Ron's possible plea deal?

I can hardly wait! I sure hope this is a serious judge and he doesn't fool around. This is the date that has been set aside for Ronald's trial and I just cannot see how it would not happen today.

The sentencing may not take place today, but at least there is finally some action!

PALATKA, Fla. -- Ronald Cummings is slated to start his trial on drug charges Monday.

He faces five felony counts related to drug trafficking.

His lawyer told First Coast News in May they were trying to arrange a plea deal, a final decision on that arrangement never surfaced. Trial to start later today.
 
I really cant believe hes taking this to trial, I mean I really wanted him too, but I just cant believe he is with all the evidence against him!

Update on Ronald Cummings case---jury is being selected--live stream will happen once jury is placed--News4Jax will live stream it from what I heard down the grapevine....Levi, you here today? He will be on JVM tonight FYI.

I am going to be shocked if he goes to trial. I am also starting to think the state maybe really didn't give him a plea, and thats why hes at trial, is that possible?
 
Does this mean the potenial jurors have to be voydire ,,(sp) whatever and if so how long will this take,,,,TIA for those who can answer,,,or is the voydire procedure only for capital crimes?

Yes, the process is the same unless RC has a bench trial which means no jury, the judge will hear the proceedings.
I am not sure how it is decided the defendant will get a jury or bench trial.
Anyone know? TIA

Ron chose to have a jury trial. Its up to the defendant what route they want to take. I just cant see this being Shoemakers idea when the evidence is so highly stacked agaisnt his client. jmo
 
It will take several hours to chose a jury. Quite a process. First they have to make sure they eliminate anyone who is familiar with the case. Then they have to eliminate anyone who may be relative, friend, friend of a friend or who has a very bad personal view of drug defendants or the system as a whole. They will be given a synopsis of the case by a judge, the statutes and other legal matters. They will eliminate anyone who can't speak or understand English. They will ask about hardships if you are seated for several days. They will ask you if you can be fair and objective.

They will then seat a panel of more jurors than they need. Then the lawyers will question the potential jurors. Asking how do you feel about police? Do you have a criminal record? Do you have relatives that are in law enforcement? In my trial there was a chart. Name, age, children, married or single and profession, parents ages, and their profession. Have you ever been deposed, or been a witness at a trial. From there they will continue with questions as they might relate to the case. Maybe surveillance type of questions relative to your attitude. They will get very personal with the jurors about their pasts and present activities and that of their family members. Then the attorneys get a shot of removing people they don't feel will be good for their side. They will eventually get the jury down to 12 with probably one alternate. Sometimes 2 alternates.

At my trial in which I recently sat as a criminal juror, it took about 5 hours for voir dire and it wasn't a high profile case.

Ronald Cummings, the father of missing Putnam County 5-year-old Haleigh Cummings, is set to stand trial on drug-trafficking charges today.

His attorney had hinted back in May that he would take a plea deal on the five charges. But at a hearing in June he only pleaded no contest to two of the charges.

According to Putnam County Court Records, jury selection on the remaining three charges begins Monday morning.

Here is a link to an article an attorney wrote for advertisement purposes about "preparing for a jury trial Jacksonville Florida." I've only copied the start of the jury process but it answers all the questions about jury selection, voir dire, etc.

Selecting the Jury

On the day your case goes to trial, a group of prospective jurors is selected at random. If the jury will consist of the traditional 12 jurors, about 30 prospective jurors will be called. If the jury will consist of only six or eight jurors, the jury pool is likely to be smaller.

The pool of prospective jurors is brought into the courtroom, and a smaller group is chosen at random and seated in the jury box. The judge then asks them questions. The goal of this questioning process, which lawyers refer to by the French term, voir dire, is to select a fair and impartial jury.

ITA but Shoemaker could have withdrawn as his lawyer so I think Shoemaker has a plan. Dam* I wish I was there.
