Definition of murder in SC:
"Murder is the killing of a person, with malice aforethought, either express or implied".
So...what would be "implied" malice aforethought? Apparently this term is included in all murder charges, so it does not really tell us they have explicit proof of premeditation, but could have "implied" evidence of such. I asked this before; would luring someone out of their home be enough? Or doing so while carrying weapons? Or do they even break it down at all, since murder charges in this state all include this wording?
In other words, in SC, it appears that "malice aforethought" accompanies all charges of murder. Or that is how I am reading it.
