Oh my gosh. I can't say I agree with everything Judge Stephens has done here, and many I disagreed with strongly, but man there is no way she's anywhere close to incompetent. If you guys could only see the nonsense some of us have to deal with, with actual, crazy judges. It's rare but there are some real lemons. I watched Stephens during the entire trial and have a lot of respect for her. Calm, not driven by ego, trying to make sure there are no grounds for appeal. I liked her a lot.

That's for sure. There was one judge (retired now) who was so unpredictable that I would sit through the hearing before mine just to get a feel for her mood so I could adjust my approach accordingly.

How are there not legal consequences for any defendant/counsel who falsely accuse in a motion to a court attorneys, LE, etc., of wrongdoing involving a trial? I really do not get how something can be claimed without one ounce of evidence. It's bad enough lies are allowed in court under oath with zero proof.

I'm not riled about the motion per se; that will be denied due to lack of evidence. I am riled about how a motion can be filed with false allegations in the first place. It's not like they believe it to be legitimate and would back down once proven false. It is an out and out lie, in writing to a court of law, solely for some type of gain. I don't buy that the DT did this to preserve the issue for appeal because they would have to prove the allegation there as well--and they can't prove a negative!

That is a really good point. Isnt there supposed to be at least a tiny bit of vetting process to happen before an allegation is submitted formally onto a motion?

If there isn't, then whats to prevent the defense from filing 1,000 of these types of allegations and waisting a lot of court time and money to have them all denied?

For this latest allegation about the detective's wife's internet postings, a simple review of the evidence that the defense has for this would most likely show that it is just someone posting it with a "handle" or "user name" that looks to be the wife. Anybody can create "handles" + "user names" of their own choice and the only way you know who really is behind the name is to get the interent hosting site (i.e., Utube, Twitter, Facebook) to send you certified information of who has that particular "handle" or "user name".

If the defense does not have that as part of their evidence, this should have never been allowed to be submitted as a motion to begin with.

I am surprised they have 176 potential jurors remaining. They were dropping like flies. No one wants to give up months of their precious time to this murderer. Can't blame them.

Let's hope the State of Arizona is not billed for Zervakos' interview by the defense attorneys. Seriously, this could happen.

That's really what I was getting at. If he was interviewed after the original trial, that would be perfectly normal - JM or one of his people no doubt did as well. But if he has continued to consult with them, especially if he's getting slipped some money, seems to open a real can of worms. Think about it - he is more or less singularly responsible for JA not getting the DP at that time. If he engineered that so he could get a job working for the defense at taxpayer expense afterward, that would be a huge problem I would think.

Why is it both sides in a trial do not have to go by the same standards? It seems to me as though the defense has no standards.
