Court in session. Stander opposing Daubermann's application. He says there will be typo's and grammar errors

Stander will focus on certain exhibits for his argument. Phone billing, tracker etc

Stander says it is clear that Siyoni recruited Vumazonke and a car was rented. The question is who was with

Stander points to fact that Vumazonke and Nemembe never spoke to each other prior to April then they communicated 89 times

Stander says on 9 April Vumazonke had several conversations with Nemembe, Khusta, Sibeko

Stander says when they went to Swanepoel's house they all communicated again. Communicated with Sibeko several times

13/15/16/21 April communications were between 4-6am (Stander calls this ridiculous hours)

14 April 7 calls between Vumazonke and Sibeko (Sibeko calling). Stander says Sibeko can challenge this

Stander says they could have answered simple questions. Were these their phones? Did they make calls etc

Stander says their argument is ridiculous-he will tell the court why these two have not answered these questions thus far

Stander says phone evidence cannot be disputed. Vumazonke phones Siyoni who then phones Chris etc

15 April nine communications between Vumazonke and Sibeko . First call is before 5am. Nemembe also called

Stander says it is interesting that Sibeko made these calls. Why? The car moves until both handsets are together

Stander says explanation is simple. They are both in same car. If not? then surely Sibeko could tell us that?

Stander says on one day 31 calls were made between Vumazonke and Sibeko. Why is he keeping quiet?

Stander says it is simple. He could challenge this by telling the court why and what they were talking about

(Stander is going through his argument day by day leading up to murder by comparing phones and GPS )

Stander points to his argument where Siyoni received a call moments after Jayde was killed.

Stander says it was never the State's case that Nemembe was present during murder (as Daubermann argued)

From September '14- murder there is not one instance where they picked up tower near murder scene

Stander says we dont always have to rely on evidence from state witnesses, we can look at other billings

Stander says phone shows that Vumazonke was in Kwazhekele after murder (to visit Sangoma) yet the vehicle was not!

Stander asks who was in car and where were they going while Vumazonke was not present?

Stander says evidence shows that Nemembe and car were still together. He maps out car's journey and towers

Evidence shows car parked at Nemembe's house, and later in Parliament street. (at this point after 12pm on day of murder)

Stander says it is quite clear that Nemembe travelled in Etios on day of murder

Stander states case law where person was convicted on cellphone evidence which was also considered circumstantial

https://twitter.com/alzammer

Stander will now focus on circumstantial evidence and is bringing up more case law

Stander says accused 3 and 4 have not given this court any explanations

(Stander keeps putting his glasses on and takes them off if he makes his point)

https://twitter.com/alzammer

"As we are standing here, SN & ZS have given no explanation."

"Without any explanation from them, they should not be granted discharge at this stage"

(Stander hints Daubermann had good argument with reference to Sibeko, but he will prove that sim was in his possession)

Stander brings more case law about guy who killed girlfriend in caravan. Woke up one morning she was dead and he alive

Stander says this guy had intimate knowledge. He says there is no reverse onus on these accused

Stander gives examples of how Sibeko could have challenged his evidence.

Stander says Nemembe's phone is plain sailing. It is clear he was using this phone. Now Sibeko....

Daubermann said State could not prove beyond reasonable doubt that phone belonged to Sibeko, Stander says he can

Stander says long before his arrest there was communication with Vumazonke and number was saved as "Zolani"

In July 2016 (Day of arrest) Sibeko's handset had same contacts and phoned the same people as April 2015

Stander says it all indicates that phone was used by same person. They have proved beyond reasonable doubt

Stander says he has a mountain of evidence against them. Daubermann says Stander does not give up easily

Daubermann says this mountain of evidence is nothing but a house of cards, which has now collapsed

Daubermann points to range of towers again and the contradiction between Vodacom and MTN witness

Daubermann says Stander should have called an expert, says now Judge is in the dark

Daubermann brings up Stander's comment that accused communicated at "ridicilous" hours

https://twitter.com/alzammer

I think she means Sibeko, not Nemembe.

This is confirmed here

[FONT=&quot]In addition, Nemembe’s handset placed him at the scene of the murder.

I think 16-20th October must be the correct one because it is a whole week and mentions the end date of 20th. Also the 6th Oct is a Friday.

Thanks again for all the tweets JJ. Much appreciated.
