I think the Dr was trying her hardest to get Juan pissed off so he would go off on her. That is what I got out of the tweets. I believe Juan new this would be her tactic but he did not take the bait and ignored her. He never attacked her no matter what the DF team or she says. It never happened although she deserved it.

Completely agree. But...Nurmi is simply no match for JM. Of course JM knew Nurmi would coach her to be belligerent. JM as bully to witnesses has been one of N's themes throughout.

And Dr. F was simply not bright enough to adapt to JM the patient prosecutor & layer of traps. He danced around her.

So yes, pathetically, she was reduced to a completely out of context and absurd sputtering of that rehearsed line about being offended. Hoisted by her own petard.

The defender of rapists and pedophiles calling JM a misogynist is truly rich.

And how about her 'client', the especially cruel lying torture murderess and Three Cavern Wonder, referring to Lisa Andrews as the 🤬🤬🤬🤬🤬?

I agree-and also mentioned it after seeing her nudes-something is just off about her anatomy. Also, the big hands and forearms, neck and general look scream "boy" to me.

CMJA's DNA and even her blood mixed with Travis' blood was at the murder scene. If CMJA is both male and female, wouldn't that reflect in her DNA in the chromosomes? Then if it were reflected in her DNA, wouldn't it be a big point in court for the prosecution to state that the DNA recovered at the scene was extremely unusual and that it did belong to CMJA? The prosecution wouldn't have to even state why the DNA was so unusual; just that it was and it did belong to CMJA. (and we do know her DNA was at the scene)

I just do not believe that CMJA is anything other than just a misshapen ugly female! There is also a disease that I cannot remember the name of whereby the female might have very long fingers, big feet, and grow very tall. It is the disease we were thinking the mysterious Lori Ruff in Longview, Texas might have had.

She must have known they would appeal. But if she were setting up the appeal, she would have stated openly that it was JA testifying.

It looks like the whole order to me. Sometimes they issue a "short and sweet" order followed by a longer opinion, but in those cases they say "opinion to follow."

Maybe they didn't need to give their arguments because everyone with a law degree already knows that if it was JA testifying there would be no possible argument to justify it. Who would they need to convince? :gaah:

BBM - Reposting this for folks who were questioning why there would be further orders/information from the CoA to follow.

I think what some of us wondered was whether the DT was hoping that this one juror would see Juan as attacking Dr F too much and empathize with her/dislike him. But she has been such a pathetic and obviously biased witness that we probably don't even need to worry about that possibility, regardless of how slight the odds may have been to begin with.

This woman looks like my 8th grade science teacher, lol! She was well known for being the meanest teacher in the whole school!

Dr. F looks like a mean old woman to me, and I'm an old woman myself! The way this so called Dr. (or whatever she is) spoke to Juan and the things she spouted, I'd rather think the jury wouldn't think Juan was being hard enough on her!

I have to believe this is an intelligent jury and can see through what Nurmi and Willmott are doing. They are trying to baffle them with BS because the truth is surely not on their side.

This whole trial has been down and dirty, IMO, and the defense team did not have to put it in the gutter and keep it there.

I hope it’s okay to link to this forensic computer blog site?
http://whereismydata.wordpress.com/2009/06/27/forensic-encase-verification-md5-and-other-myths/

As a Thanksgiving Scrooge (but I LOVE Christmas!), I spent this afternoon trying to get a “feel” for what goofs COULD have happened when TA’s hard drive was first mirrored using EnCase (as asserted by Bryan Neumeister during the “porngate” evidentiary hearing). The article above is extremely informative.

An excerpt:

“If the hard drive is not working correctly, or the cables are damaged, or the pins are not aligned correctly, or any of a host of other reasons then the hard drive will not image correctly. 99% of the time this error will be a very obvious error, …

Sometimes, very rarely but sometimes, the drive will image, but it will be producing junk data, or “skewed” data. …

In the worst case scenario this means that data will be imaged, Encase will read it, write it, and then verify it. The person conducting the image will then leave the scene and state, without intending to lie, that they have a 100% accurate image of the data. When in actual fact they have junk. This can, and does lead to all sorts of problems.”

If you’re interested, go read the entire post. The author gives an example where accusations were made that a drive had been wiped to hide evidence. Turns out it was a bad “mirror.”

What caught my eye was, “… or the pins are not aligned correctly.” IIRC, BN claimed the pins on TA’s HD were bent and he had to repair them. This article also says the EnCase ‘verification’ process does not verify the mirror against the original hard drive.

Hum. Heck if I know! It’s sad I’d rather research this than eat turkey and watch football, isn’t it?

I thought it was very interesting to read the defendant's response to state's motion for sanctions and strike filed on 11/20/14.

When I saw the picture of the hard drive connector pins, I thought WTH? Why or how could those pins have been bent? Who, why and when was the hard drive removed from the laptop? Fast forward to the evidentiary hearing, during which Martinez charges that the defense damaged the hard drive and he can prove it. This allegation elicited the "slimy" response from Neumeister.

I think that we'll learn in the next hearing that it was Neumeister who removed the drive from the laptop. Perhaps the State did a CYA move of making another mirror image this summer, just prior to the defense being able to examine the drive.

There was no need to remove the hard drive from the laptop assembly unless the was a reason to believe that the mirror image was faulty. But Neumeister never looked at the original mirror image made in 2008, so he had no reason to question it. Certainly if the laptop was booted up on 6/19/2009, the drive was still in the laptop. IMO, it would take some serious mishandling or intentional act to bend the pins.

It does create a big problem for the defense if Neumeister never compared the original mirror image to his results.

Likewise, it creates an even bigger problem for the defense if the State is unable to replicate the results claimed by Neumeister.

Might want to pay attention to the docket, because the State may be filing a motion that the defense did not comply with the court order to provide copy of drive and software used to analyze the drive.

I am remembering the day when the courtroom was cleared. Counsel, judge, and JA were in chambers, correct? There was sort of a back-and-forth about where the media were to be, and then the courtroom was cleared. Was this unanticipated? Did JA have some kind of tantrum in chambers?

And from all I've seen Travis had more patience and tolerance in his little finger than i could muster on my best day. It's too bad he took sex with Jodi as an expression of love. For her it was nothing of the sort. Her true nature was revealed in what she did to a truly good and remarkable man. She is nothing but a dark force, and completely unresponsive to light.

I am not sure Travis mistook sex for love in that relationship. I think he had sex on his mind a lot which is typical for many men around his age, and what she offered was tantalizing enough that he could not turn it down. But aside from their sexual relationship, I think Travis truly cared for Jodi.

Travis was, as you point out, far more patient than most guys would or could be under some circumstances that have now been brought to light; that was because he really did care about Jodi as a person, IMO. There are too many examples of him trying to help her out for me to believe he didn't care at all beyond the sex.

How is the jury expected to remember anything with all these crazy delays for one reason or another. I know they take notes but I don't think I could keep my thoughts straight for months with all these crazy delays. Hope they have a better attention span than I do.

Hope everyone had a great Thanksgiving!
<respectfully snipped for brevity>
JSS had nothing to gain by granting the secrecy, though , and a lot to lose. The fact that a sitting judge in the state of Arizona saw no problem violating the Constitution of the United States to accommodate the whims of a sociopathic , convicted, DP-eligible murderer is downright scary.
This^. Some have asked 'what's going on'? For me it was the confirmation that JA was indeed the mystery witness. I was apparently one of few who thought it couldn't be her, she's a convicted murderer who testified in open court and on video for 18 days! She has no reputation to protect and she's certainly guarded physically. I don't believe it could simply be her refusing to testify, or that her testimony could hurt her fund raising - it has to be more than that. A witness is not required to testify and there is case law supporting that. As for fund raising, etc.? Pfftt! I still think it has to do with someone outside of this case that JSS felt needed to be protected. As for the testimony being released at some point in time, I'm not sure it would have to be if she had won this appeal. As low as my opinion has been of JSS's handling of this case - as biased or hyper-sensitive to appeal issues - I still cannot imagine her not only granting this extreme action, but when challenged standing by it only for what would amount to emotional blackmail. Been wrong before, several times, and probably wrong on this too, but that's "what is going on" for me.

BBM - It seems like JA was skilled at charming the heck out of many guys. It was obvious that Darryl Brewer still had feelings for her, even though he cost her his house! And many of Travis's friends seemed to like her - at least at first. Look how much the Hugheses thought of her until they found out how much of a liar and a manipulator she was.

We are obviously seeing her through a different prism, but she does or at least did have some skills at pretending to be a human being that managed to win guys over, including Travis until that last week or so.

In giving this more thought I want to say this. The MAIN thing sociopaths like Arias are good at is the fine art of manipulation. I dont mean to excuse anyone here really but to understand maybe a little better.
The men who murdered my sister walked in to her bank branch, having no money, her accounts frozen by the police already, no jobs, no green cards, no citizenship, the only "collateral" being the life insurance they hoped to get from killing her and that bank MANAGER gave them a $3000 loan. It was also my bank branch so I went in to confront him and he broke out in a cold sweat across from me in his own office and just said "I don't know why I did it". Oh that was after they came after HER estate for the loan. (dropped that which was really, as their customer, why I went in to confront the *@^#% out of him).
Those killers also conned Rolex watch sellers, Jaguar, BMW dealers, a custom home builder and realtor and several other women that they were rich bankers/prof tennis players/pilots etc etc. Usually savvy people conned in to their web.
They are masterful at getting normally smart people to do completely uncharacteristic things then scratch their heads later. Sadly neither Travis nor my sister had a later.

One thing that has always bothered me in the 1st trial is that Arias deliberately turned her license plate upside down to avoid being detected in Mesa.
Now I might not be an Einstein like JA, but that makes absolutely no sense to me at all. If anything, that would draw more attention.

In her premeditation of killing Travis she really thought out her "I wasn't even in Mesa" plan.

1. Made it look like a burglary at her grandparents house to get the gun
2. borrowed 2 gas cans from Darryl
3. bought another gas can at Walmart
4. dyed her hair back to her natural color
5. Bought a 24 pack of water bottles.
6. Grabbed her backpack full of "tricks" the one she always carries with her handy knife just in case somebody needed their tires slashed, a larger knife just for back-up, the GUN,
extra clothes, (gotta get rid of her killing clothes) 3 or 4 pairs of socks. wash rags,
extra towels, so when she could clean up MORE with the water she bought. Although I do think she showered with T.A. < (hard to type) to get any of her DNA off of him, and the blood off of herself.
*7. She rented a car almost 100 miles away in Redding Ca
8. Turned off her cellphone right before leaving Califonia

*I think she took off the California license plate and put on the Arizona plate from the BMW, right after turning off her phone (premeditation again)
With a different car with Arizona license plates, dark hair making sure no one would happen to recognize her passing on the road. She made herself look like just another local. And in her frantic hurry to get out of AZ and get rid of all the evidence, she switched back to the California tags in such a hurry that she didn't notice it was upside down.

"Thanksgiving Scrooge" lol!

Lonnie Dworkin said in his testimony on day 12 in the criminal phase that the EnCase image is compared bit for bit with the original to make sure it's a clean copy. It's more than just comparing the MD5 or SHA256 hashes, but even just comparing the hashes will show if even one bit was flipped.

ETA: I went back and read the author's follow up article about hash values http://whereismydata.wordpress.com/2009/09/08/forensics-hashes-do-they-work/ . Okay, so it's possible. Unlikely, but possible. I am not a computer forensics expert.

In the guilt trial, every time Jodi was present in chambers, Travis' family was allowed to be there too. Why not now?

Was Jodi's direct this time completed or will there be more? Did Nurmi stop or did the Judge call the halt?

I too think the upside down license plate could have been an accident. Maybe she switched the plates in the dark and didn't notice she was putting it on upside down? It doesn't make sense for it to be deliberate because as you say, it would be more likely to attract attention.

I do not recall how she discovered the upside down plate...did she happen to see it while sitting in a Starbucks, or was she stopped by a traffic cop at some point? I do not recall anything she claimed about the discovery other than she was in Starbucks and the teenage skateboarding gang armed with screwdrivers came along and messed with her plates. I remember her claim that after they removed it they left it lying on the ground propped up at just the right angle for her to notice it there.

So...does anyone recall if Killer discovered the plates upside down or if someone else mentioned it to her?

I have reviewed the tweets from Oct. 30 and am now convinced that the "secret testimony" was planned ahead of trial. Counsel, family, defendant, and the judge were buzzing like bees in and out of the courtroom almost as soon as they got there.

Wow. I still cannot believe that this happened.

I have wondered the same things, Tart, but what do you mean by why the Alexanders weren't allowed in chambers? Are you referring to Oct. 30?

It occurred to me that possibly BN's image that he created and examined could have been corrupt, too.

I can't find it now, but iirc, BN testified that he uses open source forensics tools. I know that some of these are forks of the standard Linux/Unix imaging tool called dd. When this program encounters a hard drive that has read errors, sometimes the imaging tool will record the bad blocks as nulls or zeros.

It will ask to stop, skip or continue.

Stop will stop, making no copy.

Skip will create an image that omits the bad blocks (eg a 500*gb disk with 400gb of bad sectors will result in a 100gb forensic image) which is useless in court since it's not really a mirror.

Continue will fill the space with zeroes. It will "copy" that unreadable space with filler so that it can continue copying the original drive accurately where it can. 500gb = 500gb, but 400gb would be zeroes.

This is pure speculation, but I wonder if something like this happened, could it be interpreted by a paid expert defense witness as 70,000 files 'scrubbed' by a program not on the computer**?

Whatever happened, the story is all there on that computer and the State will figure it out.

*example numbers only, I do not know the capacity of TA's computer HDD

** Computer expert Neumeister says that 70,000 files were scrubbed, zeroed out by a program that is not on Alexander's computer. #JodiArias —Michael Kiefer (@michaelbkiefer) November 21, 2014

I HATE that Travis' reputation is the whole focal point of Jodi and her defense. How convenient for them as Travis is no longer here to defend himself from all the lies. It's all about trying to save her life! What about Travis' life?? He certainly didn't a chance to save his life....Yet Jodi get's two chances :furious: I.HATE.JODI.ARIAS
