Does that leave Caylee's Father tho? I would think so. So there again another plus for FCA as I am sure we will never know. Heck he may not even know :moo:

So in reality this was all about JB being able to mention his book, again. I did notice he did make reference to his book. Thank you AZlawyer and JWG for that you have done. It's because of people like you two that the truth will continue to come out.

I am guessing he thought this interview was to discuss himself and his book but it did not turn out that way..

Something is bothering me about what JB said- that the Defense team were all on the edge of their seats waiting for the Prosecution to bring up this computer search....
Doesn't the Prosecution share their evidence with the defense ahead of time in discovery?
Wouldn't they have known if Ashton/Burdick were going to use that computer data?

And, iirc, early on in the case both sides signed an agreement to disclose evidence.
LDB is a straight forward, no nonsense, brilliant Prosecutor and she delivered all the discovery she had to Baez.
For Baez to think that LDB would pull a Trial by Ambush is, in his own words, ridiculous...the lawyer in that court room that would attempt that is Baez. And did he not try to do that with expert Jose Rodrigues? or was it Eikelbloom

On June 21, 2011 (see my signature below for the link to the WS discussion on this), the prosecutors announced that they planned to use computer activity from June 16 to challenge JB's opening statement. JB was clearly terrified and argued that they had failed to disclose this "new evidence" to him. HHJP said it wasn't "new evidence" because they had disclosed the ENTIRE hard drive to him, and only an idiot would have failed to look at June 16.... OK, he didn't word it exactly that way, but it was close.

ETA: Obviously, the "new evidence" wasn't what JB was worried about (the foolproof suffocation search)--it was just a general activity report.

I believe that if LDB had the computer search info on suffocation she would have used it in a Plea Bargain.
What are your thoughts on that AZ?

I have alot of respect for the OCSO and the prosecution team but agree with you.

I am not willing to accept that this jury would have ignored this evidence. Yes, it is possible - but it is also possible that a clear, concise timeline presented in a visual aid showing that this could only have been Casey making these searches may have led to a conviction.

Just my two cents. What a tragedy this is. :banghead:

Now that you mention visual aids...LDB did say that they asked Lawson Lamar for funds for visual aids,..posters?? like the ones Baez used, and he turned them down.

What I meant was they may be going back and re-checking since the timeline has been challenged and shows their findings were incorrect

In the end, it was <modsnip> who brought the evidence to light after reading about it in Baez&#8217;s book. With the help of <modsnip>, a fellow member of an online Websleuth community, they requested the data and were able to extract the evidence. Once they found the searches, they turned their findings over to Local 6.

He made this revelation to boost book sales. How ironic this would be if it lead to a civil case against her. She probably left a slew of curses on his voice mail. I hope she stays under the rock she crawled under.

Well, actually, in a roundabout way, they did discuss the book. Without Baez's book, we would not have been aware of this little ' fool-proof suffication' tidbit.

Casey has her lawyer to thank for this new evidence against her. LOL

umm...maybe they should be forthcoming and also describe their legal analyst as a "blogger" since he has posted here himself on many, many occasions.

I mean I am getting really, really tired of the "blogger" description as if it is something less than admirable and cast some sort of doubt on the quality of the info uncovered.

Burdick said she never asked investigators to search for the term "suffocation" specifically before or during the trial but that, "I asked for a full history of June 16, 2008, before trial. I have those emails."

uh..yeah, she sounds pretty clear here that she thought it had been done thoroughly. I imagine she is not too happy to discover this.
