Defence recounts normal family evening watching Star Trek

Earlier, defence lawyer Pieter Botha read van Breda's account, detailing a normal family evening that included dinner and a Star Trek movie.

Van Breda said he went to the bathroom later that night, heard banging sounds and opened a door to see someone attacking his brother with an axe.

He shouted for help and his father entered and accosted the attacker, who was wearing a ski mask, according to van Breda's account.

"The attacker was laughing," van Breda said.
"I heard my mother's voice saying, 'What is going on?'"

He said there may have been at least two attackers, and that he suffered minor injuries while wrestling with one of them.

He called emergency responders several hours later, according to South African media reports.

Van Breda, who also has been charged with tampering with the crime scene, was found by police sitting outside the house, his clothing stained with the blood of the victims, according to media reports.

Investigators found a bloodstained axe and kitchen knife in the house.

Van Breda was later released into the care of an uncle, and was barred from contacting his sister.

Police Sergeant Adrian Kleynhans, the first officer at the crime scene, testified in the Western Cape High Court that he smelled alcohol on the breath of Henri van Breda.

Sergeant Kleynhans said the suspect "appeared emotional, like he was blowing off steam, and was nervous but wasn't crying", the African News Agency reported.

The police officer said he saw a laptop and a handbag with cash on the bottom floor, and that the area did not resemble a normal burglary scene in which things are usually scattered around.

Stellenbosch police sergeant Adrian Kleynhans, who has been in the service for 22 years, has taken the witness stand.

Kleynhans, who was the first policeman on scene, says he received a complaint about a fight and a possible crime scene at the security estate.

But he says that he and his colleagues had been given a different address and were blocked from entering the premises by the estate's private security.

He adds they had to first get permission from the De Zalze Estate management despite driving an official police van.

He explained the front door of the home was ajar as he approached with his pistol, angled at 45 degrees towards the ground.

Kleynhans says an emotional Henri, wearing white socks and covered in blood walked towards him from the inside.

He then found the body of Theresa and an injured Marli on the first floor.

The sergeant also mentioned he discovered items including a laptop and a handbag containing money at the scene, that would likely have been taken if a burglary took place. Proceedings have been postponed until Tuesday.

Kleynhans said Van Breda had smelled of alcohol.

The police officer had found no evidence of forced entry, but also no evidence that someone had cleaned the crime scene.

He said nothing had looked out of place on the bottom level of the house. A laptop and handbag, with cash still in the wallet, were on the table.

Kleynhans said he had seen one of the women moving a leg and told his superior to contact paramedics. After they arrived, the scene had been cordoned off.

White walls of 1.3 metres high surrounded the house, but none had had scuff marks on them. Kleynhans said a black gate with a key in it, which would have been used by the intruders to exit the property, had been closed.

He had also seen emergency numbers stuck on the fridge. The axe and the knife used in the attack had been shown to him. While he recognised the axe, he said he did not recognise the knife.

Judge Siraj Desai described the axe as one used for chopping wood, about half a metre in length.

Kleynhans is expected to finish his evidence-in-chief on Wednesday.

1. He had watched a movie with his brother and father. They had gone to sleep and he had continued watching an animated movie and playing games on his phone.

2. He had been playing games on his phone when he had gone to the bathroom, and that was when, he claimed, he had heard loud bangs. When he had opened the door, he had seen his brother being attacked by a “laughing” axe-wielding intruder, he said.

3. His father had then confronted the man and was also attacked. He had heard his mother shout, “What is going on?” The attacker, he claimed, had seemed “unconcerned” about his presence.

4. He claimed he had wrestled the axe away from the man and been “surprised by how easily I disarmed him”.

5. The man had also had a knife and had cut and slashed at his chest, also cutting Van Breda’s left arm, he said.

6. Van Breda said he had managed to strike the attacker with the axe and flee the room. Van Breda recalled his brother writhing on the bed. He had also heard angry voices, speaking in Afrikaans.

7. Marli and his mother were lying on the landing.

8. Van Breda said he had then fallen down the stairs. The kitchen door was open and he believed there had been at least two attackers.

9. He said he wanted to call emergency services, but had no idea of the number, so called his girlfriend instead. She didn’t answer.

10. He had then found an emergency number but had failed twice to get through. When he had finally got through from the landline, he had tried to remain calm. He said he had spoken calmly in case the operator did not understand his Australian accent.

11. He had gone outside to show the ambulance service where the house was. When police officers had arrived, he had told them to go upstairs.

12. Police had taken his clothes, leaving him in his boxer shorts. His stab wounds were dressed.

13. Van Breda had told the police he thought the intruder was a black person, he said.

14. Police had told the doctor attending to him that they thought his wounds were self-inflicted. At the police station, the air conditioning had been turned up, so he had been “freezing cold”.

15. He said the police officer had told him he did not believe a word of his “******** story”.

16. Van Breda said that by the time he had signed his statement, he had been exhausted and in shock and had not been warned of his rights.

I cannot understand how anyone, on trial for these kinds of horrific crimes, is allowed freedom, even for years . Same for OP. Why are they not held in prison to await trial? Imagine having van Breda staying with you! Hope the shed was cleared of any axes!

2. HvB gave a slight laugh when he phoned emergency, it seems he's describing his own behaviour that night.

3. I'm thinking Theresa called this out before she entered the room, she heard HvB arguing with his father?

4. IMO, self-inflicted.

IMO, HvB is describing the situation like he stood outside himself while he was attacking his family and he remembers it that way.
It's incredible that no drugs were found in his system, so he was fueled by pure adrenaline induced by a psychotic episode or, revenge due to a personality disorder? If HvB bought the axe earlier that day or before, this was a planned attack therefore it rules out temporary psychosis. Was he craving his drugs and resented his parents interference in obtaining them?
Is he just bad to the bone?

I can't believe it either and the police suspected him from the start. He's not making sense but hopefully he takes the stand and the state make mincemeat of his idiotic story.
