Erin Corwin murder trial date set, Chris Lee could face death penalty

"The Hi-Desert Star news reported Jan. 2 that a trial date has been set for the case of missing horse whisperer Erin Corwin. It was 7 AM one hot summer morning when 19-year-old and pregnant Erin kissed her husband goodbye and was seen alive for the last time. It would be weeks before she was found murdered, at the bottom of a mine shaft in Joshua Tree, California. Evidence collected at the bottom of the mine shaft matched evidence found in the Jeep of the next door neighbors of Erin and her husband Jonathan. The Jeep was owned by another married couple. The husband of that couple, Christopher Brandon Lee, has been arrested and is facing first degree murder in the death of Erin Corwin...

And trial will begin Feb. 29."

Federal Appeals Court Calls Arizona Death Sentences Into Question

"WASHINGTON — A federal appeals court on Tuesday ordered the re-sentencing of James McKinney, sentenced to death in Arizona in 1993, in a decision that several judges warned calls into question 15 years of death sentences handed down in the state.

The 9th Circuit Court of Appeals, sharply split on a 6-5 vote, granted McKinney’s request that his death sentence — though not his underlying murder conviction — be tossed out unless the state re-sentences him under a constitutional system or imposes a lesser sentence than death “within a reasonable period.”..."

Appeals court reverses death sentence for Arizona killer

"TUCSON, Ariz. (AP) — Arizona inmates sent to death row between the late 1980s and 2006 may be able to challenge their sentences after a federal appeals court found that the state unconstitutionally excluded information in one case that could have led to lesser punishment.

The 9th U.S. Circuit Court of Appeals ruled Tuesday that Arizona’s “causal nexus” rule violated the Constitution. The rule required any mitigating evidence, such as mental illness or post-traumatic stress disorder, to be directly tied to the crime committed to be relevant in sentencing.

In the case of convicted killer James McKinney, that means a judge could have granted some leniency — and perhaps avoided the death penalty — had he been able to consider McKinney’s troubled past and abuse as a child. But McKinney’s abuse wasn’t directly correlated to the double murders he committed, so it wasn’t admissible as a mitigating factor in court. McKinney was sentenced to death in 1993, and the Arizona Supreme Court upheld the sentence three years later..."

The prisoners were released early over the last 13 years because of problems calculating sentences, the state Corrections Department said this week..."

Woman in Reno Hospital End-of-Life Case Dies on Life Support

"A 20-year-old woman at the center of an end-of-life court battle over her treatment at a Reno hospital has died while still on life support, her family's lawyer said Tuesday.

Aden Hailu died about 4:30 p.m. Monday at Saint Mary's Regional Medical Center, where she never awoke from anesthesia after surgery April 1, said David O'Mara, the attorney representing Hailu's father and family.

O'Mara said the family was told the cause was respiratory failure.

The hospital didn't immediately comment.

Hailu's father, Fanuel Gebreyes, lost a bid in court last week to delay brain electroencephalogram, or EEG, tests that the hospital said would show she was brain dead and wouldn't recover.

Washoe County Family Court Judge Frances Doherty had given Saint Mary's the go-ahead to conduct brain wave tests, but indicated she wouldn't rule until at least Jan. 22 on the question of life or death...

O'Mara earlier accused the hospital of wanting to pull the plug to cut costs. He said Gebreyes felt that that as long as there was a chance Hailu was alive, the hospital should treat her or find a place that would.

The father appealed to the Nevada Supreme Court after the doctors at Saint Mary's pronounced Hailu dead last May 28..."

Twitter revises policy banning threats and abuse

"Twitter has revised its rules of conduct to emphasize that it prohibits violent threats and abusive behavior by users, promising a tough stance at a time when critics are calling for the online service to adopt a harder line against extremists.

While the new policy unveiled Tuesday doesn't substantively change what's allowed, it may help Twitter answer criticism from politicians and others who say militant extremists are using the service and other social networks to recruit members and promote their violent agendas..."

New Year's Day: Hundreds of New Laws Across the Country Go Into Effect

"The beginning of the new year means hundreds of new laws go into effect starting Friday — from the rules governing smoking and carrying guns in public to regulations for getting wine in the mail.

Hawaii begins 2016 as the first state in the nation to raise the legal smoking age to 21. The law applies not only to the sale or use of tobacco products — including cigarettes and cigars — but also to smoking electronic cigarettes, popularly known as vaping...

And starting Friday in Texas, adults with the proper permits no longer need to hide the handguns they carry in their shoulder or belt holsters. Proponents of the new open carry law say making guns more visible will deter mass shootings...

While Texas is loosening gun regulations, California is tightening them. Beginning on Friday, it's illegal there for holders of concealed carry permits to bring handguns to school campuses...

Tennessee on Friday launches the nation's first statewide online registry of animal abusers, listing anyone convicted under state mistreatment laws. Sponsors hope to encourage more humane conduct and to keep animals out of the hands of known abusers..."

Singer Natalie Cole Dies at 65

"R&B singer Natalie Cole, whose hits included “This Will Be,” “I Live For Your Love” and “Unforgettable,” a virtual duet that she sang with her late father Nat “King” Cole, has died. The Associated Press reported she died Thursday night at Cedars-Sinai Medical Center in Los Angeles.

Cole died of congestive heart failure, and reportedly had experienced complications from a kidney transplant and hepatitis C. She had recently cancelled several concerts and suffered from liver disease.

“Natalie fought a fierce, courageous battle, dying how she lived … with dignity, strength and honor,” Cole’s son and two sisters said in a statement. Recording Academy president Neil Portnow called her “one of music’s most celebrated and iconic women” and a “highly cherished artist.”.."

You could be in pictures: Essay contest held for theater

"...Mike Hurley will give his twin-screen Temple Theatre located in Houlton, Maine, to whomever writes the most convincing 250-word-or-less essay on why they should be the next owner of what's billed on its website as "one of the oldest continuously operated movie theatres" in the state.

"The winning entry will be judged on ... writing structure, content, quality of expression (and) creativity," according to the rules Hurley set forth.

There is, of course, a catch -- or perhaps more aptly, a twist: the essay most be accompanied by a $100 entry fee, and there must be a minimum of 3,500 entries. If not, Hurley said all entry fees will be returned...

Hurley said his entries only thus far number "in the several hundreds," but he is hopeful that some national media exposure might give him a much-needed boost before the contest's January 31 deadline..."

GigiG,
Thanks for the heads-up on the Travion Smith trial. Indeed WRAL is excellent in live streaming trials. We have seen several over the years. I'll be watching. I think jury selection is in process. Correct?

All --

Unfortunately, Zuri had to put Knox down tonight. Sadly, it was also his 11th birthday.

She is heartbroken beyond belief. She wishes to thank everyone for all the jingles sent her way on behalf of Knox and her ordeals with trying to maintain a good life for him.

Knox was a remarkable horse, beautiful in every regard. And he was very much beloved. Zuri spared nothing in giving him the life that he deserved. She was meant to be his, and he was meant to be hers.

Please keep her in your thoughts and prayers as she attempts to manage this painful first chapter of her grief.
