The defense is SO sneaky! JMO
It sounds like they listened to her story and used it to justify her actions - as though that could be possible - not!
They also chose not to diagnose her. As I stated in an earlier post, most if not all of those sitting on death rows in the U.S. could be diagnosed antisocial personality disorder. Sociopath is not a recognized diagnosis according to the DSM-IV TR, the manual that is used for diagnostic purposes by all clinicians. I think you can see evil in those diagnosed with antisocial personality disorder. No remorse or concern for the rights of others. Think of Ted Bundy.
I also think it would be contrary to defense purposes to have this diagnosis testified to in court since the criteria includes no conscience, no remorse - that would explain the partying after very well, wouldn't it - as well as stealing from her mother for years and years. Also the lying. Everything. IMO

But isn't the 64 million dollar question "what actions?" Are they trying to explain away her murdering her daughter, or covering up an accident? Or lying about an imaginnany?

Ok, so we know he was added to the Defense very late in the game. He had only talked to the Defense. He agrees to help out on the case.

Now comes his depo with the state. I am quite sure that JA was not fooling around with his questioning. His depo started on April 7th, to be continued on the 13th.

The way I'm reading this motion, he didn't show up yesterday, and the defense knew he wasn't going to. Thus, removing him from the witness list.

I can only assume that this Doctor decided he wanted NOTHING to do with this case. PERIOD! I'll bet JA was asking some pretty tough questions, that he couldn't answer, or didn't want to answer. IMO of course. I'd love to have been a fly on the wall!

just a wild guess...by all accounts she was rather normal prior to Caylee. Her refusing to name the father instead making up all sorts of ridiclous lies about trust funds & whose the daddy and such. Maybe she will claim little Caylee was a product of a rape?

Casey seems to make up her own reality instead of living in the real one.

My guess is the "ugly coping" (IMO her learned maladaptive, pathalogical defense mechanisms) after Caylee vanished.

Denial, dissociation, splitting, minimization, fantasy, rationalization, regression, projection, and displacement.

im wondering if this is the defenses way of trying to keep her OFF the stand. Im of the belief that she really has always wanted to tell her story. That she believes that we will all understand when we hear her new version. What if what they were trying to do is get this in so that way they can prove to her that they can somehow get her side in without putting her up there. maybe????

You could be right you know - that could be partially at least what this is about. Of course - if ICA wants to testify - she can easily step around her Defense team and tell HHJP she wishes to speak with out against the advice of her DT.

They cannot stop her from getting on the stand if she is determined to speak.

During the hearing today CJBP stated that during the depo, he got calls from both the SA and the DT, and that the DT were the ones who asked that he stop the deposition... So now we have no Danziger, and no Weitz. I wonder how significant to their overall defense these doctors were--or in other words, how damaging is it that they've had to withdraw both of them?

I tend to think that the DT tried this little "back door" move and it backfired BIG TIME on them. I think when the State took the depositions, stuff started coming out that the DT did not want out there. Hence, once again, JB is saying "no fair Judge, do over"....in other words, just forget we even wanted these experts in because we had no idea you would let the state examine them.

And Dr. Danziger is the doctor who the DEFENSE abruptly stopped his deposition on April 7th, and then withdrew this doctor from both the Guilt Phase and Penalty Phase Defense Witness Lists.
The Defense also removed Dr. Weitz from the Defense Guilt Phase Witness List.

Well, their testimonies must have been pretty damaging to the defense because now the state has added them to their witness list. LOVE IT.

I cannot wait to hear what their 'diagnosis' was, if any. I seem to remember that the consensus was that NO MENTAL HEALTH ISSUES were found. If so, that is detrimental to the defense because how can they explain the 31 days?

Here is the state's motion re: the health experts.
In this motion it seems they want no mention of the mental health expert testimony until the trial and want to keep it out during the pre-trial phase. I wonder what the difference is. I'm really puzzled by all of this.

ETA: after reading it again I see that they want to keep it quiet until the judge rules on the admissibility of the expert witness testimony but then why would they go ahead and add them to the witness list after this?
