Judge Chetty has declared Babalwa Breakfast a hostile witness which in effect means that she will be treated as if being she is a witness for the defence. Stander can now cross-examine her and ask leading questions.
 
Breakfast is running a huge risk of being charged with perjury.
 
Breakfast was crying hysterically as she was taken to the holding cells when the court broke for lunch. As none of the advocates have any further questions for her, it would appear that charges are going to be laid against her.

ETA She's been taken into custody.
 
Breakfast will be charged with perjury and defeating the ends of justice. She will appear in the Magistrate's court tomorrow.
 
This must be the loneliest little thread on WS. What a shame. It's an excellent trial.

Poor Jayde! She was gorgeous and seemed to just want to be loved in her marriage. It's a shame that her husband was such scum. So much so that his own father tried to force him to be a man and treat her right. I wish she would have found a man that deserved the lovely person that she appears to have been.

I'm glad the middle man flipped so quickly and easily.

I felt he was guilty long before the trial, however I always sit on the fence until I've heard the accused's version. I can't believe the co-accused would have done this except at CP's direction. What motive would they have had other than stealing the contents of her handbag and perhaps her engagement ring. The mistress, the debt, his obvious lack of time spent with Jayde, using someone's words in his eulogy all point in one direction. As they had been together for 11 years and the affair started before his marriage, I really do wonder why he got married in the first place. Maybe Coutts wasn't suitable wife material and he wanted to have his cake and eat it too. Obviously CP's father was very unhappy about the affair but the parents will stand by him because he's their son.

The call charge records will no doubt be the most important evidence. Whatever CP denies, he can't get away from that even if other witnesses are discredited as in the case of Breakfast.

As there are so few following this trial, it's interesting to see that several of us are Aussies - Estelle, SweetCaro, (?) PrimeSuspect and me. I just hope others can join me when the trial is on.
 
Det. Botes has refuted claims alleged hitman Sizwezakhe Vumazonke (the hitman) was assaulted by police. He says Vumazonke bumped his head during the arrest, resulting in a swollen eye. Sizwe was the person pictured in many media articles with a very swollen eye and he’s shown in the link below.

Yesterday Breakfast said that her boyfriend, Thando Siyoli, had a swollen eye and a cut to his lower lip, but to my knowledge he hasn’t been shown in the media with an injury, possibly because he’s a section 204 witness. So there were 2 suspects who sustained an injury to their face.

How can CP be innocent in light of the taped conversation that appears in the link below? This conversation is no doubt the reason why the defence wants Siyoli’s evidence to be ruled inadmissible (possible trial within a trial) and are saying that he only made these admissions because he was beaten by the police.

But Constable Yandiswa Kumla said he had written down exactly what Breakfast relayed to him.

Kumla took down Breakfast’s statement and commissioned it at the Kabega Park police station at 3.20am on April 28.

“I did not know what the case was about. I was only told to take her statement because she is more comfortable speaking Xhosa,” Kumla said.

He said he had read the statement to Breakfast before handing it to her to read once more.

There were a few changes to be made and Breakfast was asked to initial alongside those.

The state turned the tables on its own witness yesterday, charging middleman Luthando Siyoni’s girlfriend with perjury and defeating the ends of justice for backtracking on two affidavits in which she revealed everything she knew about Jayde Panayiotou’s murder.

The effect of staying declared a hostile witness is that the State could cross-study Breakfast as if she have been a defence witness.

Question: Why don't the SA courts record the police interviews to avoid this situation of Breakfast lying?

The first vehicle, a Toyota Etios, was hired by the hitman, Sizwe Vumazonke. It had a tracking device installed. On 23 April he returned the vehicle and exchanged it for a Polo Vivo.

I raised this point a number of times in the OP trial. If they videotaped it there would be visual evidence as well.

I also said during that trial that serious crime scenes should always be videotaped. This stops the "tampering, moving" etc. claims by defendants. It also stops a lot of theft by police officers during searches.

The police found blood in the boot of the Toyota Etios.

The State's next witness is Babalwa Konzani who was an assistant manager at the Infinity Bar which is owned by CP. BK knows the middleman Thando Siyoni who worked at Infinity from when it opened until gambling machines were installed. He left but returned in September 2014 and was employed as a guard at the front door of Infinity. She also saw him at other places where he worked as a bouncer. BK said Siyoni was just another employee at first but then became close to CP. Siyoni started work on Fridays and continued over the weekend.

BK worked with a woman named Noxi. She also knew a man named Mawonga who worked at the OK Grocer (owned by CP) and also worked as a handyman at the bar. She said from what she could judge, Mawonga and CP were very good friends.
