I understand that under AZ law the judge could not have sentenced the killer to Life after the hung jury, unless the state had been willing to take the death penalty off the table. If, however, this jury hangs, that's it...it is a life sentence given by the judge.

ETA: I apologize as I believe I misunderstood the OP. I thought it said the judge should have...but it does not say that at all. Sorry.

I thought it was the States option to pursue a retrial of the penalty phase or accept the hung jury and turn it over to JSS?

Honestly. Rarely do criminal appeals even get heard at least in Oklahoma. They burn through their appeals QUICKLY even DP cases

Oh, thank you SO much! I've honestly been a lurker for so long - all throughout this case (and a few others!) - and I almost feel like I know you guys already, having followed your posts for so long! (Sorry if that sounds creepy - EEEEK!) But it's a bit daunting trying to join in as a newbie - but I'm glad I've finally taken the plunge. It's been a wonderful warm welcome. Again - I hope I haven't 'outdone' my welcome by being TOO loud, but a lot of it is finally pent-up venting! (And a lot of beer - Arias will do that to you!)

I'm happy I've finally joined in. Looking forward to seeing the END of this creature along with the rest of you x

Glad you can be a voice for those who have been lurking along as well - we are pretty good folks! (Even GarAnTeed poked out of lurkdom today too!)

I cannot wait for this to get over, so that JSS actions in this case can be held to a level of scrutiny by colleagues, press and public. Her lackadaisical attitude towards the constitution is astounding.

Not to mention her lack of concern for the Jury's time. Because of her bad decision, now the jury has to be delayed a couple days and their lives are on hold.

During the 1st trial, it was ridiculous how she would just throw the jury in and out of the courtroom while she had private conversations with the attorneys outside of their presence.

I wish she would begin to show compassion for the jury and the public as much as she shows compassion for the defendent.

Which brings me to the silly delay tomorrow. It is obvious with the appeals court decision that JSS was just wrong to do what she did. So simply change your ruling back to allowing EVERYONE back in the courtroom to hear what this secret witness has to say.
If Nurmi doesn't like it, then allow the stay for that 1 witness and let any other witnesses appear. If he doesnt want to continue, then hold him in contempt.

if I were JSS I'd seek out why they are making inflammatory statements if they are indeed in fear of their lives? Why did ALV go on a national show post verdict if she was so fearful? Nobody forces these people to put themselves in the public arena
