SC - Bride, Samantha Miller, dies 5 hours after wedding when DUI driver slams golf cart, Folly Beach - 28 Apr 2023

I think that the defense is just letting this play out for as long as possible, and we will probably see a deal prior to trial. After all, JK has no reason to go for a deal now, it just puts her in prison that much faster.

We saw the same strategy with the "Long Island Cesspool Socialite".

Not sure if we're going to see a plea even offered - JK is likely looking at 20+ which under SC law would require her to serve at least 85% of her sentence.

Yeah I'm surprised they didn't offer a plea deal considering it's a slam dunk. Is there anything controversial? Like maybe golf carts are not allowed on that road or something? It still wont absolve you even if that were the case. MOO

I asked a now retired police friend and tho he has been out for several years, he says the technical points of charging DUI could get sticky. I figure a plea deal will be the result tho she is facing serious penalties.

If you read about the victim, the mother of the victim tried to get the money from her daughter's estate, as she said that the marriage was not valid as it had not been consummated. Therefore, the husband was not entitled to any of the money from the settlement, as it was for her daughter's estate.

Wow...

Well the trial starts tomorrow, so I guess there was no plea deal. I guess they are fighting specific charges because the civil case already outlined quite a bit. IMO

Komoroski’s trial is scheduled to begin Dec. 2. She faces 3-85 years in prison if convicted at trial.

At least she is smarter than Sarah Boone, taking the plea deal

There was an atty interviews earlier who explained the dangers of going to trial with this evidence.

Good on her. Taking accountability.
Glad the families dont need to experience any of the suffering a trial would bring them. jmo

Oh wow, so they could not agree on punishment so the judge will decide! Interesting, did not know that was an option.

Is the judge going to decide today?

Gotta say, Called it. There was no way she was going to trial. Maybe this will let her sentence be a bit less severe. Wow, she has really changed from the "party girl". I wonder if her fiancé broke up with her?

As I understood it, 25 years for the felony DUI resulting in death to be served concurrently with two other sentences of 10/15 years for DUI bodily injury. Less any time served including house arrest so about 23 1/2 years. She has to serve at least 85%.

Edited to reflect actual charges/sentences to be served concurrently -

1. Felony DUI driving - death results - 25 years
2. Felony DUI driving - great bodily injury - 15 years
3. Same as #2
4. Reckless homicide - 10 years

Upthread Sustained stated that Komoroski has to serve at least 85% of her sentence. Does this mean that she is not eligible for parole at all? I hope?

After 21.25 years she could be eligible for parole.
