This sounds awful fishy to me. How come all of a sudden they were able to get it done? I don't like this one bit. MOO


I agree, same way the defense team never went to the crime scene after they were allowed to. :rolleyes:

They are in effect holding evidence from the defense, because they are not releasing the autopsy report in a timely manner and are putting restrictions upon that release of evidence. There's a bigger picture here.

These type of motions by a prosecutor is not unusual regarding evidence. The prosecutor's first obligation is to protect his case and preserve the integrity of the evidence. IMO, if the SA filed this motion citing their concern that previous photos were/may have been sold, that is their concern and reasoning for this motion to begin with. A valid concern that the SA will have to back up in court or have it tossed out by the judge and that will be determined tomorrow.

I didn't say the state is trying to withhold evidence, I said that they ARE withholding evidence.

IMO, some disorder runs in this whole family.

I have been wondering about the exact same for quite some time, since the first phone call between C & KC in jail...it didn't strike me as real.


This has been my DH's pet theory since the beginning. And on many levels it makes more sense than anything else about this. His theory - Caylee is accidently murdered by Casey, the entire family then comes up with this plan, or just Casey and Cindy - he goes back and forth on this - and the idea is that Casey is willing to go down on it thinking she will get at most 10 years, but, they/she will achieve what they feel is fame and wealth over this and she will still be young when she gets out.

There are so many things that just totally don't add up. Having a month to cook this up and then work it seems likely.

Since the photos are apparently no longer an issue, what else is on the agenda for tomorrows hearing? Anyone know?

If NG's info is true, it sounds like the defense and prosecution were able to work out some sort of compromise today. That's a good thing.

If I recall correctly, the State had 14 days to turn over the evidence or respond to the order the signed by the Judge. Like I said, I am going by memory, so I might be wrong, but that is how I remember it being said when it was announced.

If that is the case, then how is the State, at this point, withholding evidence from the defense team?

Random thought here. One would think JB and the A's would do anything NOT to have the photos viewed by the public. Publishing the photos would incite more people in angry more than they already feel about KC, CA, GA and LA. Add JB to that mix too.

I don't know. That poor judge. It might be a long day for him.

Yes, it is good news if, in fact, the second "autopsy" was completed.

I am totally in shock that most of those items have not already been turned over to the defense. What the heck is the prosecution doing????

Probably trying to figure out this whole mess, and are not through investigating most of what defense is asking for

What could the prosecution still be investigating that would keep them from turning over old interviews, DNA results, search warrants, etc?

After reading item #6, I'm inclined to believe that the concern is the media is shopping for a seller and the SA wants to make sure a seller isn't created by distributing these pics.

ETA: and they want to make sure Baez doesn't let that happen.
