RI RI - Linda Carman, 54, Point Judith, 18 Sept 2016 *SON ARRESTED, dies before trial*

Wired reported last summer that Carman's account of where and when the boat sank does not jive with expert analysis of wind and current data from a research buoy in the area.

An experienced maritime lawyer working for the insurance company learned about an expert in ocean forensics who'd help locate the wreckage of Air France flight 447 when it disappeared over the Atlantic in 2009. He contacted the oceanographer and asked him to analyze data from an offshore scientific research buoy in the area.

The expert's analysis of weather and current data from that week indicates the raft would have drifted west (toward New York) if it sank in the area Carman said it did. But for Carman's account to be true, the life raft had to have been drifting east (toward Massachusetts) in order for it be in the proximity of the commercial vessel 7 days later. The oceanographer also worked backwards from where the crew of the commercial vessel picked up Carman, using the oceanographic data to reconstruct the life raft's position on previous days. Scientific analysis indicates the Chicken Pox did not sink in the area Carman claims and/or it was not drifting for the number of days Carman claims it was.

The oceanographer's findings were part of the insurance trial. Because Carman's work on the boat undermined its structural integrity and seaworthiness, thus voiding his insurance claim, the insurance company's argument and the court's decision focused on his alterations to the boat.

That trial did not hinge on the plausibility of Carman's account of where the boat sank and when. But the forensic analysis done at the behest of the insurance company's attorney may have been pivotal in the indictments for murder and fraud.

I recall listening to the audio between NC and the US Coast Guard in Boston when he was picked up by the freighter. I was surprised to learn that the guy I heard over the radio accounting his ordeal was allegedly adrift for 8 days at sea. JMO

Me too. But I couldn't come up with a plausible explanation for where he could have been for that week. It still seems unlikely that he hid out at an island or on the mainland someplace because the search was such big news around New England. Do you have any theories?

Reading about a similar disappearance in Australia raises the question--was there a second boat? The Chicken Pox wasn't seaworthy to be out that far for so many days and it didn't offer much protection from the elements.

I knew it reminded me of another case.

I recall thinking that he must have been very prepared with plenty of water and food -- i.e., a quantity that definitely exceeded the supplies typically carried for an overnight trip.

I believe he is guilty but have thought they may never actually get him for this!

RUTLAND, Vt. — A former Connecticut resident accused of killing his mother off the coast of Block Island in 2016 to inherit a cut of the family’s estate asked to postpone his detention hearing set for Monday to give his federal public defenders a chance to “investigate” the allegations.

Nathan Carman, 28, pleaded not guilty during his arraignment Wednesday inside a federal Vermont courthouse on first-degree murder and multiple fraud charges in connection with the death of his mother, Linda Carman.

HARTFORD, Conn. (AP) — The circumstantial evidence against Nathan Carman had been lying in plain sight for years before his surprising indictment and arrest this month on allegations he killed his mother at sea off New England in a plot to inherit millions of dollars.
Federal prosecutors in Vermont are not commenting on the timing of their decision to put the case before a grand jury, and the indictment offers no clues and no new information on the case, which included a dramatic rescue at sea and the suspicious deaths of two members of a wealthy New England family.

Both the prosecution and defense believe Nathan Carman is competent to stand trial.

Both the prosecution and defense believe Nathan Carman is competent to stand trial.
The defendant has now been incarcerated for about three weeks and the Judge's inquiry about whether or not the defense (or Govt) expects to pursue a competency evaluation of NC is a standard inquiry during the status hearing.

However, since competency can change at any time, it does not necessarily mean NC is competent to stand trial, but that both sides believe he's capable of assisting his counsel with his defense, and the Court can proceed with the hearings.

If at any time between today and the trial the defense believes NC is impaired, they can move/motion for an evaluation which essentially stops the clock on all proceedings until the evaluation is completed and/or the defendant is restored to health.

BURLINGTON, Vt. (AP) — The man charged with killing his mother at sea during a 2016 fishing trip off the coast of New England in a plot to inherit millions of dollars will remain detained pending trial, a federal judge in Vermont ruled Tuesday.

U.S. District Court Judge Geoffrey Crawford denied Nathan Carman’s request to be released, saying he is a flight risk and potential danger due to the seriousness of the charges, lack of strong family, employment or community connections “and his involvement with firearms and the ongoing feud with his family” over his late grandfather’s inheritance.

Crawford said the evidence regarding the loss of his mother at sea, and “the acrimonious dispute” with relatives over the inheritance, as well as his purchase of AR-15 type weapons “are evidence that this is a volatile situation.”

In summary, federal prosecutors want the potential trial date moved back due to the complexity of the case.

“The clock started ticking Friday for Carman to receive a speedy trial within 70 days” but “prosecutors don’t want the 70-day time frame to go into effect until at least after a status conference at the end of September.”

U.S. District Court Judge Geoffrey Crawford on Tuesday set the trial for Oct. 2 in Rutland. A federal prosecutor said the government planned to include several different types of expert testimony, including testimony on marine survival and draft analysis. Prosecutors plan to make those disclosures to the court by May 1.

I wonder how it is possible to kill his mother and grandfather: I cannot even imagine that. I know that sometimes intra-family problems exist, but to go as far as murder . I am flabbergasted. (traduction reverso, English is not my native langage.)
