Can't wait til Juan gets into her. Testimony so far has been nothing but her feelings on the matter. Nothing that can really prove anything.

So, despite the ridiculous claims as to why ALV cannot testify in the mitigating phase, Arias has obviously dumped her for not persuading the previous jury to find 'Not Guilty - Self Defence'. What exactly decided the DT to rehash the self-same model then? Could it be that they just love seeing Juan dismantle their experts, or could it be that Arias still has no mitigating factors?

Looks like it's been an interesting morning. I laughed when I heard that the " files" were deleted when a former defense team member had his or her hands on the laptop. Perhaps the DT asked to see the "live" laptop rather than just the Encase forensic image, then had to run a virus scan to get past the pop-ups lol.

To answer someone's question about 20 pages back, it's not ineffective assistance of counsel to delete a virus that has nothing to do with the case.

I think they encouraged this witness to not come off as so biased and not claim that every little actions of Travis' is evidence of abuse. She is keeping it a little more vague. I can see why Jeff thinks this tactic would have been a little more beneficial in the guilt phase. I still don't buy it though. She's still making Jodi sound like an innocent little angel. But I guess Jodi was a little better at hiding her true self than Travis.

I think that's his plan. Let's just hope this expert doesn't make a total defensive idiot of herself as ALV did. ALV was totally obstreperous on cross. I shudder to remember that horrible time.

Hopefully this lady wont be nearly as combative and plain weird like ALV. I just don't think there are too many running around like that woman or I would like to think... not.

If she honors her profession she will answer Juan's questions truthfully and honestly.

And he has a lot to work with on the questions he can ask her.

One of my favorite cross-examinations of a witness similar to this one, "mind-reading" the dead:

AZL: Doctor, did you ever get a chance to interview Mr. X?
Dr.: No, he was dead.
AZL: And did you ever interview anyone who had ever spoken to Mr. X?
Dr.: Um, no.
AZL: Actually did you ever even meet anyone who had ever met Mr. X or perhaps seen him across a crowded room?
Dr.: Um, no.
AZL: So if the next 12 witnesses who sit on that witness stand are people who not only met but spoke to Mr. X on a regular basis, wouldn't you agree that they would be in a better position than you are to say what he was thinking?
Dr. (arrogantly): No, because of my training and experience.
AZL: Oh, OK. Well, thank you for sharing your thoughts with us. I have no further questions.

As far as I can tell from reading tweets , she has not yet ruled on the "" motion. However, it appears that she granted JM's motion to prevent Nurmi from mentioning the alleged sites while questioning this witness, which is a pretty good indication that she thinks JM's story about the defense team accessing the computer at the relevant time is likely to pan out.
