Perhaps someone should ask Dworkin where the sim cards went that BN claims weren't there, otherwise just how did Dworkin get the data off the phone?

Yeah, I watched all of Dworkins testimony earlier today and never once mentioned sim cards, their presence or absence. As an expert, you'd think he might have noticed??

It's actually good news. If there was no on Dworkin's copy provided by the state, that would be a problem because it's there. And if it wasn't on his copy it means the state did something untoward. I don't know what, because you clearly cannot erase anything without leaving a record of it. The fact that it's there, point for point, but simply missed by two experts means there was nothing dishonest going on, it was just human error. The defense can no longer claim the state hid the on purpose to frame Jodi as a liar.

Sorry for replying late to msg's that have probably already been discussed ad nauseum but I would just like to point out, yet again, that there is a big difference between actual being on a pc and hits on sites. If the had actually been downloaded to the pc and then deleted then yes there's an argument to be made. However, so far all we've heard is that no (according to Dworkin's testimony which he said he stands by) was found. So this "new" is probably just hits made on sites, which doesn't mean they were even accessed let alone viewed simply because of the large number of them that BN is reporting, it would be next to impossible to actually view that many.

It doesn't matter what anyone thinks of TA, his friends, his religion, his profession or anything about him. It doesn't matter at all. It's not okay to be slaughtered by anyone, crazy zzz or sane zzz. Possibly not even State zzz, but AZ is a capital state and we have M1 especially cruel.

I find it interesting that BN has not mentioned that TA, apparently the master of looking at 24 hours a day and then scrubbing it clean off his computer with every anti virus program available (and yes, I would think 22 anti virus programs would negate any of them from ever actually working), never thought to install a VPN or Proxy service on his computer to keep his illegal child viewing from being traced back to his IP. I was also not aware that you could find child pretty much anywhere on the open web just by surfing for it. Thought maybe that would be more prominent on the underground web or TOR. :waitasec: But then again, I can honestly say I've never even tried to type the words "child " into a search engine. Pretty sure TA didn't either but lets just bring the innuendo into a sentencing phase anyway. Why not?

I read somewhere in the minute entries that her hard drive was broken in half. On 10-18-2012 entry it says that drive #402873 was sent to TLSI.inc for recovery and the judge was ordering for the return of the drive by a certain date. A while back I saw an entry where Nurmi was arguing that the data from the drive could not be admitted because they could not be sure what was changed or missing. I am still looking for that entry.

I would love to see what they found. Murder Plans? Mileage maps? ? Blackmail of prior boyfriends? Evidence of photoshopped photos? Emails from Travis's accounts to her own? Evidence of spying with remote programs?

Is that the same internal HD with a bag of parts that was received by the DT(BN?) on Oct.25, 2012 with the questionable mirror image taken from it and received by the DT on Nov.5, 2012? The one that iirc Dworkin pulled the penis pics from?

I think BN is doing this now, to make it clear he wasn't hiding anything before. He turned over an image and says that should be good enough and Juan's "badgering" about getting a copy is unnecessary. However, now that Juan is clear he wants his copy and the judge has ordered it, there should be no problem now with it. He got it out there. Fair enough. And he may be right. I think we sort of talked about this and I said something about Willmott maybe having a point in her motion because what they turned over is apparently a compressed image and that should work.

But Juan still wants the copy. When you ask for a copy, you want a copy. BN is saying Juan doesn't know what he wants and what they've given him is fine and he's just splitting hairs. Juan may not understand what the image of the copy BN an gave him was, as alluded to in his motion. But he knows it wasn't a copy. And I think Juan does understand he hasn't gotten the copy, obviously, because he keeps asking for it.

IMO, he's doing it now to lord over the prosecution, as if they are idiots. He could have turned everything over when Juan asked for it. His superiority matters more, IMO, than actually following the rules. He has not remotely shown that he has nothing to hide. Someone who has nothing to hide and is being professional would have handed over whatever was asked for. And the fact that this is the third time he's been ordered doesn't look good. So, actually, I don't care what his POV is. He refuses to play by the rules, and to me, that is a huge red flag.

Not at all...I hear ya.

Thing is, compared to about 90 percent of young men in his age range, not of the Mormon faith, he pretty much was a saint as far as relationships with women go. Whether he was not a "saint" in the eyes of his church is irrelevant. And the ridiculous part is that the defence team, via Dr. F, tried to point out that the reason why TA is so much worse than anyone else for his "emotional abuse", "sexual promiscuity" and "womanizing" (none of which have been proven and never will be because it's just not true) is because he was a Mormon.

I find this so unbelievably offensive just off the top because any single young man, who may actually be doing those things, does not deserve for a "friends with benefits" stalker to premeditate and drive 1000 miles to slaughter them, Mormon or not. This is not a situation where she was actually fighting for her life in an abusive situation. This has been proven. She did not kill him because he was a pedophile or because she was discussing anything about him being a pedophile with him when she snuck up on his house in a rental car with missing or altered plates and her hair dyed. Equipped with a stolen gun and a large knife. Apparently the only thing they discussed before the murder was that she was still a 3 hole wonder (and would only be a 3 hole wonder to him) by looking at the pics taken in the bedroom before the slaughter in the bathroom. This whole mitigating phase is beyond absurd. She doesn't deserve to live because she knows there was accessed on TA's computer ( likely because she accessed it on there often) and the original trial did not bring that out. It has no relevance to her mitigation phase. It had no relevance to her guilt phase either but she can certainly waste time her new lawyer's time with it on appeal. I really don't know what this judge is thinking allowing this to go on. And I cannot believe that there is not a higher power to set her and this phase of the trial straight. She must be accountable to someone?

I personally think we are drowning in the Sargasso Sea of BS. We can't even figure out what the actual hearing was about. Because of the secrecy and really, really inadequate reporting/tweeting. I hope Judge Stephens is proud of what she has wrought. So much for the 1st amendment and transparency.

Again, where's the proof? They were taken from a cell phone that went missing for years and then magically turned up with penis pics and sex tapes and what's worse, the judge allowed this very questionable "evidence".

I believe it's been mentioned in this thread that the pics were found on JA's damaged hard drive? So if they weren't on her phone and they weren't on TA's phone, doesn't make sense to me that they are pics that he texted to her. Nor does it matter. She didn't kill him because he sent her pics of his penis. The only thing important about those pics is that it is the ONLY thing that was allowed to be entered into evidence from HER computer. In the guilt phase, that would have been very interesting to me as a juror. In the mitigating phase...not important at all.

It isn't his job or right to instruct the State what is or isn't relevant, much less to make accusations of misconduct.

That request vs. order thing got me too. Juan said the judge ordered you to do this, and Willmott objected and said the prosecutor requested it. The judge sustained and I thought huh? He did make the first two requests, but after the first hearing, the judge did order it. Did she forget that, or something?

Without the transcript, do we actually know what really happened? It seems to me the tweeters have totally dropped the ball on continuity.

The first evidence of a possible single work day next week to continue the trial.
With no Fridays, its our only shot.

Taking bets if this sole day will happen or not.

If the judge wants this trial finished before the next millenium perhaps they should consider
-starting at 8 AM instead of 9:30 AM each day
-start going till 5 PM instead of leaving at 3ish or earlier
-start having court on every weekday and quit skipping Fridays, other days
-start having Saturday court days

-Better yet, just start denying the ridiculous DT motions and anything that is related to an appeal of original verdict needs to force DT to wait and file appeal AFTER sentencing phase. Its irrelevant during this phase. Its an appeal about the original guilt phase.
