Rebecca's cell phone records

Why hasn't anyone requested that cell phone towers data be used to see where these phones were during calls?

Magic!

At this point, I don't think they should be allowed to even touch any evidence. They completed screwed up. I can't fathom that they did not even get a search warrant until August 24th for Jonah's phones, one of which it appears Dina used (what????).

The SD Keystone Kops division may already have compromised that phone, unfortunately. Hell, if I recall correctly (and I very well may not) didn't they paint over the door message - for absolutely no good reason I can imagine?

SAN DIEGO (CBS8) - The San Diego County Sheriff's Department has opened a new examination of data contained in the cell phone of Rebecca Zahau, the woman found hanging at the Spreckels mansion July 13.

Sheriff's homicide Lt. Larry Nesbit said that within the past week technology experts from his department started using newly-identified software to download data from Zahau's phone for forensic review.

"It constitutes a new examination of the evidence," Lt. Nesbit told News 8.

To date, sheriff investigators have served no search warrants or subpoenas on AT&T seeking to obtain either the deleted voicemail or call logs related to Rebecca Zahau's phone, according to Lt. Nesbit.

Even with the new program, it is unlikely the the detectives will be able to recover the deleted voice mail. The new program can retrieve data from the phone. But voice mail is never downloaded to one's phone, unless one installs special app for that purpose (the special app creates backup copies). Most people won't have this type of app installed because there is no need. Voice mail is stored on the network of the cell phone carrier. That's why you can access your voice mail through any phone other than your cell phone. But if you cancel your service, even if you still possess the physical phone, you won't find your voice mail on the same phone.

Email is different. Email can have copies on both local client (such as your computer) and server (the email service provider's computer). If you delete an email from your computer, server side may still have a copy for cops to recover. Even on your computer itself, if the sector of the hard drive where the information was stored has not been repeatedly rewritten, experts can retrieve deleted information. For voice mail, unless ATT provides voice mail backup service or has significant delays in deleting voicemails from their network server after a customer has initiated the deletion command (it has to be months of delay in this case), I don't see how Rebecca's voice mail can be retrieved.

You are absolutely correct. The only way to get the voicemail is to TRY and retrieve it from backup from AT&T. LE never did that because they waited one month to manually attempt to retrieve the voicemail.

Still, a forensic download of the phone's data will allow LE to find any deleted texts, emails, journals, etc (in addition to the ones that have not been deleted).

So, was Howard at the hospital the whole day? Unusual that Howard was there with Jonah during the day, but his brother Adam didn't stay with him that night.

I remember reading somewhere that LE opened up her phone early on. Wonder if they might have destroyed stuff. Figures!

They didn't. They waited a month to turn it on. By that time it was impossible to recover whatever was deleted from her voicemail.

Yes, it does seem strange, does it not?

Also, there is no mention of Rebecca picking Howard up at the airport. I wonder if he was there when Max had his accident and if he was at the hospital with Jonah the whole time?

Got this from that link. They did manually open her phone.

"Once we found out that the technology did not exist to forensically examine the phone, the detective manually opened the phone and learned that the message had been deleted; and she knew from prior case experience that if the message had been deleted from the phone, it would not have been stored on an AT&T server," Nesbit said.

That must have been a month after RN's death. That new article says they learned voicemail was deleted. They turned the phone on August 15. By that time it has been a month since voicemail was deleted, so it was impossible to recover it, since AT&T doesn't keep voicemails on their server for more than one week.

It says Jonah did leave the voice mail for Rebecca that night, as most of us thought. Why did LE lie about that?

That must have been a month after RN's death. That new article says they learned voicemail was deleted, on August 15 when they powered the phone.

How does a voicemail get deleted by powering on a phone? I wish my phone woulf do that for me!!:loser:

No, I believe the LE is claiming RN deleted it when she listened to it at 12:50 am. I guess that sentence was not very clear, I meant they turned the phone on August 15 to learn that the voicemail was deleted and they couldn't recover it since it's been a month and AT&T doesn't keep it on their servers for more than one week.

In a Sept. 21 report by CBS 8, Lt. LN was quoted as saying it "had been at least a week" after RZ's death that the phone was manually activated and checked for voicemails by the Sheriff detective.

However, the entire phone bill was obtained on Sept. 22 by CBS 8 and the logs showed the first voicemail access following RZ's death was Aug. 15, more than a month after the phone was seized.

(post edited, it was first turned on Aug 15)

Well see-LE has been very honest with us. One month definitely qualifies as "at least a week."
