I think the order was made on the 22nd or 23rd...I don't know if they count public holidays or not, but if they don't, then it expires about now.

I saw Conway on tape after the hearing.....must have been edited....he was whining about the delay of the release of the x-rays and pics prohibiting the A's of having a funeral for Caylee. The part about the A's worried about the selling of these items wasn't mentioned.

Makes sense to me. They want the issue resolved, which ultimately will mean the items are turned over to the defense, and they also do not want the photos sold.

I don't believe the state is trying to withhold evidence, they are only trying to be certain that these traumatic, and probably vivid photos of poor Caylee don't end up on the internet and on the cover of the grocery store tabloids!

As far as your last paragraph, I wouldn't have any problem at all with the prosecution wanting to be sure that my baby's photos of skeletal remains didn't end up public! It is blatantly apparent to me that they only want the ME's photos and findings to try to shoot holes in them as was stated by another poster. The defense doesn't have a case all they can try to do is get KC off on some technicality - so they are looking for some mistake somewhere - anywhere to help their case. While they are at it, they can make some $$!

If the prosecution just wants reassurance that the photos won't be sold, why is JB objecting? UNLESS HE (or someone) WANTS THEM SOLD FOR $$$!

This trial is going to be laughable I'm sure!

JB should just agree to what the prosecution is requesting. JB would be a fool to allow anyone to sell those pictures for profit. If those pictures were released, the public would really see what kind of monster KC is and what she is capable of. This is the last thing he needs while trying to defend her. IMO:furious:

The two weeks were up yesterday. The SA filed the "protect the pictures" motion instead of just handing the videos and disks over.

Do we know if Casey has transferred her rights pertaining to Caylee to G and A? Would that be necessary for the A's to proceed with a funeral?

I have been asking that same question for days. There is nothing in print to confirm or deny that Casey has signed over her rights to the remains to the Anthony's. Or anyone else, for that matter.

"Anyone" who would have access to the prosecution's photos would be limited to the prosecution and the defense. You think JB should have filed a motion barring the prosecution from selling the photos? The prosecution didn't file this motion citing concerns about "anyone" - just the defense team.

I don't know who would have access to this info...maybe a cleaning person? I just think that out of concern the defense should have wanted this info guarded very well and have taken any steps necessary to assure that. Is it only pros or defence? Does anyone not a lawyer or judge handle the process of paperwork? Someone who could secretly copy and sell this info? Just how many experts (potential book writers) have access. It only takes one unscruplous person.

By restricting this evidence, they're effectively limiting the right of the defendant to confront witnesses and her counsel from preparing a zealous defense. If this motion were to be granted it would set a dangerous precedent for the rights of all citizens.

I don't think that many people grasp that concept - they have so telescoped their vision to this one case, that they simply cannot grasp that this case can set precedent that can affect us all.

IMHO, it would not be a bad precedent to set to restrict the sale of such things as autopsy photos/images for criminal cases. I agree that restricting use for the defense team itself can be tricky, but as for confronting witnesses, in regards to the autopsy, the witnesses that would be confronted would be the fellow experts who performed the autopsy in the first place, not any other state's witness, I would imagine.

Certainly you aren't suggesting that if the motion was approved with a specific clause stating the images cannot be sold, in any manner, that would be a bad thing for other cases, too?

Just say, for instance, that the 3rd party backing this defense team is an entity which would love to get their hands on such pictures. The SA may have figured out who is behind this dream team and realized they better address it at this juncture BEFORE JB could show THEM the photos and somehow allow the evidence to be "leaked, stolen, or hacked".

Conway is making statements that imply and leave no doubt. The A's are in charge of the remains.

Confront what witness?

The defense expert(s) can view these findings. Even do a "second" autopsy if they wish. Could have gone to the site where the remains were found.

Can they send these x-rays and pics via the internet or send the remains via UPS? Hopefully, not. And can they sell these images to The Globe or National Enquirer? Hopefully, not. But, I guess in your thinking, who knows? Some budding forensic sleuth may see something in The Globe pics to help JB vigorously defend Casey.

All of this is available to JB and whomever he deems as an expert to examine. In Florida. But, they just can't sell pics of Caylees' remains to the highest bidder. Hopefully.

I believe that LKB and Dr. Lee are the point persons on forensics for the defense. They managed to travel to Florida for some photo ops. I bet they could manage to return to work their magic on debunking the states case.

I agree, cutting it close but there were the holidays to consider. Why didn't JB file to protect this info. Seems that KC should be concerned about this issue.

Would that then be Jan 12 that the SA would have to turn over the doc's? That is weekend and Holidays are excluded.

I do not think that JB wants that info out there NOW. But do I think that info could be bartered in the future for book deals, movies, true crime dramas by someone(not necessarily JB)? Yes! Is this all about copywright?
