That's how I understood it. Juan set up a catch-22; I am not aware of any assertion by him that there was . Meanwhile, the innuendo is doing its work. Poetic justice, IMO.

I don't think the jury ever saw Mr Emmy, so I think the first they heard about it was from Sue.

Yes, I was just responding to when the first reared it's ugly head in the DT strategy in this retrial. The original poster commented that KN did not bring it up in his opening statements. I guess BN was still working on the computer HD issues after the start of the trial so nothing was said at the time in case nothing was found? But it was obviously something they were working on at the direction of their "client".
