I think the media has one more trick up their sleeve before they put this to rest,they stand to Lose millions and millions on this coverage,plus first amendment rights are not going down that easy. And yes she got a fair trial, media or no media,same verdict.

OK, just popping in for a sec and have not read all new posts, so sorry if this has all already been discussed.

Was an actual list of actual mitigation witnesses ever actually submitted?

Hey, here's a thought. Call me a cynic, but maybe there's no list and never was. If the judge allows live broadcast, Jodi can say her mitigation witnesses all scurried back under their various rocks because they're scared of death threats, haters, possibility of arrest on outstanding warrants, and on and on and on... Basic Jodi sob story. Nurmi fails to mention why live broadcast specifically would be so much worse than delayed broadcast, but maybe he's still speaking and just hasn't reached the end of that sentence yet.

Despite Jodi's protestations to the contrary, I suspect she does actually want the new Fall season of her show to air live. (Too bad the title American Horror Story: Freak Show has already been taken.) How totally awesome for her if she not only gets the celebrity treatment, but also gets to say that she doesn't want the media coverage, that it's unfair to her, and that it damages her case. The best part, for her, is that it allows Nurmi to play the "fear of being harassed and/or threatened" card, thus explaining to the new jury why this wonderful "girl" has no witnesses willing to take the stand in her defense.

I have no doubt that there are witnesses. Do you really think Nurmi would flat out lie to JSS about having conversations with imaginary witnesses?

Nurmi is doing what he can to manufacture an issue for appeal. It's about all he can do at this point, and its his job.

Brewer didn't back out of testifying for her. Nurmi pulled the plug on presenting any mitigation witnesses. Nurmi's decision.

The murderer's post conviction interview had backed him into a corner. Not putting in witnesses was his Hail Mary pass.

I am disappointed because now it can be assumed that the killer didn't get a fair trial the first time around, with cameras. So, JSS has essentially set up an appeals issue. At this point, however, I couldn't care less, as it is time to just get this retrial done, put the killer in Perryville, & watch her hair get gray. I will satisfy myself with the daily tweets. And if the trial is on YouTube afterwards, I will watch it. I do think JSS has set a dangerous precedent for First Amendment rights, though. Again, the criminal gets more rights than a regular citizen. Regular citizens that, I may add, pay for this trial with their hard earned tax money. Let's get on with it!

No, JSS has not done any such thing. She's bent over so far backwards to avoid any grounds for appeals that she's facing forward .

Its been frustrating at times, but oh yeah, I'd much rather that she err on the side of caution then give CMJA any reason to hope for a redo.

It's a lot of nothing. Trials have been broadcast for decades now, printed about in the media, etc. And I've never heard of a single one turned over on appeal because there were cameras present and the world could watch. I don't know why the DT thinks they're so special. Nurmi is too preoccupied with what's going on in the media right now than he is with defending his client. And he has been. His head is in the clouds. The appeal won't work because Jodi got a fair trial. The jury honoring their admonitions is all that matters and they did, even if they had to actively avoid talk of the trial when they came across it.

If there were witnesses willing to testify that didn't want to because they felt threatened he could have subpoenad them. He could have had their faces blocked out. Once again, JM has already made a very clear record of why Patti Womack all of a sudden decided not to testify. And I imagine he's made more records that we never heard about under seal about why the defense didn't and could have put witnesses on for her. There's no reason Nurmi couldn't have put up a single witness. There's no reason he couldn't have gotten her family to speak for her. There's no reason he couldn't have gotten somebody. Hulsey had little mitigating factors and they still found people to testify on his behalf. Nurmi just threw a hissy fit and threw up his hands.

The only thing that worried me was an infective counsel appeal winning for Nurmi failing to do his job and defend his client against the death penalty. But they're trying this time around apparently so even that probably won't happen.

I don't think witnesses the first time had any expectations of being threatened. They came willingly to testify. The reasoning for them not testifying were those of credibility not because they were threatened, which is what they would be claiming now. jmo

ITA. Nurmi could have had DB testify and her family. If has witnesses now, he could have had them then, but JM would cross and Nurmi was hoping for that one juror and boy did he get one.

I personally think the only thing that could change the ruling is if the defense states there will be no defense mitigation witnesses after all, then possibly the media might prevail on another motion, but I find either very unlikely.

Word gets around. With two opposing camps, the Arias supporters vs. the State of AZ and Justice for Travis plus innumerable interested parties, blogs and a knowledgeable public, the identity of a witness will not remain secret. It's not so much information leaking ​anymore, it's more that honey bees carry pollen.

Oh my god. This letter better not be a part of the retrial it is outer orbit irrelevant. There are threats happening on both sides (idiots) as evidenced by the man currently on trial for his plot to kill Nancy Grace. I wonder how many threatening letters Martinez has received from JA's nut bag supporters and could admit as evidence???

And how many Jo-dimwits are sending death threats to Jodi's own motley crew of loser witnesses, just so Nurmi and Willmott can cry "Lookie here! Death threats! Grounds for mistrial!"?

Is that the motivation? I couldn't figure that one out. It won't reverse her conviction. She's a convicted murderer no matter what. This trial only determines her future, she'lll never be a free woman.
