Because no one is claiming porn was missed, then found. The DT is claiming links to porn sites were missed then found. These are text files, URL's, showing the computer was once directed to porn sites, and in this case no one is disputing at least partially through the action of viruses. Maybe intentionally too, but imo that's impossible to prove. Anything a person could possibly do with a computer using a mouse or keyboard can also be done by a virus, except write 'War and Peace' or other creative work. Linking a computer to porn sites is not only possible for a virus, it's what many of them were written to do, and making it appear as if they were typed in is trivial. The original experts were asked if there was porn on the computer and they said no. They were right, and there still isn't. What was 'missed' but actually never asked, was "has this computer ever been to porn sites?" This is what the current defense has found.

Exactly Steve. And remember how after JA brought up something new; "I returned the gas cans" or "I stepped on the wobbly closet", JM actually investigated those claims (without delay I might add). If the DT was so concerned with the porn (or porn websites), why didn't they ask their experts to review the harddrive again while the original trial was still going on? Nothing was stopping them!

And it's at this point more than ever that JSS needs to actually do her job. This trial has jumped track. We're down to one day a week as a matter of course because of all the side issues the defense has clogged it up with, and JSS doesn't even keep it focused on them enough to actually solve them. We're set to burn through a large part of 2015 at this pace and if that happens it will be because of JSS and no one else. How long does she expect the jury to put up with this bull****? She looks at them so affectionately and appreciatively when they come in but to me it just makes her look two-faced. She's being played for a fool, but damnit she wears it well.

If the point the DT is trying to make is that Travis "deserved" to die due to pedophilia or porn addiction, that is still despicable. Noone deserves to die in the manner that he did. CMJA was convicted of M1 in a cruel, depraved murder. I don't get it, what does this all have to do with mitigation? Can't these issues be dealt with on appeals? They want the conviction overturned in the middle of the penalty phase? IMO this is the judge's fault in not setting priorities and letting this trial run amok. I understand JSS wants to give the murderess every chance to save her life, but why couldn't she have said, guys (DT) you had 18 months between the guilt and sentencing phase to deal with outstanding issues, let's finish the retrial now for the sake of the jurors and Travis's family, and you can raise this after? Why, because then the murderess and her team would have to pay for these motions to be heard, IMO, and again CMJA & KN/JW is sticking it to the State. $2.7 million dollars so far. JUDGE GET A GRIP! Self defense is out the window, obviously. This trial & judge is now out of control. And why can't she order that KN's motions be heard on a Friday or even Saturday, and rule that the testimony be heard Monday thru Thursday both for continuity of testimony for the jurors and the Alexander family? The victim has no rights here, just the killer and the actual retrial stands still for frivolous motions. Doesn't the judge have an inkling that the jury members, like #3, may have schedule commitments in January & February that may affect their ability to serve, and by allowing these breaks in testimony, the possibility of mistrial exists, or does she even care? I am not being facetious either, maybe that's what JSS wants.
Pardon my rant, but a man was murdered, stabbed 27 times, throat slit & shot in the head. What does all this BS have to do with obtaining justice for him? His character dragged through the mud every single day. Who cares if he even liked to watch porn, which I highly doubt, he does not deserve character assassination. I personally think CMJA put the porn on his computer if there indeed was any, either remotely or it was put there by pure accident, downloaded unknowingly through a video or email. This has happened to me years back, when all of a sudden you get a xrated pop up and you click the "close" button so quickly because you can't believe what you just saw and want it off your computer.
IMO Travis didn't download any porn. I think he was too good of a person to do that, whether he be Mormon or Catholic or any religion. He continues to get framed, berated and shamed even in death because of his psycho, evil, monster of a killer and the crap her defense team is allowed to get away with by this Judge. I just don't have faith in Judge Stephens anymore. I respect judges in general & was not wanting to discount the difficult job they have, but this judge has lost control of this trial. She has clerks and support staff to help her, she is not working alone. It's not an overly physical job, I do not think she is overworked, it's just that I get a sense time and efficiency mean nothing to her.

About number of scrubbers etc. A commenter on BK offered the thought that its possible TA repeatedly downloaded the same scrubber (s) because he didn't know the first download had been successful.

I've done that on multiple occasions with different programs so know that's possible!

One would think that a defendant convicted of nearly decapitating a man would be on her hands and knees begging for forgiveness and mercy. BN's ego is out of control when testifying from the witness stand, I find it troubling when an expert with over 20 years experience should degrade a fellow expert in such an unprofessional manner. He actually said that Melendez was either incompetent or lying when he testified to not finding any porn or viruses on TA's pc. He then went on to claim that a person with less than 5 days training would have had not missed what Melendez failed to find. When BN was asked if that was also the case for Dworkin he said he may have been given a scan clone–not a complete one. as he failed to find porn or viruses also he said no because it was more than likely that Dworkin was given an improper image by Melendez. Dworkin may have been given a scan clone–not a complete one. Of course it has to be Melendez's fault because he can't criticise Dworkin as he's the DT's expert. I have just gone over BK's notes from the first hearing to refresh my memory & this is what BN claims.
1 - Updates of Windows and iTunes were downloaded on June 10, 2008–not installed. The updates were installed on June 19, 2009.
2 - There were so many pornography sites accessed–not from a virus–cloned x 3.
3 - Long list of urls which were accessed by the user on June 1, 2008. Some of the key words — great body, great sex, hxxd job. These files were in the history, not caused by a virus
4 - 9/5/07 - Adult film database, escorts sites were accessed as well. "Legal Escort for You" was one of the sites. Not a site on pc from a virus the user accessed it.
5 - 70,000 files were scrubbed or which was done by a program which was not on the pc. One way to do it would be to use a USB stick but can't make that determination. JW then tries to get him to say that they are in addition to the damage caused by Mesa PD but he can't confirm.
6 - Lots of viruses & porn sites specifically accessed by the user. The computer did not go to those sites because of a virus. BN now points to the first batch of porn sites that were typed in–not from a virus.
7 - About 90 pages of hundreds of sites, from the virus & from the user accessing. Z-lob virus comes from a porn site where a special player is downloaded for the user to watch the video.
8 - Sites that were accessed. Under “girls”, vile stuff, says BN. Found porn sites related to teens. Usually the word “sxxt” was used. “Sex” had 68,000 hits. Most of these sites in the registry, not just in the cloud, they were on the computer. Of the 90 pages of stuff he pulled down, these were in the registry. - (Did cloud storage exist in 2008?)
9 - BN has a history of these sites being accessed, not just 6/1/08.

If all the above is true, I believe their is a very simple explanation why Melendex & Dworkin missed this data. I'll explain in another post.

Encase used by Melendez & Dworkin – Encase is a court recognised program, hence why law enforcement use this program.
BN claims 166,000 porn sites missed, not hits, but actual sites.
BN went to Mesa PD & did 2 clones himself
BN’s clone was done in the past year, didn’t look at the clone drive from June 11, 2008 because he didn’t need to.
Tony Klump is the person who used FTK. When he made the first clone, the FTK program grabbed the wrong image. (This is the Dell image given to JM)
Here is my theory for the discrepancy between clones. Mesa PD & Dworkin clone was done in 2008. BN’s clone x 3 was done in the past year. As with all software it is continually improved & updated over time. Each update introduces new features & fixes any glitches & instability that the previous version had.
BN’s program although freeware was a newly released current version which would have more features than a program that was 5 years old.
BN is comparing work that was done 5 years ago on an old program, so of course there is going to be a difference in the finished report. No doubt Mesa PD now use the current version of Encase as all law enforcement do. If they were to do a new clone on the current version of Encase the generated report will no doubt be different to the now 5 year old clone. Until this allegation surfaced there would have been no reason for Mesa PD to investigate this further. So perhaps neither expert was asked to look for internet porn. Hmmm....

For two years of incarceration, there wasn't a whisper about pedophilia nor domestic violence. When Nurmi assumed his representation, he began visiting Arias & he dunned her with the hard fact that her tale of intruders was not in the least credible. She finally caved and well, she had to replace that lie with something! Why not another one? I think she studied what people, and jurors particularly, find execrable. What revolts a decent person. Finds beneath contempt. She had access to material on this subject.

So I think the victim's pedophilia was late in formation. However, during the days in Utah following the murder, Arias confided in Leslie Udy that she envisioned the day when her children and Travis' children would be playing together. Travis' body had not been discovered. This hopeful statement directly contradicts others she has made from the witness stand where she explained her fear for the children of Travis' friends and the trouble she went to, to keep him away from them. Little did she realize that Leslie Udy would remember that vision Arias shared and testify to it in the murder trial. We also remember the threat Arias made from her cell. Bargain with me for a term less than life or I will, regrettably of course, smear Travis Alexander with everything I've got.

She has learned quite a bit in jail. And after thinking about different scenarios for 5 years she creates the worst of worst LIE. Story number three, he was a pedophile. She knows that in prison or on the outside, people feel this abhorrence toward this particular, pathetic type of being. She is pure evil. We don't know what they are but most likely, the vast majority will be malware programs, masquerading as antiviruses or alerts from resident antivirus programs (You've been infected! Click this box to clean the virus!) sort of things that download crap programs and infect a computer further. Sort of like that recent fake Java update box folks here (and all over) were dealing with a few months ago.

No, that's just an update from the java already installed on your pc. It supports some programs that are running on your computer. If it's a bother, you can uninstall it. Open Start menu, go to installed programs and choose Java from the uninstall list. Or you can update it.

With advances in technology over the past 6 years, I wish more than anything they could access her broken HD and computer. I would love to know what she was up to for the months leading up to TA's death.

This whole thing reeks of practices of politicians, accuse the other side of what you are doing. When you are slimy, repeatedly say they are slimy. If you are stalling, accuse them of stalling. If you are possibly tampering with things, look to them and scream misconduct. It all feels like misdirection.
