How do we find that out for certain?
Is it a directions hearing or something else?
A phone call to the court will solve those questions. It was listed as a Directions Hearing.

I rang the Supreme Court Registry this morning, and the clerk informed me that the matter is going ahead this Friday, 29th November, 2024, at 9am. It is an open court, so interested people can freely attend.

It still might be an idea to check the Supreme Court online list after 4pm tomorrow, incase any last minute changes occur.

 
Legislation changed 2022 to allow Judge only trials in Victoria. However he can't go that way if mental health is an issue.

The parties involved have to appear before a judge who decides if it is in the public interest to have a judge only trial, Unlike NSW where the accused can choose it. Dawson , Gittany, they went that way, and it didn't turn up trumps for them!! :p
 
I reckon he's growing all this hair and beard and throwing on the weight, it's so he looks nothing like some visual VICPOL has of him on the day of the murder. He wants to leave that boyish looking figure behind... .

This is a directions hearing, where he has to submit all his upcoming testimony , who makes it, how long it will take, how many witnesses, normally, this would have been handed up once he made his plea, his barrister would whip it out of his briefcase and hand it to the clerk of courts. . But , obviously, this has not happened, so an explanation of that will eventually become clearer.

Once this part is settled, , ( it is a significant part of a trial, ) it's basically the timetable of the upcoming cross examinations , then the judge asks the prosecutor how long his opening statement will be, ditto for the defence, an estimation for the clerks, and paralegals etc.. The prosecutor and the defence will know to the second how long their opening and closing statements will be. What is unknown, is the behavior of witnesses... who is co operative, who is not,

I am wondering, given his change of counsel, if the new guys will be up to speed enough to provide all this?

WHen I look at the website of Allen, the man who was at his last hearing as his legal rep, Moya O'Brien appears to be an associate of his chambers, Gormans chambers.. and not Galbally's now, whether this is correct or an optical illusion on my part, ...

I wish there was a 'shrug' emoji, Mr Jitty.. I can't unravel it at this point, but it will all become clearer, down the track..

I don't know, because I don't know what time it ( his particular matter ) will start. ..... Generally speaking, and it's only general, the matters to be heard where the accused appears in person are attended to first.. they are all bought in from the CIty Remand centre by a big horse float thingy, and dealt with and then carted back to the Remand centre... then the ZOOM appearances, but this depends very much on what is going on at the Remand centre. Things do go awry and schedules get shifted around.

A lot will depend on whether he has adhered to the court's direction to him at the last hearing. Get your Notification of Alibi on the record. . if this is again in doubt, then things are going to take a bit longer. Nothing can move ahead until he has done that. But once he makes his appearance, and all things he has been required to do have been settled and tabled, then it takes about 30 minutes tops.. generally..

To be honest my motto is you can just not bother about all this pre-trial stuff and tune in for trial.

That is correct. it may well be that he is the only Remandee to be called up, I have not got the list for the day. but if there is more than one, more than him, there is no reason to suppose that he will be first.. he could be, but not guaranteed.... He has been squeezed into this day's court day, so it's unlikely to me that he would be the only one who had a matter before the court... .. even so, ANY case being heard in the SC is interesting!!..

People will come and go, you can go as well, but you can't get up and go once a hearing starts.. you have to wait until the usher says, all rise.. while the judge exits..you can't leave in the middle of it...

I’m getting myself confused. Have both Michael and Moya come from Galbally’s, and both moved to Parnell’s?

It's like Central Station, all change for the Chatswood line.. ... I have not figured it out yet. But somewhere there has been a change. Either of his barristers, or the barristers have changed chambers... :confused: :confused: :confused: :confused:

Ok, so there’s a chance he could be still with Moya (to some extent), yet the admin is appearing a bit shoddy of late so maybe not. Michael Allen wouldn’t be partially in though, he’d either be totally in or out. So how do you have competent Barristers, and also stones left unturned?

Just speculating, but does the confusion lie in the possibility that the accused has rejected counsel from his assigned legal team…and perhaps now they’re scrambling to find someone else who’ll work with him and get up to date with the volumes of info? Gosh, what a task if so!
