Grand jury rule an affront to freedom
January 16, 2004

Colorado's grand jury secrecy rule strikes us as a clear violation of the First Amendment. Thus U.S. District Judge Wiley Daniel was right to strike it down in 2001 and the 10th Circuit Court of Appeals in Denver wrong to reverse him last summer.

But what we think doesn't matter now, alas, because the U.S. Supreme Court refused this week to take up the case. The appellate decision stands.

We're stubborn, however, and will discuss it anyway in the hope that the legislature and courts might someday do something about the secrecy rule.

I'm so glad the Rocky Mountain News understands what the whole appeal was about.
