Yep. Not to mention, Det. Stoddard testified at the hearing that he could see in the vehicle.

I was with my mom when she died and this did not happen, and my brother and I were in the room with her for an hour or so afterward.
My dad died at home around 5:30pm on the night before his birthday. My mom asked if it was ok if he wasn't picked up until after midnight so it would be his birthday when she last saw him. That's what happened and I don't recall any bad smells even though he was dead for seven hours before he was removed from home. JMO.

Not to be disrespectful... I hate even typing this...but the heat was not cranked up to 120-130 degrees in the full sun, inside your moms house.

There are witnesses who said he did attempt CPR.

The only witness I heard say that RH attempted CPR was that dude at the PCH. His name escapes me at the moment, but he said he thought RH grief was "organic" :giggle:

That guy was a trip, lol!

Does Forgotten Baby Syndrome have a precedent? Anywhere? If not, that defense won't fly. And in my opinion this is not the case to set a precedent. Any lawyers here? Help! JMO

Jayde Poole and Lyn Balfour, to name a couple where an expert testified at their trials specifically about FBS. It's gaining support from advocates and I think we'll see this defense used more and more as time goes on.

The problem with this defense is that there's no medical test for it and no history of forgetfulness is needed. All that's required is for the parent to say “I forgot.” Unless there is other compelling evidence – like in RH's case – an expert only uses a parent's self-reported declaration.

In fact, a parent who intentionally leaves a baby in the car only to find them ill or dead later is better off claiming to have forgotten. That's how simple it is. The good news is that modern technology like CCTV and data forensics can help capture the real story. And in RH's case investigators are doing an admirable job of compiling a mountain of evidence that will put any notion of an accidental forgetting of Cooper to rest.

ETA: Also, an FBS expert sometimes includes evidence like a 911 call in their analysis and testimony. In RH's case he didn't call 911 so obviously it can't be used. If he thought he was oh so smart to avoid having his voice recorded it could very well backfire on him at trial.

Sorry for your loss. Wouldn't the high temperature in RH's car for 7 hours contribute to the odors of decomposition as well as dirty diapers and/or vomit.

Jmo and I am well aware of being in the minority but I think it is possible this is when he realized he had forgotten to drop off Cooper. And spent the afternoon deciding how he would deal with it. Or maybe even as he approached the car after lunch, it hit him, which might be why he did not look back, if he did not. A d was so quick about it. He knew what he would see. Jmo anyway. Just not 100% on premediated.

clu, that's the exact thing I thought happened before the PCH. I thought he had forgotten him and then remembered and went down to the car to check. I thought when he saw him dead he went into CYA mode and went back into work and 'googled' about hot car deaths.

After the PCH, I believed he did it on purpose.

I love how during the hearing there were folks who adamantly insisted that they wanted to see the evidence. They did not want to simply take Stoddard's word under oath.

Okay, fair enough. I am a show me the evidence gal, I could support and understand that stance.

Suddenly, now that AJC says there are discrepancies based on their "review" of the surveillance, nobody needs to see the evidence to conclude that Stoddard and the DA are big fat lying railroading embellishers. Now those same individuals do not need to see the evidence themselves to make a determination of its validity, relevance or meaning???

Re-listen to the defense speaking to Stoddard. Even he admits it.

I haven't been on in a few days, so I don't know where this part of the conversation is coming from, BUT a two year old that wasn't buckled in would have been all over that car, probably could have even opened the door, based on my experience with 2 yr-olds
. The fact that his body was stiffened into the form of sitting in the carseat, I would think would show that he was in fact buckled into it.

Maybe, like my earlier post about my mom, it was that there was no bowel activity after she died. Not sure, do not want to speak for another poster though.

I wanted to see the videos BEFORE the AJC article came out, and I STILL want to see them for myself now.
