that covers several years up until the time of her death (2005), what exactly was found on those videos? I would think they would be a treasure trove of information on her life and am wondering if maybe KZ has access to those videos as well. I was wondering if anyone who is more adept at reading these kinds of legal documents could tell me if any of TH computer files were included in that brief. I know that SA's computer forensics were included, but didn't know if TH's were there as well. I would assume that her computer would be where she would have kept such a thing as a "video diary", and I would imagine that having such extensive information on TH's life would be extremely helpful in making KZ's job even easier than what it would appear to be already.
 
I always wondered if there was any abuse by RH, verbal or physical. I'm guessing yes but not sure if anyone else would know. TH seems like a private person and I doubt she'd have shared those details.

Well, it seems that KK is not the only agent of the state to now be spewing much hate and mis-information to the local public in an attempt to smear KZ's name and intention's. This column was written by the state's SECOND, (but, granted, less slimier version), mouthpiece...MG, himself. For all of his fake sincerity in the past of saying how he proves he is only interested in the "truth" because he was against the state in SA first wrongful conviction, so that shows he is not a bias person, I think MG's mask is slipping now, as can be seen by this petty and mean news column, imo. he starts off admitting that,

"Mistakes were made in the Avery case." (You don't say!) but that, "an imperfect investigation doesn't add up to a wrongful conviction- or even the right to a new trial" (Uhhh, excuse me but last time I checked this was still America and I would think that it would add up to a new trial, at the LEAST!?!). He finishes up this masterpiece by stating about KZ...

"Will Zellner feel an ounce of regret for pulling the wool over America's eyes while celebrating MAM2's debut, perhaps in her 3000-square-foot home theater in suburban Chicago? More likely, she will send out another self-serving tweet."

Now,I don't know about anyone else else but, MG is sounding very jealous here about KZ's home theater set-up so I am assuming his books are not doing so well at the moment, LOL. :biglaugh: I would also like to point out that he is receiving an absolute BEATING :bigstick:in the comments section,which I am finding to be particularly hilarious. :laughcry:
