MAYVILLE, N.Y. (AP) — The New Jersey man charged with stabbing “The Satanic Verses” author Salman Rushdie is allowed to seek material related to Rushdie’s upcoming memoir about the attack before standing trial, a judge ruled Wednesday.

Jury selection in Hadi Matar’s attempted murder and assault trial was originally scheduled to start Jan. 8.

Instead, the trial is on hold, since Matar’s lawyer argued Tuesday that the defendant is entitled by law to see the manuscript, due out in April 2024, and related material before standing trial. Written or recorded statements about the attack made by any witness are considered potential evidence, attorneys said.

“It will not change the ultimate outcome,” Chautauqua County District Attorney Jason Schmidt said of the postponement. A new date has not yet been set.

Assistant public defender Andrew Brautigan told the jury that prosecutors have not proved that Matar intended to kill Rushdie.

“You will agree something bad happened to Mr. Rushdie, but you don’t know what Mr. Matar’s conscious objective was,” Brautigan said. “The testimony you have heard doesn’t establish anything more than a chaotic noisy outburst that occurred that injured Mr. Rushdie.”

The Booker Prize-winning author told jurors he thought he was dying when a masked stranger ran onto the stage and stabbed and slashed at him until being tackled by bystanders. Sir Salman showed jurors his now-blinded right eye, usually hidden behind a darkened lens.

The jury's guilty verdict came after a two-week trial in Chautauqua County Court in western New York state, near where Matar stabbed Rushdie in August 2022 as he was delivering a lecture.

The jury also found Matar guilty of assault for wounding the interviewer, Henry Reese, who was on stage with the author. Mr Reese suffered a minor head injury during the attack.

Matar's sentencing date has been scheduled for 23 April.

Matar still faces federal terrorism charges in connection with the attack. He was indicted by a grand jury on three counts, including attempting to provide material support to a foreign terrorist organization and providing material support to terrorists. The indictment alleges he “knowingly did attempt to provide material support and resources” to Hezbollah, a designated foreign terrorist organization, and “had engaged, and was engaging, in terrorism.”

Matar was also charged with an act of terrorism transcending national boundaries for the attack against Rushdie. The indictment alleges that he “did knowingly attempt to kill, and did knowingly maim, commit an assault resulting in serious bodily injury, and assault with a dangerous weapon.”

He has pleaded not guilty to the federal charges.
