On the "what happened to the bag in Casey's trunk" thread, there's a post that LP is claiming that LE has found the body. Yes, that's right. That would certainly change things, wouldn't it?

Absolutely.

First, that would settle the dead or alive issue.

Second, the M.E. might be able to determine the cause of death and the mechanism of death (if relevant).

That's speculation.

First, where is the clear and unyielding evidence that Caylee died from an unlawful killing?

Caylee told us what happened to her. She left some of herself in the trunk , she left her hair to show us that she is in heaven. She told us that her mommy killed her. They have enough to put her behind bars for life. Bless her sweet soul.

YEP! Theres overwhelming evidence. There's absolutely NO WAY a jury wont find her guilty, if, for no other reason than her doofus attorney having some ridicoulous openingstatement.

If he put her on the stand, that would be legal malpractice.

Good idea, thanks for bringing this back. I believe LE will be able to show it was premeditated. From what has been released, I think the computer searches and the duct tape will be used to show premeditation, but I also think there is more to come in that area. LE has stated emphatically that they believe it was premeditated murder, I believe in their ability to prove it.

I believe they do. 31 days of not reporting her child missing is pretty strong in and of itself. The other stuff is just gravy.

what exactly did she do in her "backwards way" on her own to actually find her daughter?

hells bells, she put more planning into EVERYTHING else she did

getting tatoos
getting harcuts
going shopping
stealing
gabbing on the phone
etc
etc
etc

see, thats the problem for her and her whole defense team, they wont be able to show one credible piece of evidence that she DID anything :furious:

The clear and unyielding evidence is that she was DEAD in her mothers trunk.
Her mother told NOBODY!
Her body was found down the street from their house-wrapped in garnage bags and thrown into a laundry tote.
She had DUCT TAPE across her mouth.
And oh yes, she was DEAD! and I doubt that she was killed in a lawful manner...:rolleyes:

Anyway.. I am not as convinced as I wish I were that this is an open and shut case. There is no one single piece of evidence, (so far released) that taken by itself, really shows that this was murder, and/or that KC was responsible. Taken all together, the evidence seems overwhelming, and I cannot imagine what the defense will be, but juries do not always listen to the whole chain of evidence. They wait to hear that 'her fingerprints were on the duct tape.' If it isn't as simple as that, they hesitate to convict a pretty young woman on circumstantial evidence alone.

There might not be one single piece of evidence released YET (a "smoking gun"), but LE has emphatically stated that they believe that Casey was single-handedly responsible for the premeditated killing and disposal of her child. In order to make that statement, they have to have some pretty convincing evidence. Remember, too, that they made that very same statement to the GJ, who delivered a 7 count indictment including 1st degree murder-ALL BEFORE CAYLEE WAS FOUND. Now, with the discovery of the remains, they now have even more evidence. Obviously, they are keeping the "smoking guns" close to the vest at this point-testing, retesting, making their case airtight against Casey. It's going to be the totality of the mountain of circumstantial evidence, as well as a few smoking guns that we haven't seen yet (IMO) that are going to seal the deal for Miss Casey.

ETA: In a sense, it's not going to be an "open and shut" case...it's going to be weeks upon weeks of the State presenting exhibit after exhibit, and all of us watching as JB's head finally goes "pop"! I can't wait!

Unfortunately I wish there was direct proof that will tie Casey to the baby's demise, but like you I feel that everything is pointing at Casey but nothing so far ties her directly to proof of doing it.

I agree - I don't see evidence to prove premeditated murder so far. I especially agree with your point about the dream team - I think that group of high profile professionals will change drastically what goes on in this trial, as compared to how it started with only J. Baez to defend her. You know how it is, there are some people who think if a "famous" (or infamous!lol) person says it, then it is true, or if news media reports it - it's true, or if law enforcement/courts say it - it's true. If it was premeditated murder, I certainly hope they have the evidence to prove it - or to put it another way, whatever part she did played in this, I hope they hold her accountable -- no more and no less.
