State rests rebuttal case - thread #169

ANY bullet wound through the skull with brain adjacent to it would HAVE to penetrate the dura simply because the skull, dura (plus two other membrane layers: arachnoid and pia mater) and brain are like layers smack up against each other.. Too bad the ME was on autopilot (IMO) when he dictated a phrase he has probably dictated 1000's of times ("dura mater is intact"), but given the number and severity of wounds he had to document, it is a relatively minor error since common sense tells anyone who knows any basic anatomy that ANY bullet wound through the skull with brain adjacent to it would HAVE to penetrate the dura. MOO.

God I hope you are right

Yes he did. And remember, he said he has performed 6,000 autopsies. If the jury comes back with anything less than murder one, I will believe they came from Pinellas County, Florida, and will cease to believe in justice ever again!

Exactly. If one little typo from the M.E. makes them come back with anything else then they didn't believe in the state's case to begin with.

The Judge has her hair pulled back into a ponytail.

Good ... it looks like she is sticking to her word -- keeping them there until they finish this evening !

I hope so ... enough is enough !

:moo:

I agree. I've been saying it. I know none of us here wants to think or believe that, but it's become pretty obvious over tonight that it is so. Please God, no hung jury. Please.

I just don't get it. What's to agree with? That she didn't plan to go to Mesa, armed to the teeth? That she didn't shut off her phone, fill cans with gas, flip her license plate upside down, call a dead Travis' voicemail, send a dead Travis an email, send his grandma flowers, or write an 18 page letter about ninjas killing Travis to his family?
What am I missing? What is there to hold out for, or onto at this point?:banghead:

what was the typo....,anyone....

The autopsy report said the dura Matter (sp?) was intact when it actually was not intact - the bullet pierced it.

It was a type -per the doctor but it was an error on the autopsy report.

I'm am all on the Juan train no doubt, and will hang on until either lock her up forever or put a needle in her arm. But if one of the DT's witnesses had a typo in their report. And the actual report on how the victim actually died....JM would be all over that like a spider monkey.
Just sayin'.

Maybe the juror wanted to get the correct answer? Doesn't mean they're pro DT or anything. I don't think a typo is anything to be sickened over. A typo is not going to be the end all be all of this case. If we were all sitting together I would make all of you strong cups of tea. It's almost over guys. Cross your fingers, pray, do whatever it takes. The end of the trial is drawing near and we are all terrified but all we can do now is appreciate Juan and his hard work and pray that justice prevails.

I thought the Scott Peterson trial had a hung jury and they just called in an alternate and got the guilty verdict. Did that not happen? Is that what happens?

oh dear, will be Juan is thinking, oh crap-- it is a huge moment- and calls into question the testimony of the ME- i hate to even say that

It really is no big deal. There was one bullet hole in the skull. The bullet ended up in the sinus. Therefore, the durameter was damaged because the bullet penetrated the skull through the durameter.

It's not like it was a questionable conclusion and he wrote one thing and said another. It's a typo.

It's really not an issue as to any fact.

For those of you freaking out over the typo, I have 2 words for you: gas cans. I have 2 more for you: "stolen" gun.

With all of Willmott's to and fro-ing up to the bar, they are going to have to replace the carpet in the courtroom when this trial is over.

I suffered a compound depressed skull fracture when I was a kid. I was in a rope swing in our barn and the rope broke, my head hit a tractor first and then the cement from appoximently 12 feet high. I had a tiny cut on my head but the back of my skull shattered and sliced through the dura. Just bone fragments mind you, not a bullet perforating it. I can tell you the damage is extensive.

I doubt it. It is REASONABLE to believe it was a typo. Not dealing with scoring tests here, either. Fact is fact.
It's not only reasonable, but in his answer he said why it had to be a typo - because the underlying bone was perforated. That is in the autopsy report, btw. I do wish he had expanded on that part of his answer a little more, to make sure it didn't get lost in his testimony.

TYPO: in the ME's report he said the dura mater was INTACT yet in order for the bullet to have penetrated the brain it could not have been. He says the dura mater must have been perforated and saying it was intact in his report was a typo.
