McCahren bond hearing scheduled for Monday

Since that night, McCahren has been held without bond in the Hughes County Juvenile Detention Center. Beadle County State’s Attorney Michael Moore, who is the special prosecutor in the case, says Monday’s hearing will center on a defense request to modify that bond condition.

Monday’s hearing, which starts at 11 a.m. in the Hughes County Courthouse, is one of three hearings set in the case within the next month.

McCahren was scheduled to stand trial January 21. But that was postponed after the South Dakota Supreme Court overturned Judge John Brown’s ruling in September that McCahren be tried as an adult...

...Two motion hearings, one on Thursday, January 23 and the other on Thursday, January 30, have been scheduled to consider that issue. Both of the motion hearings start at 10 a.m.

Moore says those motion hearings will help determine how the case proceeds from here.

No new trial date has yet been set.

Candle Light Vigil tonight for Dalton Williams

A candle light vigil is tonight in memory of a Pierre youth who was shot and killed one year ago today.

Dalton Williams, 16, died after being shot by Braiden McCahren, another Pierre youth. The shooting took place on December 18, 2012 in the McCahren home.

Pierre teen accused in killing can get out of jail

PIERRE, S.D. (AP) - A Pierre teen accused of killing a classmate will be released from jail.

KCCR-AM reports a judge granted a defense request Monday to release 17-year-old Braiden McCahren on bond.

McCahren hearing set for Thursday

The murder case of Braiden McCahren is back in Hughes County circuit court Thursday.

McCahren, 17, has pleaded not guilty to first degree murder in the December 18, 2012 shooting death of 16-year-old Dalton Williams. The shooting took place in McCahren’s home. Another juvenile also was in the home at that time.

Prosecutors allege that McCahren deliberately pointed the gun at the third juvenile and fired, hitting Williams instead. The defense says the incident was an accident.

Two hearings, one on Thursday and the other set for next Thursday, January 30, have been scheduled. At issue will be several motions that have been filed and also arguments regarding whether McCahren should be tried as an adult.

Defense says it was an accident but, even in the beginning, the 3rd boy in the room at the time of the shooting said McCahren was aiming for him and hit the other boy. Is it the defense's contention that it was an 'accident' because he missed his intended target? smh

If McCahren's dad wasn't a lawyer, would this case be carried this far? I personally don't think so.
 
Now the defense has said that McCahren's original attorneys MAY be potential witnesses in a motion hearing and at trial. Based on a potential event the defense wants a new trial date. McCahren's father is an attorney and is using every possible tactic to stall this trial.

PIERRE, S.D. (AP) — A Pierre teenager accused of murder has new attorneys and might get a new trial date...

...McCahren's trial is tentatively scheduled to begin June 2 in the town of Winner, but his new attorneys have asked that the trial and the Monday hearing be delayed.

PIERRE, S.D. (AP) - Trial has been delayed for a Pierre teenager charged in adult court with killing another teen.

Judge John Brown on Monday granted a continuance requested by the attorneys for 17-year-old Braiden McCahren. The teen has two new defense attorneys handling his case because his two former attorneys might be called to testify as witnesses.

Now this trial has been moved from Pierre, the state capital, to Winner, a small town only 92 miles away. The trial could have been moved to Rapid City, which is 200 miles away or Sioux Falls, which is 224 miles away. The demographics of both those places is much different than Winner; they are larger and a broader cross section of the population. Choosing Winner is, in my opinion, jury shopping. If the accused's father wasn't a prominent attorney in South Dakota, the accused would already being serving his sentence. Instead, again just my opinion [as well as the opinion of others in Pierre], he is a pawn in a game of 3 dimensional legal chess. The out come should be interesting.

Testimony has started in the murder trial of a Pierre teen accused of shooting and killing a classmate in December 2012...

During opening statements McCahren’s defense attorney Mike Butler described the shooting as a tragic accident. “What happened to Dalton Williams is terrible,” Butler told the jury. “But convicting someone wrongfully of murder in an effort to console them (the Williams family) would be wrong.”

But Beadle County State’s Attorney Michael Moore, who is serving as a special prosecutor in the case, said that McCahren is the one who ‘intentionally’ pointed the gun at his friend and Williams while the three were messing around in the home.

McCahren’s prosecution has taken almost 21 months to reach trial, having been delayed nearly half a dozen times as lawyers from both sides contested what evidence can be used, who can testify and whether McCahren should be tried as an adult.

Hughes County Judge John Brown rejected defense lawyers’ efforts to have the case tried in juvenile court. Brown said McCahren’s history of aggressive and violent behavior warranted adult court, calling his past behavior “reckless, impulsive and violent

Witness: Doesn't think Williams' death accidental

T.Y. testified that he was scared when McCahren loaded a shell into a 12-gauge shotgun, pointed it at him twice and pulled the trigger. He said he tried to leave McCahren's house on two occasions. The third time he attempted to leave, T.Y. said, Williams was between him and McCahren, the gun discharged and struck the victim.

A forensic pathologist testifying for the prosecution said Williams was struck twice by the same shotgun blast. Dr. Donald Habbe told jurors that the bullet initially hit Williams in the front of the right wrist as it was raised in a defensive posture. The shot then exited through the back of the wrist and went into the chest.
