Retrial for Sentencing of Jodi Arias #3

The previous comment made me think about something. The state is obligated to provide defense counsel for her through the conclusion of the penalty phase, and presumably through various appeals if she gets the death penalty. If she survives this phase (slight pun intended) is the state obligated to provide lawyers for whatever other appeals she might try to dredge up, or is it up to her at that point to try to find lawyers to do it for free?

From what i understand, if she gets the death penalty she gets an automatic appeal and free attorneys. But if she gets life in prison then we the tax payers are no longer obligated to pay for her attorneys. She'd have to start paying for them on her own.

I'd love for her to get the death penalty and have it swiftly carried out but we all know it would be dragged out to be an even bigger drama-rama. I kinda like the idea of her getting life in prison with no more free attorneys and no longer getting any attention. Just sitting in her cell day after day, getting older and uglier while prettier, younger girls come along and get all of the attention that Jodi so desperately craves.

Being on death row means never-ending appeals and more drama. The advantage is that she will not be allowed in general population. She will be by herself most of the time.
I don't think she'll do well if given LWOP. She's so unlikeable eight days a week. And she's frighteningly manipulative. I don't think the other hard-core criminals will like or tolerate her. I don't know which is worse for her...DP or LWOP.

Isn't it obvious what is up? Just a strategy to underline the "media" motions. The poor little lamb going to the slaughter is so disturbed by the tainting of her potential jurors that she cannot stand to hear any more - and would the court please take note that she is thereby denied her right to be present for all proceedings.
 
Det. Esteban Flores AND WIFE? I was going to say this must be one of the dozens of motions to dismiss that have already failed, maybe it just somehow got mixed in with current court docs. But as far as I know (which isn't far), Mrs. Flores has not been named previously. Is she an officer of the court? In law enforcement? How can anything she has done be grounds for dismissal?

If you take a look at the motion on about page 14 of 59 pages....she seems to have knowledge of things that happened in private meetings under seal and is tweeting about them. She also did a video campaign against Jodi Arias. I assume the implication is Det. Flores told her...i seem to remember another snafu regarding Det. Flores in the trial that gave JM a bit of trouble getting by it. I think Det. Flores may talk too much. I do not believe his wife Corrina Flores is in law enforcement at all. I can only assume they have deemed this stuff to be really coming from her to file this motion but we will see. This trial is doomed to me and will either never start or if it does go forever.
 
He's already ruined his reputation, why not make a buck if he can. Samuels and ALV got their bucks first, and then ruined their reputations. Or at least ALV did (with the help of Nurmi and Willmott who I believe set her up, at least to some extent). Did Samuels ever even have a reputation to lose? Will anyone in any way associated with the defense come away unsullied?


Reminds me of that other trial. You know, the one in Florida?
 
That is a really good point. Isnt there supposed to be at least a tiny bit of vetting process to happen before an allegation is submitted formally onto a motion?

If there isn't, then whats to prevent the defense from filing 1,000 of these types of allegations and waisting a lot of court time and money to have them all denied?

For this latest allegation about the detective's wife's internet postings, a simple review of the evidence that the defense has for this would most likely show that it is just someone posting it with a "handle" or "user name" that looks to be the wife. Anybody can create "handles" + "user names" of their own choice and the only way you know who really is behind the name is to get the interent hosting site (i.e., Utube, Twitter, Facebook) to send you certified information of who has that particular "handle" or "user name".

If the defense does not have that as part of their evidence, this should have never been allowed to be submitted as a motion to begin with.

I guess I assumed they had to have the proof or not waste the court's time...if there is any truth to this frankly as much as I hate Jodi and her team...they have cause to ask for mistrial

I need good, solid evidence to believe that Detective Flores or his wife did anything even remotely 'wrong' precisely because this Defense team is making the allegations. The defendant and her team have no integrity. Self-defense, domestic violence, pedophilia, prosecutorial misconduct...and now accusations against Detective Flores' wife! I've been in awe of the good Detective from the beginning. He's amazing and my opinion is not going to change because some murderer is out for revenge.
 
I followed Mrs. Flores on Twitter until she shut it down in March. There have been 3 fake Twitter accounts since that posted all kinds of stuff. She did not reveal anything that was sealed that I saw. Were there some questionable things on YouTube? Yes. They were shut down.

The #Heinous Is Innocent people are behind a lot of this info. I am not sure that I trust their veracity. We shall see.

Zuri...why would she even have such an account given her high profile husband in this crazy crazy case and just shut down in March? And the You Tube stuff...why??? I would have to say Det. Flores is less than smart if he knew this and did not ask her to get off the internet. Lots of us live just fine without posting on line nonstop.
 
That's really what I was getting at. If he was interviewed after the original trial, that would be perfectly normal - JM or one of his people no doubt did as well. But if he has continued to consult with them, especially if he's getting slipped some money, seems to open a real can of worms. Think about it - he is more or less singularly responsible for JA not getting the DP at that time. If he engineered that so he could get a job working for the defense at taxpayer expense afterward, that would be a huge problem I would think.

It is standard practice that attorneys can reach out to jurors or vv if both sides are agreeable to talk. In this case the defense of course wanted to know what jurors were thinking and especially what he was thinking to tailor the next phase to get more like him. After a jury trial I was contacted by attorneys for my ideas of how they could do better etc. Nothing illegal here at all.

I had not followed this whole "snafu" between the JA team and the allegations with Mrs. Flores. If it turns out there is some truth that she was in a social media battle of sorts between the JA supporters and herself, I am actually quite surprised that Mr. Flores would not have put a stop to it before it got out of hand.

This JA trial continues to live up to its reputation. :)

I know very little of dp and what happens but my opinion is it would have been far better to cut the loss to taxpayers now...and seems like dp in the unlikely event they will give it to her (almost sure to be a stealth onboard) will afford her many more opportunities for grandstanding and taking up the courts' time.

That information was out there when the juror was dismissed and she had given an interview to MSM. The discussion about her could have been sealed but the dismissed juror had no problems talking about why she was let go. And we discussed it here on WS's while the trial was still in session. The juror was free to discuss whatever she wanted to about why she was dismissed. jmo
 
I'm in awe of anyone who managed to read the whole 59 freakin pages of that latest document. I made it to "Relevant facts" at the top of page 4 and I'm pretty sure I won't make it much further.

1. Ms. Arias has no prior criminal history.
Well, none that she was charged for at least, eh?​

3. Ms. Arias is remorseful for her conduct.
Really? Haven't seen that myself. All I've seen is her continuing to blame Travis. Even the choice of words: "remorseful for her conduct" -- doesn't quite seem to say she's remorseful for murdering him 3 times over so I'm not seeing remorse.​

6. The abusive nature of the relationship caused Ms. Arias to suffer extreme emotional stress at the time of the incident.
The words from her own mouth continue to prove there's way more evidence to show she enjoyed the relationship she had with Travis -- "that's so debasing. I like it." -- and probably instigated a lot of the sexcapades they had together -- and zero evidence of Travis abusing her. But HTG, if you're gonna claim remorse in one sentence, then FTLOG don't refer to it as "the incident". The butchering works. The murder works. 'The incident' does not work.​
 
I'd really like to understand the hard drive situation, did the defense ever get the mirror images of the 3 areas they (TLSI) could pull from it, and what was on them? The defense was extremely interested in that and it does seem the prosecution was making sure it was held back as long as possible, what the heck was on her laptop hard drive that required such behavior on both sides?

I only got to the Flores part because that was all I found interesting...and did not remember about jurors being dismissed etc. followed case but maybe not as close as most here...the point I am making is why have any on line presence at all if your husband is involved in a profession such as Esteban Flores is? I say low profile is the way to go and maybe a protected facebook to keep up with your family and friends but does not permit weirdos from sleuthing you. He is a high profile guy...just my opinion

They will have oral arguments on 10/14 for that motion as well as the motions to preclude witnesses and compel.
