Sleuthing Cindy's Depo & Baez Objections to Sealed Items

Yeah, the use of the word "sealed" is very interesting. It means it is something that has come before the judge already and he has decided to keep it off of any public records at least until trial. So that would be any photos involving the remains, and some elements of the contracts and payment agreements between JB and KC.

The only way I could see JB blocking the deposition because something is "sealed" at this point would be if CA was naming something that KC gave him specifically as part of their financial arangements. And even then I really hope that the SA was asking for a closed door meeting with the judge to resolve whether those items were in fact appropriate to seal, or whether JB is using that to mask actual incriminating evidence.

One more thing: Just following through with some thoughts on the $$$ for pictures possibility. IF this is what happened - KC took pictures to JB. JB (or someone through his office) brokered a deal for $$ for exclusive rights to these pictures then KC would be REALLY mad at her parents for also selling photos, videos to whomever they sold them to because it would have impacted any future deals KC might have made. Only so many pictures out there, don't ya know.

A couple of quick thoughts.

1. Whatever it was that Baez objected to, it wasn't accidently broached by the SA. I don't see the SA making that mistake. Whatever it is, it is something that the SA thought they might be able to lead into and around about without violating court order, but still get the info out there~ I have a feeling it's highly damaging to the defense.

2. The question immediately prior to Baez' objection (and what looks to be close to a melt down heh had to get the dig in) by all appearances seems to be about photographs or items that KC may have removed from the residence and taken into Baez office. (just my thoughts from reading and rereading).

3. I haven't been able to find a list of all motions to seal. We might find a clue if we can find those motions.

4. I also want to note that in LA's depo he states on record that the throw away phone he purchased for KC was sent to Baez's office in a box along with the binder(s) and other paperwork (we saw a picture of KC in her stolen blue shirt from target and her snazzy white sunglasses carrying a binder).

5. One last question~ what is the responsibilty legally for a defense attn to disclose what he has to the State?

Why would there be a tooth? Caylee was not even 3 yet. There should not no tooth from Caylee? Could KC have brought Caylee in after she died and laid her on the bed and those hairs recovered from the bed show signs of decomp?

I just almost wonder if that tooth was discovered in the car. Perhaps, mind you this is all JMO, Casey hit Caylee while in the car and knocked out her tooth. Perhaps, George or Cindy while cleaning the car found it. Or at home for that matter

I believe it's about money for the photos and videos. That's right where JB interrupts. Cindy states in her depo that they only received money for the 48 hours show. It has been reported that over 200,000 has been paid out for photo and videos from various media. JB says this info will come out but he doesn't want it made public now or words to that effect.

I know others don't agree with me in my belief that Caylee was in that trunk a LONG time. And I know others don't agree with my belief that the tape was placed over her mouth and nose because of decomposition fluids...

but just for a second humor me. If Caylee WAS in the car long enough to really start ... getting ... bad. - Baby teeth have no roots. Is it possible that they become loose very quickly during decomposition?

I don't know the answer to this, so I'm just asking.

Not sure if you caught it, but when I revisited the March 25 clip I posted earlier - the one that lead to the side bar, Ashton was pretty strenuous in tone that day. He & JB got in a bit of a heated exhange after the sidebar. Ashton was very upset that JB implied the State would leak the sidebar and he took much offense to JB implying that the State might behave unethically.

I note that Ashton had the some tone with JB during Cindy's depo after they come back on the record. Ashton says something along the lines of, "Anyone who could spill it already knows the answer, and any of those people could spill it if they were so inclined."

To me, this is definitely related to funding somehow - and something Casey provided to JB for that funding - which arrangments CA didn't know about until this depo.

I'm still married to your theory. Whatever it is, it is a real hot-button for the state when it comes to the ethics in this case.

I don't think Casey would have given anyone (even JB) those hairs if she knew there was any chance of them showing decomp (which she would have realized if she had laid her body there). After the hair with decomp they found in the trunck I think she would have been sensitive to this possibility and avoided it. Just :cow:

I checked the autopsy and the tooth that was missing was an incisor. One of Caylee's front teeth.

I don't know whether they were sealed or not. I do remember the FBI talking to GA about some pictures they had come across, but I can't find anything about them being sealed - perhaps someone can set us both straight on this.

Finally ....... found this:

Judge Stan Strickland set a trial date for October 12. He also ruled against the defense motion to block the release of picture from Casey's photobucket account.

My big question of the day:

- is there a picture that is a smoking gun or shows a smoking gun that the SA cannot release under the Sunshine Laws because it is sealed? What would cause this picture to be sealed? If it is one that was sold?

Having said all that, I think the crux of the objections here is because any proof that KC is paying for her defense by selling pictures of the baby she murdered would cause a huge feces storm. And if JB brokered those deals, profiting off the sale of pictures of his client's murdered baby, well... the feces storm grows.

Consider this: if you were being paid via the sale of pictures of the baby your client murdered, wouldn't you too keep saying your client was innocent of that murder?

What mother would ever allow that to happen ??? I for one, would NEVER allow any lawyer of mine to profit from anything having to do with my daughter, had she passed away. I can just see Casey nodding and smiling at Jose, "oh Absolutely you have to get paid, Go right ahead. sell as many as you can." Giggle, "Just make sure you put some of that cash in my snack account", Wink. Really despise these two ...hope they choke on their twizzler.

Just a thought...could the tooth referred to be KC's baby tooth? Most moms keep the baby teeth. But why would they even want KC's baby tooth? :waitasec:

Let's also remember the add on comments KC made during one of those motions. The one where she stated the JB did not have current of future rights to sell her "story". I always thought that the fact that she stated "story" as opposed to rights to story, photos, video, or likeness of Caylee, to use for his own profit was odd. I know we are all outraged at her selling "Caylee" for her own defense.......but I do want to point out that while her actions are nauseating, the fact that she used the money to hire [Baez]instead of someone legit.....is karma at its best. I think we now know why JB consulting with an ethics attorney early on.

Additional thought......perhaps the other list is one that itemizes the photos / video / visual media that KC used as part of her payment and that are part of the "payment plan"....or a doc giving JB the right to broker them. That info would fall under the "sealed" category unless it was an unofficial doc and never entered formally as an exhibit. If it is just notes made....that may explain why the SA tried to get it entered AND why JB brought up "sealed".

Please note also that earlier this same week (July 28th) is when the State asked for transcripts of the side bar from March 25! Doing their homework in prep of the depo. Unfortunately no trascripts exist of that, but there is a transcript of the meeting both sides had with Judge strickland later that day.

The WFTV video did not have the full hearing - the last 10 minutes were chopped off (from the in camera hearing to the end).

I have it saved and watched it... after the in camera hearing, Judge S says basically that the matter is settled to his satisfaction.

Then he says "I have just one more thing. If the attorneys could approach for a sidebar."

This sidebar lasted for about 5 minutes, with Ashton, LDB, Baez and Judge S, and no record exists of it other than their memories. This is the transcript the state requested the week of July 25, right before Cindy's depo. It was not recorded by the court reporter. Afterwards is when Baez and Ashton got into it, and Judge S says he's tired of this crap (paraphrasing, of course... )

It seems like an odd sidebar, as no matters were being heard by the court. It does not seem to have anything to do with the in camera meeting about his retainer agreement with Casey.
